Blackburn it will be up to congress to take action following with the fcc does. This is what the chairman this is why what the chairman did was the right step to take, and i like seeing that. Peter in your subcommittee, what are some of the items you are working on that we have not seen in the news you can in the news . Rep. Blackburn looking at agencies, reshaping them, making certain fcc is focused on spectrum and Spectrum Management and media ownership. Hose are right things to do we are also working on first net and ourt nations emergency communication template. It is more than an Emergency Alert that comes on the Television Screen or a radio. Last that you hear we have done some hearings and some work there. We have different members that are going to lead on different issues. Bill johnson is going to lead our work on broadband expansion. Leonard lance, who vice chairs the subcommittee, is going to lead on encryption, and mimi leonardwill work with on the encryption issues. She is new to our committee. Susan brooks is going to lead our work for enhanced 911, firstnet, those efforts. Is leading the work on media ownership. Adam kinzinger is going to lead the work we are doing looking at u. S. Cyberumn crimes. U. S. Cyber we have individuals who have really well developed areas of expertise and a tremendous amount of institutional and career knowledge, so it is going to be nice to have them take the lead on some of those components. Lydia i would like to turn to your new bill, the browser act. It is kind of sweeping legislation that would give consumers more control over their online data how it is used, how it is collected and it would apply to not just isps , but also facebook, google. When you introduced at last week, you seemed to have caught a number of folks by surprise, including a number of your colleagues in the house and senate. Can you tell us about the bill and what drove you to introduce it . Absolutely, and i welcome the opportunity. This is something i have worked on since i was vice chair of commerce, manufacturing, and trade. Was chairman of that subcommittee, and we tried to generate some interest around privacy and Data Security and somedesk held and held hearings on it. It really did not get a lot of movement. Then, fred upton, who was chairman of energy and commerce, shei was vice chairman took the lead with a privacy working group, and peter welch and i cochaired that in a bipartisan manner. You may remember last year, we had a Data Security bill that made it out of committee, but we never got it to the floor. People are ready to see something come forward from us onthe issues of privacy and Data Security. Certainly now we are beginning to have not only states but cities look at privacy regulation, and they are doing it because the federal government, because congress has not taken an action, and now that the privacy issue will not is atwo regulators, which good thing we are going to has one, and the ftc historically been the regulator of privacy in both the physical and virtual spaces. We think it is important to have one set of rules for the entire ecosystem and one regulator for the entire ecosystem so the in charge,now who is so consumers have that protection. I think our consumers deserve to toolbox of full tools that they can use to protect what i call their virtual you, their presence online. This is a way that we can say, all right, lets simplify this what thento statutes privacy framework will be, and i think it is a great place to start the conversation. Lydia to add onto that, your bill would preempt some state, and i guess those local privacy laws. It would return of authority to the ftc. Lydia thats right. What is novel is it would require a company like facebook consentonsumers opt in. I think they view that as something of a fundamental threat to some of their business models. How did you take that into your tabulation in introducing the bill . Rep. Blackburn i think when people feel more confident and as if they have control over a situation, they will probably end up being a better consumer of those services. Individuals want to control their privacy. So manyes, ive had people say, ok, i dont understand this. How is it that i have to continue to get all these , and i, all this spam have to go and remove myself from these lists . How is this happening . Dataurse, it happens from mining. To allow consumers to say, ok, im going to choose to give you the right to share certain pieces of my information. Im going to choose to enhance that business to consumer relationship with you, but im not going to choose to have it shared in other ways. There are things i do not want shared. I think individuals have the right to do that. Lydia there have been some stumbles in lets say k street and elsewhere. Some consumers are concerned. Bout your role others say perhaps this bill could lead to compromised that neutrality legislation down the line. Rep. Blackburn i am working diligently on the bill. My pleased some of colleagues across the aisle are interested in the bill, and i am very pleased that we have some senators who are looking forward to filing the bill. I am hopeful this will be bipartisan. I look forward to that. Peter last week, we had Terrell Mcsweeney on this program, the democratic representative on the trade commission. She spoke about his legislation, rules of the road, the privacy commission. Here is what she had to say. Representative mcsweeney there are a couple of things im concerned about. Right now, we do not have any federal agency with jurisdiction over the privacy practices of broadband providers. Very concerned about that. I think it is a huge gap, and i would like to see congress stepped in and give the ftc jurisdiction very clearly, which they could do by passing legislation. Bill addressour what she spoke about . Rep. Blackburn it certainly does. One regulator and one set of rules for the entire ecosystem. Does it tight into Net Neutrality as lydia indicated . In netackburn neutrality, there are areas where you will see agreement, back to the to step former ftc when they reclassify broadband and Education Service to title ii when they reclassified broadband and Education Service to title ii. We all knew they would try to have two sets of rules, one for the isps from the ftc, and the of theor the balance ecosystem, and that would come from the ftc one for the. Sps from the fcc when people logged on to conduct their Business Life or their personal transactional life online, they do not look at it as a different component of the system. They look at it as one system. That is why the action was important to do. That was a new rule that had not been implemented. The privacy that individuals enjoy is the same today as it was last week, last month, last year. Nothing changed. What action we took was to preserve the status quo. The conversation moves from removing the broadband services, Internet Services providers from title ii back to title i. It is important to ensure that we do have a privacy regulator that covers the entire ecosystem. Lydia have you spoken or had any interest from anyone in the white house or the executive branch . Rep. Blackburn they have had a few things on their plate this week. Lydia fair. Rep. Blackburn no, i have not talked with anyone at the white house about the bill. The president will return from his trip, and i think that others are very involved with the tax reform legislation that is beginning to move forward and others are focused on health care. Broadband expansion and the infrastructure bill will give me the opportunity to talk with them and seek support for what we are doing with privacy. Peter is there someone in the white house or someone in the administration, a point person for you . Rep. Blackburn there are individuals working in that capacity in the white house, and you have individuals who have worked with us at committee that are now working in the administration. You also have a technologies are Technology Czar at the white house that will, im sure, way in at theh appropriate time. Peter what do you think about Technology Council the president is forming . Rep. Blackburn i think that is an excellent idea. I hope they also do something with creators because many producers of content that is online and needs copyright protection my hope is when you look at distribution, you also look at protection of copyright. Seems to have been a disconnect between Silicon Valley and the Republican Party in this last election, especially the way they voted and where their money went. Have you had a chance to visit some of the folks that work out there . Rep. Blackburn i talk with individuals that work out there on a fairly regular basis, and i think that it is fair to say that some of them look at what congress. C. And say, never keeps up, and Technology Evolves so quickly. The lifecycle of the latest computer design is about 18 months, and you do not have time to get a bill through and cannot keep up. There are a couple of good lessons number one, we know sometimes they would rather deal with the bureaucracy because they think they can get faster action just by going to a federal agency rather than waiting on congress to take action, and there is a lesson in that for us in that we can no longer legislate to a technology. What we have to do is look at useuse and use end and utilization and functionality and look at what this will be used for. As you put out spectrum, as you do broadband deployment, as you find new ways to pack down the usage in that spectrum and in that band and deliver new and be creative and innovative in that space, it is going to require us to maybe change the way we look at technology and telecommunication legislation. Lydia you mentioned a couple of key points spectrum and broadband infrastructure. A bill pending in the senate is and go to theve house. What is your interest in that bill . Would you take it into the house and look at it, do your own legislation . Rep. Blackburn i think we will take it up and look at it and use that as a starting point. I know the senate has worked on it for a couple of years, and the chairman would like to move that along. Even if the senate is sending it to us or finishing it so it can go to conference or the president s desk, they are always sending bills. Responsibility for leading some of the telecom and congress. What are your priorities for that . Rep. Blackburn there are a couple of priorities. First of all, we want to focus on unserved areas. We have many areas in the country that still do not have access to highspeed internet. That means we need to do some , andiligence with the fcc we will start with getting the maps cleaned up. The National Broadband plan maps have not been cleaned up in years. If you look at a map of tennessee, you would think that 95 of the state has access to highspeed internet. In reality, that is not even close. Our statehouse and state senate did a great survey, and it is much more accurate. Lets work with the fcc and get these maps in shape. The second thing is we need to define what is going to be the acceptable speed. What are we trying to do . Up . Wn, three 25 down, three up . What do you need to be your target . As we set that framework in place, then you are ready to move to the grants and the going into broadband expansion. The infrastructure bill will give us another opportunity. Expand ask how you best those dollars, and it may be partnerships with public entities, your local and state governments, and then they pull down money, leverage those dollars to pull down some federal dollars, and suddenly, you are getting a three to 1, 3 to 1, 4 to 1, 5 to 1 benefit. Some of those entities may want to go out and do publicprivate partnerships and look at ways to utilize broadband. It is important, too, to note that what we will do is Technology Neutral because Different Things will work for different areas. Bee places, it will wireline, fiber, wireless and other lot in other areas, satellite and others satellite in others. I have a county looking at a couple of different areas to do a x wireless project because it works for them a fixed wireless project because it works for them. They do not have enough people per square mile to get the Adoption Rate of high enough to do a fiber line project, so they , how caning to ask we make this work . So they are working with a private company to find a way to increase this access. You have to be careful with municipal broadband. If a community decides they want to do it, they certainly have the right to do that. I did not like the way the fcc approached it, picking winners and losers by giving some areas grants. I had a little bit of a problem with their approach on it, and i i like that local control, and there is a problem when someone gets federal grants and wants to go outside of their footprint. That would put another city or county being beholden to another board or mayors or alderman. We had some municipal systems that went out with something but did not have the dollars necessary for upgrades and maintenance, and that has caused some problems. The private sector seems to be better prepared for handling that. Sec under the last administration took action in your own state to preempt the state preemption. How does what you just said square with i believe you oppose the fcc action . I do. Lackburn when you have a state and state Regulatory Agency that has that is not a process they want to have unfold in their state, they have the right to do that, and i do not think the fcc should be the one saying , no, you cannot do that, and trying to come in and micromanage the delivery or expansion of broadband. Peter you talked at the beginning about reauthorization of the fcc. Is it time for a reorganization . Will get torn you some of the reorganization, and it would be a good thing to have handled as you go through reauthorization. Every once in a while, just looking at what you are about and how you organize yourself and your workload is constructive. That is how you make the appropriate adjustments and reforms, and that is what the American People are wanting to more efficiency and greater transparency, greater access. In terms of legislation, she fbctioned the ntia and reauthorizations, and those are important for the industry, but i do not know how much legislation we will see when all of congress right now is focused. N health care and taxation maybe the next thing we see will be the infrastructure bill we discussed, which will be very sectornt for the telecom. After that is what happens with Net Neutrality. Will there be legislation . Wont there be legislation . With that privacy bill, will that add pressure to the situation . Perhaps. She indicated that maybe nothing act, happen until the ftc so that is something to watch. Peter how significant is this action . Lydia that will depend on what is in the legislation. She seemed to say it could include restructuring of the agency. The white house budget request came out yesterday with some details from the fcc, and it looks like they are proposing to shed at least 100 fulltime employees. What that might mean, if that is improved approved by congress would it mean a reduction in gency activity . Might she and the rest of congress reauthorize a focus on Spectrum Management but not regulate in the broadband space . That could change the mission of the agency quite a bit if that happens. Will they have the staff to do it at the staff to review mergers . There was the sinclair and tribune merger that was announced. I think everyone in the sector is expecting a lot more. It could be a very busy agency. That reauthorization bill could have a big impact on it. Two open seats and the potential that the democratic commissioner could step down. Lydia i think commissioner clyburn has been very careful. She said she views herself as still having a lot of work to be done, but that is a question many have raised. I think it is widely expected that the white house will soon send up some nominations to the senate with a republican and democrat. I think the big question is who steps in the third gop spot. Those are important because after that, it is expected senator schumer might take off the hold on senator thunes thele now bill, which has backing of a lot of the industries in the telecommunication sector.
