The latest i have from an fbi source is that the fbi right now is going through thousands of emails that went to and from huma abedin. Why is that significant . Number one she is Hillary Clintons most senior aide. Secondly she is married separated right now but married to Anthony Weiner. That is how the fbi found out about these new emails. They had a separate investigation going on into his sexting and they found all of these emails that they believe tie back to the Hillary Clinton investigation. And what theyre trying to get at is two things. Number one, are these emails back and forth between huma abedin and Hillary Clinton, maybe . They could also be back and forth with other staffers within the campaign or any number of people. So we dont know an answer to that, number one, number two, we dont know whether or not there is classified information in those emails. Thats what they are really trying to get at. Remember, fbi director james comey in giuliani had extraordinary News Conference as we wait for Hillary Clinton maybe to have one in a few moments. His News Conference in july here in washington, he laid out all of these allegations and suggested that, in fact, Hillary Clinton had mishandled classified information. Suggested . He said it. Said that but there is not enough here for there to be criminal charges. That sparked a firestorm within his own bureau. Current and fbi agents have been speaking out, leaking documents. Suggesting there is more here now all of the sudden the Anthony Weiner case provides them an avenue of thousands of more emails, im told. That they are goings through now. Im also told by a senior Law Enforcement official look, they had a real pickle here once they found these new emails. Do they sit on them and wait to investigate them on november 9th . November 10th and then have the republicans, if Hillary Clinton wins the election on november 8th say why were you sitting on them . If they come forward now, you have the democrats saying wait a second, is he going to influence the election. I think what people that i have talked to, the fbi tonight say, look, comey was criticized in july for not moving forward. Now he has got thousands of more emails that could have classified information underlying could, whats he supposed to do . Wait until after the election he . Needs to follow the facts wherever they go. The question really is how major this is and what he is looking at. I noticed that he said in his letter that he referred back to testimony earlier in which the investigation had been completed. Now he is saying he is supplements that. To me that means something must have come up. If they dont know whats in these emails and dont know whether any of them are classified. To seems to me would not necessarily be called on to write a letter to congress to supplement. If this was a minor thing, why would he reopen. Or they dont know anything. Or if they dont know anything. Trey gogowdy is a former prosecutor. He came forward a short time ago and trey gowdy said reading that statement from the fbi director closely it led him to believe, trey gowdy as a republican, of course, led him to believe as a former prosecutor that there was something significant here. I would point this out the Republican National committee tonight is putting out this separation agreement i would like to say a few words and then take your questions. I have now seen director comeys letter to congress. We are 11 days out from, perhaps, the most Important National election of our lifetime. Voting is already underway in our country. So the American People deserve to get the full and complete facts immediately. The director himself has said he doesnt know whether the emails referenced in his letter are significant or not. Im confident, whatever they are, will not change the conclusion reached in july. Therefore, its imperative that the bureau explain this issue in question, whatever it is, without any delay. Secretary clinton, have you or any of your advisors heard from consumey or anyone else at the fbi today and are you concerned at all that these new emails, that they say they have found, will in any way reveal classified information that you sent or received . So we dont know the facts which is why we are calling on the fbi to release all the information that it has. Even director comey noted that this new information may not be significant. So, let get it out. Secretary clinton. You have 11 days to go. What would you say to a voter who right now will be seeing you and hearing what you are saying i didnt trust her before. I dont trust her anymore right now. And they are heading to the ballot box tomorrow. You know, i think people a long time ago made up their minds about the emails. I think thats factored in to what people think and now they are choosing a president. So i would urge everybody to get out and vote early in all the states that have early voting because i think americans want a president who can lead our country and get the economy working for everyone, not just those at the top. And who can bring our country together. I offer that i can do that. And im very confident that the American People know that and were going to continue to discuss whats at stake in this election because i believe that its one of the most consequential elections ever. Thats why it is incumbent upon the fbi to tell us what theyre talking about, jeff. Because right now, youre guess is as good as mine. And i dont think thats good enough. So we have made it very clear that if theyre going to be sending this kind of letter that is only going originally to republican members of the house, that they need to share whatever facts they claim to have with the American People. Well, brit, it was very clear when she landed in iowa that she had no idea that the fbi director had taken this measure. In fact, they were flying at the time that the news broke and the wifi was down on the airplane. And so the traveling press did not know and clintons team did not know. So, when she exited those steps and waved and smiled to the press, she did not know what was going on. She said now, after speaking twice here in iowa and not addressing it during her prepared remarks, he said she had time to then read the letter from director comby. She is calling on the fbi and the director to release the information that they have because she feels, and this is in her words, that this was irresponsible and led to innuendo because of the letter which she pointed out was sent only to the Republican Leaders of committees on capitol hill. So they are baffled by this. She would not confirm what we have been reporting all day, based on a source that i spoke to that this the directors decision was made after his fbi agents came to him yesterday and said as a result of the investigation into Anthony Weiner and as a result of four Electronic Devices that were obtained as part of that investigation into him sexting was allegedly sexting with an underaged girl, one of those Electronic Devices, im told by sources, belonged to huma abedin, but Hillary Clinton would not confirm right now that she had spoken to huma about it, even though huma is traveling with her and is on the plane with her. And she would not confirm the details that it was a result of the weiner investigation. Brit . Interesting, jennifer. Boy, this hardly could get any stranger. Jennifer, thank you very much. Donald trump, as you might imagine, pounced all over the news with the renewed fbi inquiry whil while campaigning in maine. Carl, what happened today . Hi there, brit. It was a busy day. He planned to have a meeting with opioid with a bunch of people from the community. He postponed that to have his big rally in order to make a big statement about it he immediately said this is a potential pivot point for the entire election. Talked about Hillary Clintons corruption as he had for weeks. Then when he got to maine later, he went further on it. Here is a little bit of what he had to say. I have Great Respect for the fbi for writing this wrong. The American People fully understand her corruption and we hope all, all justice will finally be served. We call on the fbi to immediately release all the emails pertinent to their reopened investigation, the American People have a right to know. And they have a right to know before election day. The impact of what Hillary Clinton and fbi director had to say have on the campaign. Strategist and Fox News Contributor carl rove and from columbus, ohio, sean trendy, senior elections analyst for real clear politics. First to you, karl, what do you think . Well, its going to have an impact. And it isnt going to be good for her. How this plays out is going to have a big determination how big the impact is i would say for her i think she was right. The people who are for her already have this baked in. She is not likely to lose support among those people. The question is among the 10 of the electorate that is undecided in a twoway race or the 8 that is undecided in the fourway polls, how do they break on this and its not going to be helpful to her. She has got a lead in the real clear politics average. And its interesting to look at whats happened over the last four weeks. She began the month with a 2. 7 lead. It grew by the end of the first week to 4. 7. 6. 7 the middle of the month. 6. 2 and then today 5. 2 so starting to go down. The question is 5. 2 something that could be closed in 11 days or not . And i think this is going to help close it. I just dont know how much. Sean, let me ask you about that. Karl quickly points out what your average has shown. It has declined lately. Do you ascribe that to Wikileaks Revelations or obamacare problems or is this just the kind of tightening of a race, at least in the polls, that we are accuss tommed to seeing toward the end . Well, we have seen this trend over the course of the election. This election will get close and then donald trump will Say Something controversial and Hillary Clinton will open up a lead and then when he is out of the news, or bad news strikes the Clinton Campaign it tightens up again. This is a race that wants to be close as locks as he stays out of the way that will happen. I think these new revelations will accelerate that tightening like mr. Rove said, i dont know how much it will accelerate them. Well, what do you think i mean, accelerates the tightening, do you see evidence in the battleground states of tightening of the kind that we can see in the real clear politics average . The state polls tend to lag the National Polls a little bit. We just dont get as many of them in a particular state. Yeah, we have seen evidence in a lot of the swing states, florida, ohio, a couple of these states, continued to tighten. And so, right now, they are consistent with this 5point race we see in the National Polls. But if this take as toll on clintons numbers and the National Numbers tighten, we expect the state races will tighten right along with them. Karl rove, what do you it doesnt appear that the fbi is really that position where it can dump all this information out, despite the fact that both campaigns in the person of mike pence for the republicans and ms. Clinton herself for the democrats seem to want that. If thats the case, where does this story really go . Normally when an investigation begins, we know that it has begun, we know something about what the substance of the investigation is going to be about. And then it goes quiet for a while while the inquiry proceeds. Is that likely to happen here, do you think . And if so will that cause this whole thing to die down . Well, look, this is an extraordinary moment for comey, director comey. He is going to have to make a decision. If this involves classified information that was on those devices, shared by huma abedin and her husband Anthony Weiner, they will not dump that out between now and election. There may be another issue here. The issue may not be classified information. After all the Associated Press is reporting these are not emails that came from her server. These may be communications between huma and her husband. What may be there is emails that contradict that whatever huma said to fbi investigators. What we may have a question of her veracity. She may be at risk of telling lies to federal officials and either obstruction of justice or potential perjury questions. So, again, that may be easier for him to put out. Evidence may just sort of dump all that stuff out pause its not classified and then continue the investigation. But, look, this does seem to be, i think, mike pence hit it exactly right. The American People deserve to know. Its interesting enough that hillary has now said she thinks everybody deserves to know. One key question for hillary is, if this involves huma, is it in her best interest for huma abedin tomorrow to say i dont want to be a distraction, im stepping away from the campaign here, in the last week, 1 days of the campaign in order not to be a distraction and disappears from the campaign trail . What effect, sean, do you think such a resignation would have on the race . You know, its hard to say. I mean, the last thing that the Clinton Campaign wants is for this to be kind of like donald trump would drag out some of the con flag rations he would get into. You know, they want the story to go away. And so i dont know if having huma abedin resign keeps the story alive, keeps it more in the newspapers or helps it go away. Its really, i think, a nowin situation for them at that point. The one thing that they do not want is for email headlines to dominate for the next 11 days. They have never helped, gentlemen. What about this is improper behavior by comey intended to influence the election, jonah . I think you have to be higher than a moon bat to think that comey, who i think did the wrong thing way back in the summer by not reaching the conclusion that the facts seed to be pointing him to. If you read his report log to his testimony it sounded hike he was building up to filing a case up until the end he said im not doing that as of a few days ago when every sort of prognosticator said looked like Hillary Clinton was going to win this election run away landslide that this is the moment that james comey decides to cave to pressure from donald trump and the republicans . He would be siding with the likely loser against a likely winner 11 days before the elections. Right. Its strange. For all these critics paul krugman and others their tears are delicious. Whatever you think of underlying questions taking the nearest weapon to hand and saying comey is good when he agrees with me and bad when he doesnt. Seems to me that the problem here is we are not taking the logical argument that a lot of these folks are making to its conclusion which is that if comey receives this information, is he obligated to inform the congress, having answered questions about reopening this investigation very recently and in response to that information what these liberal critics are saying is he should have sat on this. He should not have told the congress. He should not have let it be known until after the election is held. Which would be incredibly irresponsible on his part. He has informed them of this. They are going to continue to look into it obviously you heard the call from Hillary Clinton tonight and from others around her that more information should be released. But the point is that if that liberals who are criticizing comey in this situation wanted him to abrogate his duty in do his job in this situation he felt the pressure to live up to. The pressure comes from not to whether or not he should have looked into the matter but whether he felt compelled to in effect make it public. If you sent a letter to six members of congress or whatever it was, you might as well just go out in the street and take a mega phone and shout it to the world. Which i do think i agree with ben. At the same time, i think if they had found trivial things, minor things from what they have found so far in all of this. In other words, the things didnt point in any particular direction, not particularly damning information. They would have waited until after the election simply because to write this letter now, if its just smoke and no fire, why would you upset the applecart . Why would you take all of the political heat that you are getting . There has to be something significant here that as says if they waited until after the election and then it came out that they were sitting on it, they would be accused of it would be worse. He had to choose between one firestorm and potentially worse firestorm. Do you agree with that ben . I agree with that and i think thats exactly the kind of choice he had to make. Comey cares about his reputation as anyone does. I think he understood in the after math of the decision that he made this summer, there was going to be a focus on him by the congress particularly in this case if he had hit something significant, sat on something significant until after the election there would have been hell to pay. Of course, from what we know, we are probably not likely to find out much more about this unless the investigative reporters on the case are able to ferret out information about what the facts are. Although i will say just as putting on media critic hat, if this was a story about republicans, of the headline of this would be emails unearthed in pedophile probe. Less than two weeks before election day and Hillary Clinton is once again under investigation by the fbi for handling of classified material. So as a matter of law, what is the fbi actually doing . As its clinton email inquiry actually been reopened or is this something much less significant . Lets ask former prosecutor katie phang who is now a prosecutor in miami. Hi, brit. Is this a case being reopened or Something Else . Oh, its definitely an investigation being reopened choices. Look at the letter, brit, sent to the condition congressional committee. House Judiciary Committee you see that comey admits that they found, quote, pertinent emails. Pertinent can mean a whole lot of darn things as we know not only in washington but for purposes of a criminal investigation so, really, whats left to be seen now is who is going to get a sweetheart immunity deal because they have been given out like candy thus far . Let me ask you this. There has been some suggestion by clinton defenders that this investigation, or this inquiry thats underway now is really not about her, about Hillary Clinton. It may be about Anthony Weiner or it may be about huma abedin, but its really not about her. Does that make any sense . Absolutely not. The investigation thats been, quote, reopened according to fbi director comey is into clintons use of a personal server for her emails that may or may not have implicated classified emails. The fact that it was involving devices by Anthony Weiner and huma abedin is the source of the information. However, it deals directly with Hillary Rodham clinton and to suggest otherwise is really irresponsible because no one else is the target of an investigation other than Hillary Clinton. Now, wow i guess in a separate probe maybe weiner is. Thats not what were talking about here. Exactly. Well, can you you can reading between the lines of this letter and what else we know give me a sense, do you have a theory about what kind of information this might have been that would have brought this about . Well, its obviously something that was of the ilk of the import that they decided, they, being the fbi, decided to look more closely. I mean, thousands of emails suggest that it wasnt just a couple of casual i stumbled upon something kind of correspondence that they discovered on these devices, but more importantly, it has to be, again, relevant. It has to be important enough for a criminal investigation to continue. Brit, think about the thousands and thousands of hours of manpower and the hundreds of thousands of dollars thats been spent of taxpayers money going into this investigation thus far. Comey said it was done back in july. We know thats not the case for comey to reopen it means that he himself found something thats worthwhile that youre not going to get an answer prior to november 8th in any investigation. It seems it did seem pretty clear to me when i read the letter in which he reared to his letter in july in which he said during that testimony he mentions this in the letter that the investigation had been completed. That suggests to me that the case had been basically closed. And then he goes on to say here i agree that the fbi should take appropriate investigative steps designed to allow investigators to review these emails to determine whether they contain classified information as well as to assess their importance to our investigation. Im seeing all kinds of words used to refer to this inquiry. Im seeing reopen but not so much. But im saying review and so on is this just a review in your judgment . I mean, can it be interpreted that way or not . No. Its not just a review. Its not let me just look through some emails and see whether or not they lead to anything. There is no way he would have announced it the way that he did. I dont think there is subterfuge on the part of the fbi to do this 11 days before the election. What i want people to know as well, brit, from a legal standpoint, just because you become the president of the United States does not cloak you with the immunity from being prosecuted. A statute of limitations applies to any federal offense, even if Hillary Clinton wins the white house, she may face charges. And, if so, you sure as heck know that Loretta Lynch has no business looking at that investigation or having anything to do with an indictment. You would need a special prosecutor and the doj would have to appoint one. This one last question, katie, the fbi director finds himself tonight under pressure from really both campaigned to release whatever they have. Is an investigating agency in the situation like this in possession of materials like, this and beginning to investigate them, is it in a position to release them . Absolutely not. He has no obligation to do so. Its now become another active investigation. If thats the case during active criminal investigations specifically, do you not release what you have. There is no rolling basis of discovery given to the American Public like maybe in a civil, lawsuit. So because of that, comey can comfortably say im going to retreat. Im going to look. Chris, what do you think . Wow. You know, just when you think it couldnt get any more shocking, any more twists and turns, i see you have got a copy of the letter that jim comey, the fbi director sent to all of the Top Committee chairman in congress, ranking democrats. You kind of are looking at it like Indiana Jones going after the you know, one of the ark of the covenant. You are trying to make sense of what it says, clearly there is a new investigation, but it talks about. Or renewed investigation. Yes. Reopening the investigation. He talks about in connection with an unrelated case, the fbi learned of existence of emails that appear to be pertinent to the case. They have got to see if theyre classified. They have got to see what it means. Here we are. I mean as we sit here today, 11 days before the election. Given the pace at which the fbi does that and comey talks about the fact as he doesnt know how long this is going to take. It raises the pros specketd that Hillary Clinton will be under investigation by the fbi, criminal investigation as voters go to the polls. They already are now, but on election day and that we could end up with a president elect who conceivably, not saying it will happen could be indicted after she has become president. Lets say this for the sake of argument that the fbi was alerted to some information, that might be pertinent to whether she mishandled classified information to a greater degree than he had previously concluded which he said was not worthy of an indictment. Right. They werent really undernewed or retaken investigation or just look at these, whatever the material is and make an asexment as to whether a further investigation was warranted. Would he have gone ahead and written this letter to members of congress, apparently amending his earlier testimony that the investigation was complete . No. I mean, you have got to know that he hates doing what he is doing here. He had settled this case. A lot of people were unhappy with the decision he made. But on july 5th, he held that News Conference. Basically laid down political indictment of Hillary Clinton. But said there was going to be no legal case against her. And now he has to reopen that and has to say go back on his having said that the investigation was closed in his testimony to all the members of congress. He has got to hate it. You have to assume that the only reason he is doing it is because there is some substantial question here about whether his conclusions in this case, about Hillary Clinton may have to be amended. He does say one of the things that they are going to be looking for is to determine whether the information and question is classified. If they werent selfevidently classified, why would you bother . Right. Well, one assumes either that they are clearly or its at least a serious question. Does raises an interesting question about the validity, the value, the wisdom of early voting. Wouldnt you say . Well, yes and. No i mean, look, they could have day of or something. I understand your point, which is that letting people vote weeks in advance and dont know all the information, on the other hand, do you want to make it easier for people to vote who find it difficult to vote on a tuesday, the first tuesday after the first monday in november. We are talking about that. But what we have in our country today is a situation which people are voting, in some cases, before the first debate and certainly many people, millions, perhaps, voted long before all three debates have been concluded, which seems to me to be the kind of thing why would you have three debates if people will already have voted by the time that by the time the third one rolls around . I understand and lord knows the third debate was important. Most important releague one of all. That debate ended over awoke ago. You know, lets say you said okay the day after you can start to vote, to a certain degree you have got to allow the public, the voters to make up their minds whats always going to be incomplete information and are you going to say well, what if somebody comes out on the friday 11 days before the election or i dont know where you would draw the line. Obviously, its possible that information can come out after the election that may make a lot of people consider. I mean election day ought to mean something it seems to me. Well, thats a balance. I certainly do say that this raises questions about all the people someone told me, i dont know if its true. I suppose i should know before i came out here, that there are three states where you can change your vote. And one wonders if some people may go back now who have voted early and say well, i want to take that vote back and i want to switch it. What do you think speaking of which, of course, how do you assess this in terms of its impact on voters who are as yet undecided or at least perhaps made a tentative decision and may react to this . I think its going to have an impact. I think there was a growing feeling out there that clinton was going to win. And that may have discouraged some trump voters. You could just tell from the reaction today when trump announced this at the rally that theyre going to be more energized than ever. You have also got the revelations about the clinton foundation, the doug band memo very troubling about the blurring of lions. You have obamacare and startling increases in premiums for a lot of people. It certainly gives trump a lot of ammunition for the final 11 days of this campaign. Right. I noticed today he got up. He made the statement as you heard about this episode and all of it entails. Reopening of this case. Evidentiary opening of this case. And then he moved on and he went into kind of his standard speech. He didnt stray into any of the extakennous matters that have bedelved him for a period of time which suggests to me that maybe he has figured out that this is how to campaign and he will move forward. The only thing i would say about that brit, is that the day is young. You never know whats going to happen. 11 days can be a lifetime. Thanks. By the way, how are you we have blown up the show. Well take a look at that next with our panel. Stay tuned. It wasnt so long ago that when people talked about corruption in washington they mostly talked about elected officials. People walked in federal agencies might have thought bureaucratic or incompetent but usually clean. The controversies that have swirled around the fbi, the Justice Departmentenned the irs and state department seemed to have changed that perception. Welcome back to our panel Jonah Goldberg and i dont remember any time covering news in washington which goes back quite a while when i was worried about corruption in the state department. [ laughter ] i think there are two things going on. One is the clintons have a tendency of just having a reverse minus touch in corrupting anything that they get involved with, forcing people to bend to them. The white house travel office, you know, 25 years ago was the least Political Office in the white house. Maybe in the whole government. And, of course, that had to become politicized. Everything becomes politicized under them. Its sort of the arkansas way. Second of all government workers, because of federal unions and government unions and the rest have basically become an Interest Group unto themselves and representatives of the party. They were protected by law from being influenced by the elected politicians, thats what the Civil Service is all about. Right. Ben have we now reached a point where the Civil Services protections are actually making things worse . We really have. We have gotten there slowly but we have reached a point now where frankly American Voters and i think this explains a lot of frustration that they have with our institutions generally. They no longer have faith that when they vote anything will change because of the growth of the bureaucracy to the point where it actually controls some aspects of our lives and is so insulated from the responsiveness that they need to have to the American People that these bureaucracies can continue going on in these ways that no one actually approves of and engage in this type of behavior. That gets to the question of, you know, how powerful they are and how voice can you say they are, really. It doesnt really get i mean, i just dont remember experiencing a situation where you really were afraid. Maybe for a period in the Nixon Administration that the irs was going to mishandled your private information. Yes. And i always thought that when something went, you know, to the Criminal Division of the Justice Department and the fbi. That it would be handled properly. Now there seems to be doubt about that. Yeah. For the irs. I think a lot of these institutions are downstream of the staple cultural forces we see all over the place. Everything is basically becoming politicized, polarized in terms of large institutions in our country. And when the people who staff a lot of government bureaucracy are of one political vision subject to group think the same have corrupts Mainstream Media have corrupted institutions in government, too. That has led to us a point where people no longer have faith in our institutions or each other. Led us to more tribal and divided along the lines that jonah is referring to there where everything is politicized and political and every decision is viewed through that lens. I never had any doubt really that government workers, most of them live in the Washington Area were overwhelmingly democrats why would you work for the government if you are somebody like typical republican who doesnt think too highly of the government. But the numbers we had yesterday about Campaign Contributions were really quite striking. 95, 96, 97 higher than that at justice and other Government Agencies which does speak to the fact that when the democrats are in power, they are really in power. Thats right. And its been that way for a while that the government unions give overwhelmingly to democrats through afscme and these other organizations and its a selfprotection thing. And its a guild. Why would you vote for a party that wants to shrink your power and shrink your budget. You are not going to do that. In the sense that it acts as kind of a its a cycle that keeps going and going and never stops because you have a bureaucracy that is looking out for their own selfinterest as opposed to the interest of the American People.
