Mexico trade agreement assume taht is hard to say the NAFTA Canada is not in the deal not yet in new monarch is a visiting scholar at the Cato Institute So can you give us an overview of some of the updates to NAFTA that the u.s. And Mexico have agreed to so right now we know a little bit about what was agreed to by the u.s. And Mexico based on some facts sheets that the United States Trade Representative post on their website yesterday afternoon some of the major changes the agreements are in the area of rules arch and rules of origin are the requirements that essentially say whether a product can qualify for duty free entry as part of the agreement some of the things that were the main focus of this for autos textiles chemicals and stealing kinds of products as well as optical fiber I mean the details do get pretty granular Tell me about the change of the. Sunset provision what is a sunset provision and what's changed about it so originally what the u.s. Side had proposed was that after 5 years the trade agreement would automatically expire unless all 3 parties agreed to continue it so now what they've agreed to is that the trade agreement would be in effect for 16 years and that after 6 years they would review it to see whether they would continue for another 16 years now if they don't get to some sort of agreement in that time period let's say within the 16 years there's a potential that the agreement could expire now it's not clear without seeing the actual text of the agreement what would happen but that appears to be the compromise solution for the sunset clause how significant would you say these changes are to what's contained in the original enough to deal with a what you expected based on what President trumpet said in the past well I guess it depends on chapter by chapter and we'll know when we see the full text So for example on e-commerce on labor and environment it appears that what we see are similar things to what's in the transpacific partnership agreement already and that I think was no surprise to many people who are watching us but in terms of strengthening the rules of origin which was sort of what President Trump said were the main things he was going to focus on he really has made them tougher So NAFTA is already one of the toughest rules of origin regimes of any trade agreement in the world and they just got a lot more strict and I think in that sense the impact will be pretty severe particularly for the auto industry where that content requirement went from 62.5 percent regional content requirement for duty free to 75 percent regional content requirement so that means like 75 percent of all the materials in a car have to come from the u.s. Or Mexico that's exactly right and there's an additional requirement that they put in which is really a new provision that's never been in any u.s. Trade agreement before that is to say that 40 to 45 percent of that $75.00 has to be made from workers that make at least $16.00 an hour minimum wage and that is something that we've never really seen before in a trade. And it's really hard to tell what the impact of that's going to be other than the fact that Mexico will be adversely affected by in what way because they're now going to have to shell out $60.00 per hour for everybody working on that factory floor pretty much and they make roughly on average about half of that right now whereas the u.s. And Canada are to pay their auto workers at least $16.00 are and so they won't really be affected by this what details have not been worked yet so the big question remains what's going to happen with dispute settlement which is basically where one of the countries can hold another to account for not meeting the obligations of the agreements ambassador light Heiser said he wanted this to be non-binding and if it's not binding it's hard to see how you wouldn't force the trade agreement at all and I think that's going to be a major thing to watch out for this week or us in terms of timing there to flow charts here one where there's a bilateral trade deal and another where there's a trilateral trade deal Canada comes aboard what does the timeline look like so right now we have a tight deadline this week in particular because Ambassador light has or has said that he wants to give Congress a Notice of Intent to sign that deal that starts the ticker for the signing of the current agreement within 90 days so that takes us to the end of November where the u.s. And Mexico could possibly sign the new agreement now for a trilateral deal it's hard to say exactly where that deadline might be other than before the u.s. And Mexico signed their own agreement what do you think the likelihood is of this moving forward without counted and just being a bilateral deal with Mexico and would it be effective. I think it's certainly a possibility and we shouldn't rule that out President Trump has made pretty clear that he's willing to go ahead as a bilateral and even charge Canada auto tariffs at 25 percent for some sort of compromise if Canada cooperate would it be a fact I don't think so when you think about the way that the 3 countries have integrated since NAFTA was put into a fact we have over one trillion dollars of annual trade between the 3 partners you know if you think of it as like a supply chain running through the 3 countries it's almost as if you're putting a wall up between the United States and Canada and I think I'd be very detrimental to all 3 countries that occurred you know monarch a visiting scholar at the Cato Institute thanks very much for explaining this to us thank you for having me as we said President Trump is implied he's ready to cut Canada loose if it does not get on board quickly Canada's foreign minister Chrystia Freeland today cut short a trip to Europe to join talks in Washington in person specifically trumpets that Canada must sign a new deal or face heavy tariffs on the cars they produce Gordon Ritchie was one of Canada's chief negotiators in the original us Canada Free Trade Agreement the precursor to NAFTA that was back in the 1980 s. Ritchie is actually optimistic about the talks I think you could be agreement in principle but this we can't now working on some of the final details may take a fair bit more talk but it is if there is a political will if the Americans are ready to pick up the given who has quivering on the table this whole thing could be wrapped up in this week and so the deal quivering on the table that that deal is is what essentially basically the old NAFTA with some modifications I would say you will not have to do what it is isn't the agreement to eliminate terms between the 3 countries which is what the existing agreement does with some additional rules on content what constitutes a product or to travel freely across the borders and around a few other. Bits and pieces some of which will be of interest to some people more than others for example the Us pharmaceutical industry makes an enormous effort to extend the patent monopolies it enjoys and it appears there may be some movement on that as well but the basic deal would be as before free cross border trade for qualified products between all 3 countries and by the way I know Mr Trump when he gives some idea or somebody was present thing in his ear specially from Fox News it stays in there her and it rattles around but to make a big fuss about the Canadian dairy tariffs is really kind of foolish I don't know which is done I don't like the Canadian program but we're talking about less than a quarter of one percent of the 2 way trade less than a quarter of one percent and on that trade by the way the Americans are running a substantial surplus and by the way these terrible terrible terrible Canadian tyrants are no higher than the tariffs on some American sacred cows if you'll forgive the pun like and tobacco and sugar so you know one has to understand Mr Trump is almost completely disconnected from objective reality he has to be very blunt about it he is appallingly ignorant certainly in these in these trade matters he doesn't know what he is talking about and so his negotiators have a very difficult task but they're doing a good job of it and I think they can probably pull this off your opinion may be that Donald Trump is ignorant but I mean if this plan works I mean does it matter well if this isn't a matter of of my opinion. Trump is criticized for being a pathological liar I think that's a bit of a bum rap I think he honestly doesn't know what the truth is in many cases and even really doesn't attach much importance to it he doesn't know. Think about international trade he doesn't for example in that press conference that he had to to announce this wonderful deal virtually everything he said was factually wrong including by the way that the big deal was with Mexico because trade is Kenya's a much smaller sector Well that's just plain silly I mean Canada is by far the biggest customer for u.s. Products in the world and the best customer I mean it's just one example but everything he said was inaccurate that doesn't make it any less dangerous. You know poor Bud Light eyes or I don't envy him but he's got the u.s.
