Species at american universities . Were going to discuss all of that this evening. A lot of going on tonight. I want to begin with the death of 6yearold Jeremy Mardis. This is not the first time that the officers have found themselves in trouble with the law. Cnns Martin Savidge has more now. Reporter marksville, louisiana where as the water tower says everybody is a somebody and the somebody everybody here is talking about is 6yearold Jeremy Mardis killed in a blaze of bullets fired by two deputies during a chase in his fathers car. How could it happen . If according to some, this small town has big problems. Its a whole lot of things that is wrong. Its sad that it took a six years old boy for them to come and see what is really going on down here. And its just not right. Fingers point to the deputy marshals. Derek stafford and norris greenhouse jr. Stafford is a Marksville Police officer and the mayor says he has had conflicts with him. I tried to talk to the previous chief about it. And you know, nothing was done. Reporter so has patrick who says that officer stafford had him arrested for complaining about him. I made a complaint to the Sheriffs Office and later on they heard it over the radio and a Police Officer arrested me for disturbing the peace. Reporter he pseudo. It is one of five lawsuits that name stafford as a defendant. In another suit a mother accuses the officer of restraining her teenaged daughter so forcibly on a school bus the girl had to be treated at a hospital for an injury to her arm. All of the suits are still pending. We reached out to staffords civil attorney who said that i will not be making any comment about the pending litigation involving the city of marksville or its employees. Then the criminal activity. Whatever the previous allegations, of course none of them explain what Everyone Wants to know why did a pursuit that night end with an unarmed man critically wounded and his 6yearold son sitting beside him dead . And don, that is the real question that so many people in this small town want to know and the problem for them now is that a judge issued a gag order in the case. None of the participants can speak. So until this gets to a trial, if we get to that point, many people are going to be wondering for some time to come without answers being provided. Wondering what is going on. What i want to know right now, what is the status of these two officers . Well, they both have been charged with Second Degree murder and attempted Second Degree murder. They have been given a 1 million bond each and transported to a facility outside of this parrish. But the father of norris greenhouse was able to make arrangemented for his son. And by the way, his dad, he is the assistant d. A. In this parish. He would normally be pursuing major crimes. The d. A. In this parish had to recuse himself from this case because of the family connections in this case. Thank you, Martin Savidge, great reporting there. I wanting to bring in Steven Mcintosh. He is suing the officer. Lets get right to it. Good evening to you, Steven Mcintosh talk me back to 2013. You were leaving a citywide fourth of july swrags. Tell me what happened. As i was leaving the parade i stopped by another friend to talk with him a while and we heard a loud commotion. We head over to the commotion and a young man was arrested and they had him on the ground. And the cops come out of nowhere and shooting pepper spray and telling people to leave. In the process i dropped my keys and was going to pick up my keys and the officer told me to leave i said i dropped my keys and trying to leave and he just threw me down on the ground and handcuffed me and another cop came and jumped on me. There were three or four of them on me. Tell me about your injuries. We have photographs, and you have an injury to your head. What injuries do you say you sustained . When officer stafford shot pepper spray on my face when i was handcuffed on the ground on my stomach. You were charged with resisting arrest. And did you know why you were being arrested . Did they tell you . No, i didnt. And they didnt say anything . No. Never told me i was under arrest or nothing. Go ahead. They never told me i was under arrest. Just handcuffed me and that was it. Mr. Mcintosh did you have a prior history with officers stafford or greenhouse . No. So when you heard the story of the shooting that officer stafford and greenhouse were involved with with Jeremy Mardis and his father, chris few, what did you think . I was real shocked about the situation. But being that the guys they were, you would expect Something Like that. What are people saying there about that shooting . How are people feeling about it in the community . A lot of people thats upset about it. Wondering why the 6yearold got shot. Go on. They want changes . What . Do they want changed . To do people there want things to change when it comes to the Police Department . Oh, yes. Yes, they do. Mr. Jordan, to you know, what did you think when you found out that this case involves two of the same officers that you were already dealing with . First of all i want to give my condolences to the mardis family and the few family for their loss. You know, don, i was surprised in a sense because there is a distinction between certainly tasing somebody and pepper spraying them as egregious as that is for no reason at all and shooting a car 18 times. But on one hand i was not that surprised. In our case we could see there is a total lack of training in this department. So from that standpoint, this is just a further example of the lack of training that this department has displayed. I will ask you then with the allegations like the ones in your cases that you have and some of the others that are surfacing now after this one, what things could the department have done differently . First of all, they could do better training with these officers, don. In the case of mr. Mcintosh and the kid he was talking about, that is part of the greenhouse family, they are related to this officer that has been arrested. Even in that case, don, i think youve seen those pictures, they threw this young man down and beat him for no reason. This kid was 14 years old and didnt search him for a weapon or a cell phone. The photos that i sent to you showed the kid handcuffed with his camera phone taking a selfie of the injuries that he had. I mean, you know, its just no excuse for the lack of training that this department has. Edmund jordan, i appreciate that. I thank you. And i also thank mr. Mcintosh as well. Please keep us updated. We appreciate you giving us context to the stories happening there. I thank you, don. And i just want to make one comment, don. In our case they did not have body cameras, in this case they did. I think it shows the need on the local, state, and federal level that we need the body cameras. There are good officers out there. And they dont mind the body cameras. And in this one, the dash cam video, the body camera video is not being released at this point because and when cant do a freedom of information request for it because louisiana is not a sunshine state. We will not know until this goes to trial and we dont know when that is going to happen. We reached out to the police because of these ongoing investigations and lawsuits. They are not commenting on this. But we will continue to follow this story. When we come back, a jaywalking arrest gone wrong and caught on camera. Is there more to the story than meets the eye . More turmoil at the university of missouri. Is freedom of speech under fire on our College Campuses. The internet of things. What were recommending as your consultants. The new consultants are here. Its not just big data, its bigger data. Were beta testing the new wearable interface. Xerox believes finding the right solution shouldnt be so much work. For jaywalking in austin, texas caught on video and it has gone viral on social media and many are asking if the Police Officers used too much for a minor infraction. Whoa, whoa, whoa, whoa, [ bleep ] [ bleep ] [ bleep ] what the [ bleep ]. Record it, record it im recording. Get down [ bleep ] [ bleep ] [ bleep ]. Stop. Stop. Just be still. Im not doing nothing, man. Be still, be still. What the [ bleep ]. Im down, bro get me your hands. Im down, bro. [ bleep ] [ bleep ] okay. Why is he hurting them . What the [ bleep ] what the [ bleep ] is going on right now . Doing their jobs. For what . For no reason. They doing their jobs. In a statement, the police say they are reviewing the case. So lets discuss with Matthew Wallace and lordis glenn. Thank you, guys, how are you doing . Doing well. Thank you. Im doing great. Lets give the viewers some context as to what happened here. Matthew to you first. Tell me what happened that night. We were leaving the bars at closing. It was about 2 15 or so. I was walking my friends to our uber that we had just ordered. When we get to red river street, thats when we see bike cops sitting on sixth street on their bicycles. And we noticed that there were the light was about to change and there were no cars coming so we decided to all walk against the signal. And thats when officer yell at us to stop and no one stops because we are in the middle of the street. And when we step on the sidewalk they yell at us to come here and nobody comes there. So thats when the video starts. So this is a report that i have. This must be lordis. Police flashed their flashlights at us and matt and jeremy said foff noting that the street was barricading so the crime of jaywalking was a moot point. What was your interaction before did you have any sort of interaction with them before and is that accurate about saying foff and . No, thats not accurate at all. What happened was when they told us to come over here, me and jeremy were having a private conversation and he looked over to me and said, you know, no, were straight we dont need to go over there, to me. And you know, thats i guess thats what set them off, you know, kind of i think it was, you know, just, like, us being deninety of not wanting to come over there to them instead of them coming to us type of situation. And thats when they dropped their bikes and run over the us. Lulu, i want you to this is a bystander. Yelling at the officers. Listen. What are you doing to him . Taking him to jail. For what . Crossing gwen the light. Why do you think this happened . Do you think it was just because of jaywalking . I dont know of what happened before but this seems like an overreaction for just jaywalking. Correct. It was more than an overreaction. It was incorrect. Why do you think it happened, lordis . We have been contemplating that for a few days and we cannot come with an exact reasoning or what have you as to why we were treated that we. The only rationale i can think of is that they were they were upset that, you know, we were breaking the law, one, and that we knew that it wasnt a very serious situation and we were kind of defiant in the way of, you know, the group of people that we were walking with all decided to cross the street and i think they just, maybe they just needed to make an example of a couple of people to show their, you know, power. So you admit that you were breaking the law. But you just think it was Excessive Force for the infraction that you were committing. I want to read here, guys what the austin Police Department stated. As is standard protocol the chain of kmant will review the response to resistance and the incident to determine what led up to the events captured in the video. What do you want to happen . We are waiting. They have spoken on a different case. We are still pending. Its easy to pull up the rule of conduct. What is the holdup and what more is there to investigate . We have found a policy in the page four of the policy handbook thats online. It took me about two minutes to find. You know, its article eight about how their conduct is supposed to be in arresting violators of the law. And it is complete opposite of what our situation that happened on last friday morning was. We appreciate you guys coming on. And well follow this. I appreciate it, matthew and lordis. Thank you again. Now is this a case of Excessive Force by police . Up next, two people who couldnt disagree more. Were going to talk to them. Well, this is a first. At t and directv are now one. So get ready to laugh here and cry here. Police are in the spotlight tonight amid questions about possible use of Excessive Force. Joined by riva martin and a retired new York City Police detective. We talked about the two incidents. Let talk about the first tragic case of 6yearold Jeremy Mardis gunned down by two Police Officers in louisiana. Its unclear what happened. Both officers have been arrested and charged with Second Degree murder. What do you think went on her, harry . Until we can see the videotape that the officers were wearing there, it looks like this is an unjustified shooting based on the information today. The head of the state police said it is one of the worst things he has ever seen. You have a man who is not armed. Police officers. We dont know why they were chasing him. You do not shoot at a vehicle that ewe are chasing unless that person is shooting at you which was not occurring at this time. Did they know that boy was in the vehicle also . If they knew the boy was in the vehicle its even worse. There is no justification for any of it . None. The body cam video has been called very disturbing. It is a new addition to the Police Department. Do you think without that evidence this case would have moved this quickly . Not at all, done. What we know about this cases is before body cams and before citizens with their video cameras and cell phones, it was the word of the policeofficer against the person who was shot. In this case it would have been this father who was in Critical Condition and this deceased little boy. We wouldnt have gotten the story, the way we got it, because of the body camera, and i think we have to thank the protesters who became so engaged after the ferguson shooting and made the issue of body cams a National Issue and we see Police Departments starting to use them and its having a powerful impact on these shooting cases. Lets talk more about this little boy. Not about the new video that is up now. They were arrested for jaywalking in austin. Harry, you see where it gips and the cops walk up to them. I wish i saw more of this video but this is all we have. The fact is that the officers told them not to cross the street. They were in the middle of the street when the officers told them to stop. So your guests they admitted they didnt follow the Police Officers orders. So the cops said they are going to issue you a summons. And they asked them for identification. They are coming out of a bar at 2 00 in the morning. And say fyou to the officer. They said they didnt say that. This doesnt look excessive to you . Harry the fact is that they are resisting arrest. Watch the resistance going on here. Watch the resistance thats going on. How many times do you hear the officer to comply, comply, comply. And this is an incident where somebody tuesday not comply. He is keeping his arms here and stopping himself from trying to be handcuffed. Its amazing we are watching the same video and he is seeing resistance on the part of the individual. The cop is punching him in the arm. But wait a minute, the first scene is the cop throwing the man against the wall. The cops are taking a minor incident thrown up against the wall, thrown to the ground and punched by Police Officers. That is such an excessive use of force. Why do you say its still against the law. Its against the law. So watch this. What should he do, go down on his knees right now . Just comply with the officer. Put his hands behind the back. When that officer is punching him in the arm he cant get the arm around. Ive had that happen to me a million times. You think that goes along with Police Protocol . Definitely does to get the arm around. He is fighting the officer there. You see that . He is fighting the officer. Comply. You want to respond to that . As a civil rights attorney, your guest was just on without attorneys, any civil rights attorney in this country would take that case and be successful in that case. There is no argument that that level of force was required for jaywalkers to be thrown to the ground and punched repeatedly. It is for resisting arrest. You make it look like its a jaywalking thing. Let her finish. Police cant use that level of force simply because someone doesnt comply immediately. Yes individuals have to comply with lawful orders of the police. When they do it instantaneously that doesnt give the Police Permission to use that level of force. When the officers asked them for identification they said fyou to them. Because they needed identification to write a summons. And if they had given them their identification we wouldnt be talking about this right now and they wouldnt be under arrest. Two people seeing very different things. Coming up more turmoil on university campuses. Is freedom of the press under fire . University of Missouri Football Team returned to the field today tweeting mizzou football family back to practice this afternoon in preparation for byu. That in the wake of the resignation of the university president. Now there is a new war on campus and this one is with the media. Kyung lah has more now. Back off. Back off. Go. Dont push me. A confrontation between students and a student photographer. The First Amendment until the photographer shooting the video walks up to this woman. You need to get out. I actually dont. All right. Who wants to help me get this reporter out of here. Reporter that woman is an assistant professor melissa click at the universitys Communications School. She covers his lens, pushes the photographer and mocks him. This is public property. Thats a really good one. Im a communication faculty and get that argument but you need to go. Reporter directing students to form a human chain to block the journalists from doing their job. Dont let those reporters in. Hes a good one. Good job. Reporter we went to professor clicks office to ask why would a Mass Media Communications instructor want to stop the media . She wasnt there. But this flier expresses her opinion about traditional media. The Communications School says it cant comment about personnel but says intimidation is never an acceptable form of communication. Since the video went viral, melissa click says she has seen herself in the video and reflected on it and been eviscerated in social media. She did release a statement through the Communications School and heres what it says. Quote, i regret the language and strategies i used and sincerely apologize to the mu Campus Community and journalists at large for my behavior and also for the way my actions have sifted the attention away from the Students Campaign for justice. Dean, good evening to you, heres what you tweeted tonight that the assistant professor, melissa click, who we saw in that video resigned her courtesy appoint with the j school. How did that happen . So, we were meeting as a faculty and discussing this and while we were meeting, she was in contact with us she came and talked to the faculty tonight. While we were meeting we had not come to a vote yet and she called and told us that she was resigning her courtesy appointment with the school. Just to be clear a courtesy appointment is a thin thread between the school of journalism and the college of arts and sciences which is where her facility home is. She has resigned. Did you force her in any way or was this voluntary . This was voluntary. There was nothing to be done there. And the vote hadnt been taken. What is your response to that . What is your response . What do you think of her action . What do i think of her actions . Which actions specifically . I know it was a tense situation and saying get the media out of here and get me some muscle and that sort of thing. Journalism is about transparency. If it werent for the journalists there the story would not be broadcast to the Larger Community or cnn or around the world. Let me be clear we stand for the First Amendment and the freedom of the press and their right to be there and cover the story. But we also recognize its only one part of the First Amendment. The students had a right to be there to protest and to assemble. They have freedom of speech and grievouses against the their government, in this case the university, and so we understand that they had a voice there and that thats an important part of it. And so theres a tension point there that is important to understand and for journalists to understand. Its a big part of what we talk about in the jschool and how we train our students who are going to become some of the best journalists in the world. And so its that tension point that they need to be able to understand and to build trust with the communities theyre covering. After the confrontation fliers were passed out not to treat the media as an enemy. Why do you think so many students were hostil to the reporters . Well, you know, there are lot of Diverse Communities that journalists have not always come in and done fair and complete and deep and contextual coverage there. We need to as Journalism Schools train our students to understand these issues and the complexities of them so they can go out and fairly and deeply and contextually cover these communities. I want to play more from that confrontation. One of the students went to cover what happened yes yesterday. Take a look. Hey, reporters have to go. I have a job to do. I am documenting this for a National News organization. Yes, i can. This is a First Amendment. That protects your rights to stand here, protects mine. I know you dont like your journalism students to become part of the story. What did you think when you saw that encounter. They may have been trying to shape the message. But as you know, that doesnt always work and it shouldnt always happen especially with the free and open media. Well, tim ty who was in the video was standing his ground appropriately. He had every right to cover the event going on there and what was happening. And i thought he acted very professionally and he really stood up for the right of journalists to be there and cover it. And i talked to tim in my office earlier today. He doesnt want to be part of the story. He thinks the story of what happened out there on the pod and what the protesters were doing is what should be covered and he should not be the story. And im proud of why he did and how he handled himself. I also want to get your take on this email from mizzou police. It is asking for them to report hurtful speech. Are you concerned about the implications this could raise. Hurtful speech . I havent seen what you are referring to. But i was on yik yak earlier today. Anonymous social media is not the place to be right now. We are hearing people from the fringe. That does not help the conversation go well. There is an important conversation going on this campus about inclusivity and how we provide opportunities for a broad range of people and they can come here and be successful. But a lot of what were seeing on social media is hurtful. That does not mean that the media does not have a role in covering this. And i think this is where we get to the focus on trained, professional journalists who have editors behind them doing fact checks and making sure that what we report is as fair, transparent and accurate as possible is important to make. As a dean on campus, this goes beyond journalism, im talking about the freedom of speech and expression to report someone for hurtful speech, how does one define that . Are you concerned how this might be an infringe judgment on First Amendment rights and the can of worms this could open up . This is a complex issue but im not sure its opening up as big of a can of worms because i dont think that the hurtful speech piece of this is necessarily affecting how journalists are covering the story. I think it might have an affect on how social media is here. And there is an important lesson about inclusivity and how we treat each other and in a democracy its important to have civil conversations with each other rather than talking at each other. I dont think that the social media comments and the way this is being handled necessarily helps the democratic conversation go well. I appreciate you joining us. Thank you very much. I really appreciate it. When we come back were going to talk about what is happening at mizzou it has some people asking if free speech is under fire on College Campuses and what should we do about it . Ow. whimpers squeals are you okay . Yeah, i just got charged for my credit monitoring. Thats how i know its working. Ah. You know you can go on creditkarma. Com and check it out there. Its completely free. Really . Yeah. Oh, that didnt hurt at all. Yeah, completely painless. Credit karma. Really free credit monitoring. University of missouri has become ground zero in the battle over free speech on campus. Lets talk to ben ferguson and Marc Lamont Hill. You guys heard the last segment. Ben, lets start with you. Let get ready for some hurtful speech. Going to call the police on you, don. So a lot of times what we say here on television is hurtful speech. People say hurtful things all the time. How does one legislate hurtful speech in there is a difference between threats and hurtful speech. I would be calling on Marc Lamont Hill every time im on the show with him if hurtful speech is now a crime. Let be honest. Its one of the top Journalism Schools in the country. How in the world do you even allow this idea to get out there . How in the world do you push away and tell these student journalists to go away and they dont have a right to be there . I dont know what is going on that campus but it has gone beyond the racial issues that it started out as. I disagree with how you characterize this. How do you legislate against hurtful speech. That is not what they were talking about on the campus. This was not a legal question but a Campus Climate question. Illegal to say hurtful things but it violates the student code of conduct. Its not illegal for me to say things that may hurt people or unsettle a community. But if a student or faculty member does something that makes it difficult for others to feel comfortable and safe that is a violation and they can be disciplined. Is the polices job on campus to sit down and say kumbaya on hurtful speech . If the chancellor or a teacher wants to say that, i have no problem with it. But you are talking about the police doing it. And that tells me they dont understand the freedom of expression on that campus. This should be protected from all sides. They are not calling the police. But lets be clear. But marc hang on, ben, you said it is not calling the police. No, no, they are not calling the police to effect an arrest. The police are part of the Campus Community. They are calling the campus police. Ask to Call Campus Police in cases of hateful hateful and or hurtful speech. Marc lamont hill, you dont agree . Hateful and hurtful speech can be different things. Me saying ben is wrong all the time might be hurtful to him. But its not hate speech. However in this conversation because there is a thin line between hateful and harmful speech it is safer to err on the side of caution. This is a climate and culture question. If you are an 18yearold kid on campus and you see this and it talks about hurtful speech what it implies it you are going to be investigated by someone, that is if nothing else limited freedom of speech or freedom of expression on campus which is exactly what we do not want for our campuses and we do not want for the students. If i see that and 17, 18, 19, 20 im looking at being investigated that is not a culture we want on College Campuses. I think ben makes a good point and ideally i would not want Law Enforcement involved in this. I dont want Law Enforcement involved in everyday interacts in community. At this moment, though, that is the best stopgap that the university has to address a climate that has become increasingly hostile. I dont want to suggest that somehow that having people reported to student life for harmful and hateful speech is i wonder where you draw the line on it. When i went to college, no one had a safe space. Free speech was a safe space where you could say whatever you wanted or harming fizz peoppeop physically. What is going on in College Campuses. Isnt that what college is about learning about people who are different from you . I think so. And as someone who teaches at american universities i dont buy the narrative that the police have invaded universities and they are no longer bastions of free speech and liberal thought. I think the bigger issue, don, right now is that people think that freedom of expression means they have the freedom to be hurtful and hateful. Im up against a break. Thank you, guys. Which allergy .
