Affordable care act should be struck down in its entirety. That set off, according to a white house official i spoke with, a heated debate in this administration over what exactly to do going forward, whether the administration should support this ruling striking down the entirety of this Health Care Law, or whether it should maintain its previous position, which was that only certain parts of that Health Care Law should be invalidated. This all culminated on monday in a legal filing by the Justice Department, which said essentially that it did agree with this federal judges ruling striking down this Health Care Law in its entirety. This is setting off some consternation among republicans and it is part of the reason why there was such an intense debate in the administration, because there is no clear republican alternative to obamacare. If this law is indeed struck down, if it is upheld through the appeals process, that ruling, well then 20 million americans could lose their health insurance. As of now, the president has not put forward a clear plan as to what exactly would be the replacement there, but he did say yesterday he did seem to be excited about this new debate over health care, saying he believes the Republican Party will become the party of health care. This is all setting up for health care to be a central part of that debate heading into the 2020 reelection campaign. Democrats, of course, have been energized by this issue of health care. This is just putting it all the more at center stage. As of now, this administration is working to find some kind of alternative that it can really put forward here working with congress. As of now, that has yet to emerge. 20 million americans, their Health Care Coverage could be at risk if this decision is upheld. Critical repairs to the boeing 737 max 8 and the aircraft certification process in general. In Washington State boeing will unveil what it says is a software fix for an antistall device that investigators see as a possible cause of two recent deadly crashes, hundreds killed. In washington, d. C. As well, a senate panel is set to grill regulators on the longstanding practice of letting the manufacturers vouch for the safety of their own airplanes. Imagine that. The head of the faa is expected to promise significant changes. First lets start with boeing. Boeing finally, you might say, coming out with what it says is a fix to correct problems that may have led to two fatal crashes. How do we know this fix is going to work if its the airline that is saying it works . Reporter well, its actually up to the faa. Boeing will be submitting this software fix to the faa, and that process will continue. Meantime, boeing is actually not only going to be working on the software fix, but also doing this massive outreach. Theyre hosting 200 pilots amid entry stake holders at their facility outside of seattle today where they assemble the 737 max. This is a session that will center on the 737 max itself as well as this planned Software Update. So weve learned that the Company Plans to submit it to the faa by the end of this week. This is really a Software Update that could resolve those issues that aviation authorities believe led to the crash of that lion air flight in immediate these ya back indonesia back in october. The Software System pushed the nose of the plane down whale ile pilots fought to correct course. Software designers submitted this first version of the software foix the faa back ix ta on january 21st, more than two months before the crash. The first version was submitted to the government when the government was actually shutdown. The faa saying the shutdown had no impact on the rolling out of this new software. But no doubt there will be a lot of questions for the faa today. You have the issue of the plane. Then you have a tthe bigger iss of how planes are certified. The manufacturers in effect police themselves on this. Is that something that could change as a result of this following this Senate Hearing . It seem that is the acting faa administrator might give a hint that there are some potential changes coming to that selfcertification process because weve seen his planned testimony, his opening remarks. And that seems to be the case, that theyre going to be changing the selfcertification process that boeing did use with this 737 max approval process, hinting that the changes will actually be coming this summer. As such, in the testimony today were expecting the acting administrator per his testimony will acknowledge that the agencys oversight really needs to evolve after these two fatal crashes involving the boeing 737 max. But at the same time, jim, ive read the remarks, about ten pages worth. We know the acting faa administrator will also be defending this selfcertification. They say it was a lengthy review process over a number of years for the 737 max. So these will be in the opening remarks, but there will no doubt be a lot of questions from these senators asking about this process and of course the Staffing Levels at the faa as well, whether or not theyre prepared to handle whats a very intricate process. Whats the background of the current acting faa commissioner . He is still in an acting capacity. Thats one of the issues for the agency itself that they dont have a director whos permanent in place. He could face some scrutiny for not making that more of a priority. This is a hearing that could potentially have some fireworks. The prosecutor who surprisingly dropped all the charges against Jussie Smollett says he still thinks the actor is guilty. Do you think mr. Smollett did what he was charged with doing . Yes. We stand behind the cpds investigation in this case, the tremendous work that they did in investigating this case. Do you consider him innocent . No. Okay. So why were the charges dropped . The investigations are not done. Now the fraternal order of police is demanding a probe into the Cook County State Attorneys Office and this decision. Cnn National Correspondent ryan young following these developments. As you heard, rahm emanuel and the Police Superintendent are outraged by this decision. How did this happen. I was quite shocked by all the running around we did because even was surprised these charges were dropped. I think in this case there are no winners here, not for the city, not the police department. Even jussie didnt win here. His voice has been magnified because so many people rushed to judgment when he first put out that first bit of information. You saw people even running for president come to his defense and basically call this a modern day lynching. From there you had 12 detectives working this case around the clock to try to figure out who did this to Jussie Smollett. Then they found two guy who s wd gone to nigeria. In the 47th hour of holding them, they started giving up information that they were able to sort of turn this entire case and start pointing to Jussie Smollett. We were live when this happened when the Police Superintendent stood up there and gave that lengthy explanation about what they believe was the push in this case, that Jussie Smollett, according to police, wanted more money and he used this to get attention. All this has been swirling for quite some time. The entire time smolletts team has been saying hes innocent. All of a sudden the charges were dropped, emergency hearing. We were quite surprised. Listen to rahm emanuel, the mayor of chicago, talk about this and how it looks on the city. You have the state Attorneys Office saying hes not exonerated. Hes saying hes innocent. They better get their story straight. This is making a fool of all of us. Theres some hard feelings when it comes to this story because theres so many people who want answers. Lets not forget this case has been sealed. As a reporter, i cant go down there and look at all the evidence they gathered in this case, those detectives working. It will be interesting to see what happens next. Dont forget the two brothers involved in this case that talked to the grand jury, theyve never talked before. It sounds like the prosecutors argument here is that for similar crimes like this, theyre often not prosecuted or not sentenced with jail time, et cetera. And therefore, though they think hes guilty of this, theyre not going further. Is that a fair argument . I think thats an accurate assessment, jim, of how the Prosecutors Office is spinning this. I have to tell you that i think the Prosecutors Office just gave themselves a big black eye. Their handling of this matter has just been astonishing and i would even go so far as to say incompetent. Yes, there are cases like this where you have a low level offense like this is being called by this Prosecutors Office where you have an individual that doesnt have a criminal past, where they havent been involved in any Violent Crime where they are allowed to do community service, pay a fine and they dont receive jail time. Yes, were all familiar with those cases. But there are so many differences to this case. One, you have this emergency hearing that wasnt on the courts docket. You saw the prosecutors come out and read the charges filed against Jussie Smollett in the beginning of this case, yet they didnt do the same kind of press conference when they came to this agreement to drop the charges. That causes us to be concerned about the lack of transparency there. Secondly, you have communication with the highest level elected official in that state Attorneys Office. Someone from jussies family reached out to her. She has Text Messages and phone calls with that individual. Thats not afforded to the regular defendant on the street. The regular defendant on the street doesnt have the ability to contact the elected state attorney. Thats whats causing folks to say this is a form of celebrity justice. The lack of transparency more than anything is whats bothering people about the way this case was ultimately resolved. Smolletts team saying when you had that Police Superintendent come out in that really Dramatic Press Conference and lay out the case and also deliver a bit of anger and frustration there and talk about the waste of police resources. Sounds like their argument is that the police got ahead of things here and i suppose you might say prejudiced the case. Is that a fair criticism from their side . I think thats a fair criticism from their side in terms of how the police handled it. Yes that police chief was outraged. Yes, he gave lots of details about the evidence obtained. Lets face it. This is a high profile individual. He made some very salacious charges about a hate crime. These are very serious crimes that should be taken seriously. When anyone makes an allegation of a hate crime, they should be believed and all resources should be deployed to investigate that crime. We cant forget jussie himself went on television to talk about this, so we cant just say the police engaged in a Media Campaign because jussie also wanted the media to be intimately involved in this case. When you have a high profile individual, you can expect there to be media surrounding the case. As you make the point, the one thing not in dispute by either side is that he faked that claim. It really discredits and is an undoing of what bob mueller has spent 22 months doing. For him to sum it up in a threepage report, i think this is continuing. Republicans in the house voted to say it should be made public. Trump said hed let them do it. I think he knew that mcconnell wouldnt let it go through the senate. If theres nothing in the report that will make people think there was obstruction of justice and or conspiracy with some members of the Trump Administration, it should be allowed for the public to see it. The fact they dont want the mick to s public to see it makes you think this is all a whitewash and charade. Were only seeing bill barrbarrs interpretation. That said, we do know that Robert Mueller did not make a determination on whether the president committed obstruction of justice, presented information on both sides of that argument and specifically said he was not exonerating the president. I wonder if by making that determination, if you think the special counsel failed in his duties by not making a recommendation . Im not sure why Robert Mueller didnt take the position. I believe in previous independent counsel and this is a special counsel, they have not come to conclusions of law necessari necessarily. They put it up there for the congress to look at in terms of impeachment and thought it was the congressional decision to work on their investigative material. I dont know that mueller intended or thought that bill barr would interfere and jump into the breach and give his analysis rather than allow it to go to congress, who would make the analysis. I suspect thats what he wanted. On the other hand, there have been reports that three weeks ago mueller told barr that he would not take a position. And that certainly set up the ball. It may have been that he was a place kick holder and was waiting for barr to kick the field goal. I dont know. I mean, Congress Still has an opportunity when it see this s report to make its own judgment. You know politically patience is running thin. Were hearing it from voters. Were certainly seeing it in polling here. Is there any political motivation, any political momentum to pursuing this further . Or as a practical matter, is it done . I dont think its done. I think its been an injustice, because i think this has been a charade pulled off by trump and i dont think you can ever let charades that hurt democracy and take away the peoples opportunity through transparent government to see the product that they paid for succeed. So i think its important and i think politically its important to show that the democrats have integrity, that members of Congress Even some republicans have integrity and that they will let the people see what the work product is for 22 months of work and how it relates to the russian interference in our election. Its still a problem with him with some in the africanamerican community. Hes going to have to find a way in this campaign to build bridges into that community that are stronger than what he has now. Biden has been a little bit hamletlike on this waiting to give us a decision. But he does say the decision is coming. It does seem like its in the offing here. He ranks at the top of the field now pretty strongly above sanders and well above the new entries. What do you expect to happen to those numbers when he enters . Does he get that sort of boost that sanders got or harris got when she got in. I think the big question for a lot of people like myself is his highest number going to be the day he announced and all of a sudden this deluge of attacks. I will point out his favorable numbers are the highest in the field and depiespite a lot of t negative press, his numbers have been steady. Hes running at a different time with a different Democratic Party. Beyond the anita hill comments he went more broadly in his comments about culture, talking about a white mans culture. No man has a right to chastise his woman with a rod thicker than the circumference of his thumb. This is english juris prudential culture, a white mans culture. Its got to change. We all have an obligation to do nothing less than change the culture in this country. This is a message clearly directed at women voters, but also more broadly young voters here. A necessary one from the former Vice President . I think he needs to discuss this as its out there for everybody to understand that the white majority in this country is rapidly disappearing, that people under 30 in this country is a majority minority. I think its important to have that conversation in this election period. I dont think joe biden in calling this a white mans culture, hes got to be very careful not to offend whites either. They deserve respect as well. Hes going to have to be more artful in the way he does it. I also feel hes abating this. I know he will be well served by declaring for one term. He would seek one term and he would bring on a Vice President he would help to groom as a potential candidate four years down the road. But i think hes got a real opportunity over the next four years to help a lot of people advance in their careers in the Democratic Party and build a really strong bench. The issue came with john mccain in 2008. Big voting issue here, likely theres no bigger issue, which is health care. The president has not just grazed a political third rail here, hes embraced it. I would say so. By saying wipe out obamacare, which despite what you hear in washington is popular in many red states among republican voters. I dont really know what hes doing here. He gets off with the mueller thing. I think that came out about as well as he could have hoped. And then the next day he says i want to get rid of the aca which polls quite well. Look at the course of the president s presidency, right . Look at the point at which he reached his lowest approval rating. It was right around the aca debates back in the summer of 2017. By embracing this repeal idea, i just dont understand it. I get it, you know, it may poll well with the republican base. But hes already doing well with the republican base. He needs to reach out to the center of the electorate and stuff like this doesnt help his cause. Susan collins says she is vehemently opposed to the administration seeking to invalidate the entire Affordable Care act here. The president is convinced that its brilliant because he won in 2016 and of course he got a lot of things right. If you look at the midterm elections, his focus on immigration did not seem to work for him in a lot of those swing states and health care certainly worked for democrats in a lot of swing states. Did he just hand a weapon, a victory to democrats as we approach 2020 . He certainly handed them a weapon. You know, sometimes, jim, you and i have both seen this, when a president gets a big victory sometimes they have too large a sense of how its transformed their power. This is coming from a man now who thinks he has almost omnipotent power having beaten back mueller. There have been two polls out in the last 24 hours and they both have found that subsequent to barr going public with this report and his letter, that subsequent to that theres been virtually no change in trumps approval ratings. Its down in the low 40s, high 30s. Which means he did not get the leverage that yet that he hoped for. That makes this health care thing even more inexplicable. Great to have you both on. But if someone gets measles and was found to have not been vaccinated in one of these Public Places, they could be fined. Take a look there. The assessment here is that neither israel nor hamas want an allout war. Its a question of where does the response come and who feels the need to respond at this point.
