Reporter well, i got a call from sources early this morning and then over an hour ago San Jose Police confirmed that, yes, in fact, they have served a search warrant at the home of 49ers ray mcdonald. We have video of him actually leaving the jail a few weeks ago on unrelated, unproven, and uncorroborated allegations. Now police got a call from a hospital yesterday morning. It involved a possible Sexual Assault victim who was there getting treatment. The Victim Told Police she was possibly, possibly sexually assaulted the day before and identified the alleged suspect as ray mcdonald. The warrant was served last night. No arrests have been made. The d. A. Declined to file charges a few weeks ago against mcdonald after Domestic Violence allegations. Today mcdonald is back in the spotlight in a negative way here at levis stadium. Comcast sportsnet bay area did hear from the nfl. They say they are looking into the allegations, but as of now, ray mcdonald is able to take the field for the game on saturday against the chargers. Thats saturday at 5 30. Again, these are just allegations at this point. Ray mcdonald has not been arrested or charged in this case. These are allegations identified by police as being potentially the suspect of a Sexual Assault that occurred this week at his home here in the east foothills. This is sunol, but we did have two to three hours of sun, more on the way tomorrow. But there is more heavy rain moving our way, and i want to kind of bring you up to date with some of the more impressive Historical Data thats coming in. This is slowly trickling in, but take a look at this, since the beginning of this month, were now at the 17th, we have averaged threequarters of an inch of rain or more every single day up in santa rosa, so so far for the season, in every metropolitan city across the bay area, were basically at four times as much as we typically get. And last year we didnt even get what we typically get, so that is why we have such historic totals to bring you. Let me show you the radar right now. Picture looks good. You can see the clouds rushing in ahead of that rain. Thats going to be here by about 1 00, so keep in mind if youre trying to get outdoors, your hours to do so without dodging showers are numbered. Crews cleared the road and it reopened to traffic. Nobody hurt in that mudslide. Its becoming a familiar sight everywhere, a large tree fell this time in santa clara. Pine fell along the front of the house, but had it fallen in another direction, it could have taken out a number of gas meters within inches of its trunk. The ground is saturated and the root systems arent as stable as they were. And now people in that neighborhood are wondering which other trees might come down. Right along here, right in front, you know. My kids come out here and play. It could have been a lot worse. Its still pretty bad, but it could have been a lot worse. The calls coming in between 4 10 and 5 30 this morning. Please stop. Reporter thats Eric Hartwick with a short and simple message to the person who set his 2007 jeep on fire this morning as it was parked on cumberland and church. It happened a little after 4 00 this morning. You can see his jeep is destroyed, leaving him not only high and dry, but really, really frustrated to say the least with whoever it was that did this. Back on november 19th, someone set a van and three other cars, including another jeep on fire in roughly the same area of noe valley. The fire investigator who we spoke with this morning is not sure if the two mornings are related. Also doesnt believe someone is targeting jeeps, per se. Still, no arrests in either case. As we stand out here on liberty in the 400 block in noe valley, we have seen Police Officers going door to door knocking, trying to interview people to see if they know anything. Every year family giving tree collects and distributes tens of thousands of toys for underserved children and this morning the nbc bay area family joined other volunteers in milpitas to help sort, wrap, organize, and load up gifts for delivery, and soon all of those toys will be on their way to make this holiday brighter for many local families. And that was our boss there. We have a family giving tree in the office. Im always shocked at some of the thing s requested, sometime shoes. Shoe laces will make somebody a lot better off. Between 1 00 and 8 00, count on shower activity, then things will start to lighten up as we meet back here tomorrow morning, but this will be short lived. Another strong system on the heels of the one thats going to come through today, and as a result we are talking about some pretty heavy downpours starting fridayment i think this will primarily be a north bay event, however, heading over to tahoe, problematic friday into saturday. Much better conditions if youre trying to get up there saturday, into sunday, but heres the deal. As we head through next week, we are going to see a prolonged stretch of dry weather. That really kicks off on sunday and extends into christmas day, thursday. Then after that, the first week of january, potentially, we get slammed. So you do want to keep that in mind, we have a lot more rain on the way, but a nice dry break just in time for christmas. Maybe youre heading out of town. We take you inside the numbers, including one agency missing court 20 of the time. Paid to serve, protect, and show up in court, but we have uncovered more problems with local Police Officers who are skipping out on their courtroom duties. Chief investigator Tony Kovaleski has the exclusive details. All rise. Court is now in session. Reporter its a time for the ticket writer and the Ticket Holder to make their cases. Call the first case number one on the calendar reporter its show time in Santa Clara County Traffic Court. But as Court Records confirmed and our investigation found, in many cases it was noshow time. Apparently he had forgotten that there was a Traffic Court appearance today. Reporter we found Law Enforcement officers failing to appear in court, costing the court, the county, and the city both time and money. Forgetting is not good cause. Motion to dismiss is granted. Your tv spot, your investigative reporting resulted in some of these agencies being made aware of the fact that theres a problem here. Reporter and our analysis of traffic Court Records found the biggest problems with the redwood city chp division, the San Jose Police department, and the San Jose Division of the chp all failing to appear for traffic tickets more than 15 of the time. Your agency here in san jose is one of the highest in failing to appear. Will you share that with your patrolmen . Oh, most certainly. Yeah, its thats an easy question, yes. Definitely, is the message going to be a little bit stronger . I think they are going to have to turn the television on. Reporter when you got these numbers, a bit of a wakeup call . I think for us when we look at the numbers provided to us, she recognized the fact we needed to do a better job. Reporter both the chp and San Jose Police promised changes, including tracking and Monitoring Court appearances. So this matter will be dismissed. Reporter now five months later, records show those changes have made a difference. Theres a significant drop in noshow rate. Reporter Court Commissioner is referring to these numbers. Since our first investigation back in june, San Jose Police dropped its noshow rate by 4 . San jose chp dropped by 7 . And redwood city chp went from a 20 noshow rate down to 8 . A 12 improvement. Whats that say . That says that, well, number one they listened to what yall had to say. And they made the corrective made the corrections. And it just tells me that they want to do the right thing, they did the right thing. Reporter but our latest review of recent Court Records found not everyone got that message. The officer is not present in your matter reporter on this day, a santa clara sheriffs deputy failed to appear. So this matter will be dismissed, lack of prosecution. Reporter our review of Court Records for the past five months found missing court 20 of the time, a 6 increase from last years numbers. The largest noshow rate of any major agency. That number is a little higher than i expected. And thats the reason why i was surprised when you presented me with the data. Reporter captain rick sung responded to the numbers saying the Santa Clara County sheriffs office, like other agencies, will now focus on tracking deputies appearances in court. Whats the message youre taking to your deputies from this data . Take care of business. This is what we have to do as a government entity. Australian Security Forces are trying to figure out why the man behind this weeks deadly hostage situation in sydney was not on a terror watch list. They say the 50yearold iranianborn isis fanatic had been on a watch list but was removed from it years ago and its unclear why his name was taken off that list. Earlier this week, he held 17 people hostage inside a cafe for 16 hours. He was killed when Police Rushed in to free the captives. Two hostages died in that standoff. That hostage situation rattled a lot of nerves, but also cast a negative light on uber. Some riders were charged extra to escape the area in sydney there. In todays reality check, sam brock sees if uber broke its promise. The hostage situation in sydney is the most recent and extreme example of an emergency, but stormaggedon also sparked outrage, particularly on twitter. Did the company take advantage of its riders . We take a closer look. It was by nearly all accounts an unusual bay area weather event. Trucks slushing through Swimming Pool highways, vehicles stranded with drivers climbing out of car windows, residents displaced from their homes, an emergency . The Ridesharing Company uber didnt think so, allowing prices to jump up to four times the normal rate. Uber says the higher prices attract cars during times of need, in line with the companys business model. But transportation industrybacked group whos driving you . Slammed uber for allegedly breaking its promise to shut down surge pricing during local emergencies. So whos telling the truth . Heres the reality, following uproar over ubers surge pricing during hurricane sandy, the Company Announced a new National Policy shown here on its blog to outline how ubers algorithms will be capped during disasters and relevant states of emergency, although they werent capped during the bay area storm. To be clear, dozens of School Districts closed school the day before, major roadways shut down and Many Companies cancelled work. All activities at californias office of Emergency Services tells us indicative of emergency preparedness, so why didnt uber consider the event an emergency . Thats the question we specifically asked the company and received the response, the uber app was created to give riders a safe, reliable option to move around downtown and dynamic pricing makes it possible for uber to meet even during times of high demand like inclement weather. So while everyone treated the storm as a emergency, it failed to meet ubers standard. Uber did strike a deal with new york about what constitutes an emergency, that includes stressful weather, but that definition only applies in new york for now. But lets start with the good before we get to the bad, which is more aftermath from more potential flooding. Good stuff from tahoe, this is from about 5,000 feet, south lake tahoe, and you can see it looks like a virtual Winter Wonderland out there and its like lets hang on this video because it hasnt looked this good in years, in over three years, and based on what im hearing from a lot of resorts, they are expecting one of the best seasons in over ten years. You know what, some of the results so far are definitely representative of that and were talking about kirkwood the past seven days, almost three feet of powder and thats at the base and its all about that base. Were going to continue to add to those accumulations as we head throughout the next couple days with more rain on the way, but if you wanted to head up there for christmas, looking good, nice and dry most of next week across most of california. Lets bring you up to date for the month of december. This took a lot of time to get all this data together, but were looking really good in terms of our average rainfall. Here in the south bay, for example, we usually only have about an inch of rain for december, so far this december we have had over seven inches of rain. As a result were at 786 of average with more on the way. We could actually break an alltime record in san jose. We just need about two more inches of rain and i think we are going to do it. We have until the end of the month. You think about it, these are records for december, were at the 17th day. We still have about a half of the month to get through before were able to really rack up the totals for you.
