Ran hillarys 2016 communication campaign. It was not your fault. It was comeys fault. The numbers were going through the roof up until ten days before and then fell off. And my good friend, the great ari melber. Obviously host of the beat. Nbc legal analyst, chief legal analyst for msnbc. And i want to start with a tupac quote for you because of those of you who dont follow ari, it is the 6 00 record, and tupac said do everything you can to make it over the system or out of the system. Post mueller depression. Mueller has finally spoken but does it change anything strategically for democrats . I think not. If we had had confidence that the president clearly did not commit a crime we would have said so. We did not, however, make a determination as to whether the president did commit a crime. Theres no obstruction. Theres no collusion. Theres no nothing. Under Longstanding Department policy a present president cannot be charged with a federal crime while he is in office. That is unconstitutional. Do you still say Robert Mueller behaved honorably . I think hes totally conflicted. Charging the president with a crime was therefore not an option we could consider. I think mueller is a true nevertrumper. Okay, they still face the impeach or not to impeach quandary. Either recommended a cure for what could be a democratic hangover. I love we have a Brilliant Communications minds, a brilliant lawmaker mind. I want to start with a theory the democrats are playing the wrong game. If they impeach its the wrong move. They play into his hands. Its a loser in Public Opinion and ends up with a w. Change it to what i call the trump criminal investigations. Its not about impeachment. We might get to that, but hes already according to mueller, you convict him, hes already obstruction of justice. He just couldnt indict him because of doj guidelines. Hes an unindicted coconspirator of new york. We are initiating the trump criminal investigations. Barr marketed mueller. I say market away from impeachment, rebrand it. I would love to hear from a legal mind, a communications mind, a lawmaker mind. Is that an interesting strategy, and if so lets put it together. Its an interesting strategy and obviously congress has an Important Role in its investigative and oversight functions as im sure the congressman can tell us from experience. I dont think its an either or. I think the democrats do have a problem here because there was a lot of talk about what bob mueller was going to find and what they were going to do when they found it. And from the 68 days when he turned into his report and barr responded and i think at times lied about it and mueller broke his silence and resigned, on the 68 days i dont think the democrats have landed on exactly what they want to do. And i think they need to probably say that with one voice and show the country whether theyre moving on, and which goes to your point, lately it felt like a very long remuneration. I want to hold up the words because im a marketing guy. Let that sit in, trump criminal. All im doing is branding and putting out a different fight. Let him say like richard nixon, im not a crook. Let him say why they hold him criminal, but put those two words together. Put impeachment away. Thats where he wins, rebrand. This is a time where i think you have hit upon a branding where i think is easily applicable to politics. I thought it was really smart because i think when people hear impeachment they think youre trying to use extraordinary means to remove the president from office because you dont like him. I think thats probably what people hear, not because he committed crimes. I think crimes are sauchbled in courts. They dont understand that what mueller was telepathing to us all is that these crimes are adjudicated by the congress and thats where it should happen. But ari said something about that chairman frank will back me up on is never going to happen, which is the democrats need to speak with one voice on this. But you can i know theres no reason why you cant say this for the time being until you determine and i dont think that pelosi, people seem to think that its an eitheror. Either nancy pelosi at this moment is for starting impeachment proceedings or shes never going to be okay with it. I think they should say theyre continuing to look into see what kind of criminal activity the president may have done. I know you love where pelosis at. Talk to me right now if you were her Business Partner in this and you have this quandary. We let him get away with naming people. I think its time to start calling him unindicted donald. And like the sound of it and it reminds people hes unindicted. And thats his status. Earlier points. One, i read the constitution. I dont see anywhere where it says the president cant be prosecuted criminally. I agree. In fact, one of the things i would recommend now is that every democratic candidate for president of which we have way too many, should announce if he or she is elected president , they will revert that person will reverse the policy and say, no, theres nothing that say the president cant be indicted. Second, and i think this is why we need a new strategy, im disappointed in mueller. But im also ive been saying for some time one of the great lines people say is i dont like to say i told you so. I love to say i told you so. One of the few pleasures that improves with age. Everything else gets tougher. But we put too much emphasis on him and neglect policy, infrastructure, neglect a unfair tax bill. And the final thing youre right its a two part strategy. I remember when tipp oneil in the 70s. Youre one of the only guys who quote tipp oneil on the show. He quashed the efforts to impeach nixon. Obviously later he orchestrated it. So saying were not ready yet doesnt mean never. But i think at this point the best strategy is talk as you did about the criminal investigation, call him unindicted donald. Thats what he is, and emphasize the substantive issues. Ari, i actually agree with the congressman we lionize bob mueller. I want to show a clip because to me this really frames the world that bob mueller is playing. Its almost as though the lawyers, mueller and his team, are in a knife fight and barr and trump brought a gun to that knife fight. And then ari you came back and you brought tweets and not understanding the communication mueller brought a book to a twitter fight. And this is a story i think well understand on the peoplepeople matter on these things, it was incredible Rod Rosenstein tried to salvage his reputation by appointing bob mueller. People are in jail probably because of that decision alone. It is incredible bob mueller chose to do the job the way he did, and he did many things well. Although there are some things in the end where he got outmaneuvered in the public debate by mr. Barr. And lawyers understand if you let a mischaracterization sit, if you let a lie sit, it is very hard to undo that in the minds of whatever the governing body is. The minds of the jury, the congress, the entire american public. And so as i said bringing the book to the twitter fight meant that barr didnt just debate or disagree with the Mueller Report. I mean hes the boss of the Justice Department. He can do all sorts of things. No, he put in place a view of the Mueller Report that was fundamentally wrong before anybody got to read it. So i thought it was almost a plaintive cry from bob mueller, from another era, a gman. Another era. A military guy, a prosecutors prosecutor to implore everyone read the report. While mr. Barr has summary letters that were misleading and we were seeing two different ways of communicating about these issues. You have barr, the head of the judiciary acting as a marketer of the Mueller Report. So im saying congress should act as a marketer of the trump criminal investigation. Lets get back to the wall. Impotent tweets. The increasing tweet rages are having a decreasing effect. Is this one more sign trumps 2016 bag of tricks will go limp in 2020 . His nicknames, and his tweet when we say his interactions are down, the percentage of people liking them and retweeting are dropping dramatically. I have a theory, jen, that made him such a shiny toy three years ago he opened up his own publication, twitter. My god, hes calling other candidates nasty names that this takes us to season 6 of the Celebrity Apprentice and i think these are early tells that there may not be trump 2. 0, and original trump is going to get a little stale. I think its important that we still dont normalize what he tweets and then we Pay Attention to it and call it out and say thats outrageous and thats not normal. And i think sometimes we find that frustrating because it seems thats an impotent response on our part, that we shouldnt be able to Say Something more than this is crazy or dumb or not normal. But the alternative would be we were scared by his tweets. Right, in an alternative universe we could live in an america where we took his tweets seriously and that would make for a much worse outcome. I do think i actually talked to a lot of different voters. I make it a point to go to places where democrats arent and talk to more of them. And, you know, theyre wearing the tweets wear on them, too. I mean the hard core Trump Supporters will say okay he tweeted something, thats what im supposed to believe yeah, they see it and theyre like i guess thats something i have to tolerate, but, wow, i wish there were another way. Congressman, do you see something historically, obviously theres been nothing like trump, the very thing that got them there starts to hurt them . I havent seen that exactly. A president , Andrew Johnson who got drunk and wound up getting impeached and not convicted. Part of it is i think theres a real element that helped trump and thats the economy. The fact is there was a refusal on the part of other people and i believe some democrats to recognize that Economic Growth had stopped helping a lot of people and was becoming a source of anger. And so much of trumps support was in fact real. I think the thing about the tweets is that for a lot of the people that wasnt why they were for him. And i do think now he was just a fresh brand. But the reality is the tweets become more and more irrelevant to the economic reality, which is the biggest issue. I just think what it shows, ari, real fast before we get to the next topic is there was a lot of sizzle. And the more sizzle coming forward the less steak there is. Its kind of nasty meat. You can promise things can get better but if they dont get any better you lose that. The data is showing people are responding less to the tweets. That tells you something is going on. He is a classic troll, which means that the people who hate the tweets often respond even more than the people who love them. We should also be careful in overlearning the Public Opinion lessons. We live with the electoral college. Its a part of reality. But when congress doesnt pass a gun control legislation in the senate while the majority of the country is for it, we dont say oh, i guess people dont want gun control. We say the actual system is out of line with the public. So we have someone at the table who happened to work for the candidate got more votes. Even when the tweets were on fire, more americans did want something else. So i think the democrats have to also be careful to learn a lesson but understand its not as if the tweet strategy had 51 to begin with. The tweets meant a lot when thats all you knew about trump. He had these clever tweets and they were exciting. As hes been president well over half his term now and very little has happened, people judge him less on the tweets and more on the reality. The tweets held up at first, im a tough guy, im going to break things apart and things havent changed. Then theyve got more on the tweets to judge him on. And it goes to your point the way a lot of it was bravado without delivery. As drake said. I had to do the tupac. I was waiting. It took 14 minutes for you to get to a quote. Trigger fingers turn into a twitter fingers. Lets go back to the wall. Bernie blues. His slipping poll numbers suggest hes not the next antitrump. Real fast around the table. To me hes caught in between. Elizabeth warren has outliberaled him. Shes come with real meat on the bone. Biden has come as the more moderate guy. Hes not just the antihillary. I dont know where he goes. I thought when he came in at 22 that might be his floor. Because he lost a lot of support when there were more candidates. And he is falling behind and i think hes falling below that number, and i think he is losing people to Elizabeth Warren. I saw somebody on twitter go im a bernie guy and liked the town halls but after i heard Elizabeth Warren say why it was a bad idea im for her. I think its interesting. I think we all kind of thought the democrats are going to elect their trump, somehow the democrats were going to repeat the sort of behavior, the dynamic the republicans had on their side four years ago. Thats never what happens. We saw bernie as that person but he seems to be slipping. Youve obviously worked with bernie over the years. I think hes going to slip dramatically. Is he going to stick around, though . I think he will. Shes a very stubborn guy. I was very critical of him last time. Look, he was not an effective senator. Part of his problem is Elizabeth Warren got more done in Public Policy for the left as a citizen than bernies done as a senator. Hes an advocate out there by himself. And in 2016 the anger that produced trump, the unfair criticism for hillary, that gave him a base. But i think he was punching above his weight area. I think you underestimate Bernie Sanders appeal at your own peril. Hes a guy who recently won states, hes going to do very strong in new hampshire. Hes got a lot of money, not going anywhere. There are certainly policy debates to be had. I would not underestimate. Straight ahead, the untouchable president. I could stand in the middle of fifth avenue and shoot somebody and i wouldnt lose any voters, okay . The sentiment stands, did muellers appearance and adherence to doj guidelines leave trump and all future president s above the law . What would it actually take to indict a sitting president. Plus the trump 2020 pivot. I think trump will pull a surprise and lift to the middle on some key issues in the upcoming race and democrats better be prepared. And joe biden has got a big lead in the polls. Weve got two of the worlds top pollsters to look at 40 years of the president ial polls at this moment of the race. [ paper rustling ] exactly, nothing. Is muellers real life activation not indicting a sitting president begs the question what is the criminal Tipping Point for this and future president s. Ari, this is memo, an obscure 1973 memo. And in 2000 it was upheld. What has to happen for you to be able to indict a sitting president . This was a process crime. Just handicap this for me. Its an open debate because the constitution doesnt give you a firm textual answer, but, look, for a long time the view has been you dont indict a sitting president. And you can ask president s johnson, nixon and clinton when asked if there is a view correct or not you did something bad in office. And Everybody Knows it goes over to congress. I think it cuts both ways. It cuts to mr. Barr because hes playing dumb, aka, misleading about the issue. But it also cuts in some degree for the president. Because if mueller wasnt going to do more of an impeachment referral, i think it is least the body of precedent, the larger support for the view among legal experts is when theres an issue with the president whos to the guy or gal who enforces the law, it is the congress that indicts and the congress that adjudicates. But that begs the case if you have a same Party Congress you will never have i want to reiterate its not the constitution i think is ambiguous. If it doesnt say it, it doesnt happen. Theres nothing in the constitution that says you cant indict a sitting president. It leads you to absurd result he can commit a physical crime and not be indicted. And impeachment is not a suitable alternative because we have this rule when theres a jury trial in a criminal case there has to be impartiality. Theres not a Single Member of congress who could become a juror in a criminal case against the president because of the politics of it. But you cant compel the Justice Department to do it. Ill get you on the next segment. Trump 2020 pivot. Warning to democrats, trump has always doubled down on his base including a losing 2018 midterm. But his job was not on the line then. I believe as the ultimate transaction list he will pivot towards the middle on some key issues and the dems better be prepared. I know this guy, hes the ultimate transactional guy. Hes going to look at the numbers and say where he stands on his base and where he is with suburban people, women, independents, hes going to make some moves when it comes to women rights i think even possibly guns. I know this guy like the back of my hand and the democrats are going to be like what . I think its like wise to take your warnings because they usually turn out to be pretty impression. And its come back. Sg he with behind new coke. And the pinto. I think that overestimates his flex ability, his personality is so engaging. Hes been doing things that makes no sense except for his ego. The one case we have is where he talked about moving away from his base, he got somehow intimidated out of it. But the last point, the one that makes me feel secure politically is i cant think of any group or anything dramatic enough for him to do. Is he going to come out for roe v. Wade . Hes already teed up. It hasnt happened. Theres a lot that people i was going to say unfortunately like about him. And to me that has shifted is other social stuff, the racist stuff cant change. Its too late. You think he would go back on race . You think he would soften that . I think he might come up with some type of immigration solution. I think he might put on some form i know hes put health care on the back burner. I just believe hes going to look at it and see hes a loser not to congress, and he will do ari, real quick on that one . How many therapists does it take to change a light bulb . One. One, but the light bulb has to want to change. He wants to win. Hes the ultimate survivor. He doesnt understand how to. One minute on this one. Economy going south. The bond markets this week gave us the irrefutable sign thats preceded every recession of the last 60 years. Were going to go to this. The combination which basically tells you that pundits think the world is going really south economically. And of course thats selffulfilling to some extent, but theres always been the case remember the budget deficit and tax cuts and spending that he put through super charged the economy. That is winding down. So there was always going to be that down side or this down trend. Hes now exacerbating that with trade. He continues to want to do that, and i think hes going to have a much less good economy. It was coming out that Steve Mnuchin had anything to do with this new absurd mexican tariff. I guess my question as somebody who came from the clinton world, its the economy stupid, i think because its such a polarizing human good or bad the economy doesnt play as much i 100 agree with you. I think for 30 years since reagan was elected the economy has mattered less. But what does matter, i have heard Trump Supporters who are hurt by tariffs say you know what, im willing to hang in there with him. Its emotional. Because hes trying to turn the ship around, we didnt get here overnight. Still ahead, do not believe the polls. What history tells us about joe bidens big lead in the polls. There are more than 20 candidates fighting for democratic nomination but only one clear frontrunner. Joe biden is polling 38 of registered democrats in a morning poll out this week nearly doubled. 70 of democrats in the latest nbc wall street journals poll say they are enthusiastic or comfortable with biden. But do these numbers matter eight months before the first votes are cast . At this point four years ago jeb bush was the polling nominee. We looked at 18 years of polling data to see who was leading in june. Only four became the nominee and just one became president , bush. Just a few of the greatest hits, guys. Jimmy carter was at 18 . And its just interesting scott walker was at 16. 5 . A guy named donald trump was at 3 . And you lift that with Rudy Giuliani and is there anything in this history or is it in such a different world now because the amount of exposure and candidates . First of which we look at movements. And when we look at the morning consul poll as an example only two of the candidates have actually improved their lead since january. So thats important. One of which is biden and the other pete buttigieg, those two. The other thing i look at is the last cycle. I think trump led in 77 of polls and 99 of them once he got in by early to midjuly. And obviously hillary was leading 91 of them. So there is a i think significant insight to having this lead if you were able to expand it, but its a long way away. Its bidens to lose and he could well lose it. To build off that point something we have to think about here is these campaigns have gotten significantly longer over time. When we started in january 2007 that was incredibly early. He announced on december 16, 1991 that he wasnt going to file papers in new hampshire. The primaries were starting in march. It was a much shorter campaign. So the longer out from the actual voters being heard at the polls, the more erratic the polls can be. Are you seeing any numbers that joe a biden vulnerability in terms of trending or certain characteristics that make him very vulnerable . If i was seeing anything i wouldnt talk about it. No, look, wave just come onboard pretty recently. I think the thing for joe biden right now is hes got to know hes got a name idea advantage thats worked to his favor. He was Vice President for eight years. He knows thats the case, and i think theyre running a campaign accordingly. The question is for any candidate how does that name i. D. Sustain you when others become as gone as you are. The one thing hes got big in his favor is he can beat trump. And to me that is the driver beyond anything. And right now theres an idealized version of biden which kept it very kind of back which is smart. What would you be looking for in biden if you were looking at numbers to see the chinks in the armor . First of all lets look at why hes in the position hes in because i think its more than just name i. D. Hes leading because the democratic electorate may not be as progressive as we think it is. We did a poll recently and found that selfidentified democrats who were likely to vote in the primary were more center left than far left. And certainly more center left than republicans offer. So that was comfortable terrain for him. Using branding you know who he is and hes modernized a little bit. Well see the extent to which he can appeal to a crosssection of votes. Hes up by 30 or so. What i think is going to be important hes currently second among younger voters, but as a lot of people indicate there could be as many people who are part of a genz, and that would be something we need to take a close look at. Apparently hes in solid second place there. I think a lot of that is with name i. D. And the halo effect from eight years in the white house. I think theres nothing thing at stake here. I dont know if the polls show this, when i used to do advertising we do a very racy campaign. And i think that would have traditionally worked against biden. Hes been there, not sexy. The comfort food, the kind of safety of biden works against the current company. I think theres an element of that thats true, but the other thing true in my experience in president ial campaigns is people want to fall in love. They really want to get excited about the candidate theyre with. And im not saying thats not true of joe biden and his supporters. But if you look at some of the polls you cited they changed in 2008 when barack obama won in iowa, won in south carolina. And its the first time in february 2008 when he took a lead in the national polls. So i think the voters are going to be excited about a lot of these people. They like a lot of these people. We dont have a lot of controversy on our side, so i think youre going to be road tested over time here, and this thing is going to change. It certainly will change in a few weeks with the debates. Im curious as pollsters if you were talking to biden or one of the underdogs what would be the key thing based on the research youve seen, youd be saying to each one of them to accomplish in the debate . John, start with you. Not to think too much. I think too many elected officials, too many candidates, too many consultants try to put too many thoughts in peoples head. Theyre being true to themselves. Theyre speaking from their background and their authenticity to me is just very, very obvious. In particular what biden needs to do is talk more about the future. Clear in terms of how he can in his view kind of restore america domestically as well as internationally. He started that perhaps with his education policy being out of the gate first. I think your boy, the fact hes a vet is huge. I think its important and a credential people will value. My mantra about president ial campaigns and debates in particular is youve got to talk about their lives not your life. Ultimately youve got to make that connection with voters. No matter who you are its got to be about the things that are their most pressing concerns and youve got to demonstrate youve got the remedy for that. I think thats where youre seeing many candidates do pretty well right now. Youve got about five sucking up about 80 of the tolls in the polls. Im saying goodbye to these guys. People talk about nancy pelosi, k mcconnell is best example of an abusive leader ive ever seen. I think he stepped out this week to be more clear about what he thought we needed to know without stepping outside of his lane as jim comey did.
