First, we will dig into the trial donald trump has been running from his whole life. We have a special report on the witnesses that could be crucial to the case later this hour. Then were going to take a step back from all of this. Its one of the most legendary prosecutors alive, a former sdny who actually prosecuted the jimmy hoffa mobsters depicted in the new irishman movie. Thats tonight. By the end of the hour we have a special interview with a musician debuting his work at a top museum. Its not a typical week and this maybe wont be a typical show. While Speaker Pelosi is playing hard ball with trump and mitch mcconnell, the fact is preparations have already formally begun for the indignity facing trump in the new year. This will be a trial on his conduct and his fitness for office. So, just think about that because it can be easy to forget amidst all the sniping that donald trump not only lost this week. But just the fact of going on trial may have him feeling like quite the constitutional loser in january. His team already prepping. I could show you here Trumps White House counsel leaving capitol hill today because they already began walk throughs and soft he rerehearsals. Take a look at what trumps aides told nbc news about expectations. As i think the president s made very clear, he wants the opportunity to make this fully and robustly to the senate as well as the American People. So, were working with leader mcconnell as well as Senate Republicans to work through that process, how that would unfold out on the senate floor. That is what they call a walk and talk. As weve reported, no matter what deal mcconnell will claim to have in january, senators can demand votes to add evidence and witnesses throughout the trial. Pelosi, meanwhile withholding these articles as Congress Leaves Town which makes the earliest date for the trial january 7th. There are two levels for pelosis approach. On procedure, the senate may not care much about rushing her. Thats what mcconnell insists. Im not sure what leverage there is in refraining from sending us something we do not want. Other House Democrats seem to be suggesting they would prefer never to transmit the articles. Fine with me. Fine with me. And hes not just trolling. That may be fine with him. But on the other level, there is strategy. Pelosi may be deploying her knowledge of trump to draw on his reported desire for a flashy testimonyfilled trial. His belief would apparently vindicate him. In a political environment where everyone is often on to the next thing, pelosi has literally held washingtons attention by delaying the time when mcconnell may argue that he becomes the person in the drivers seat. And that keeps the focus on her argument,that trump abused his power and should be kicked out of office. Shes also moving forward on governing backing the bipartisan trade deal this week and formally inviting trump to the state of union february 4th. That boxes him into a plan even if he is coming fresh off the trial or within the trial, note that president bill clinton gave a state of the Union Address while his senate trial was in progress. While mr. Clintons address was about the state of the union, the focus of many was the state of his presidency. Its still hard to believe this is a man whose job is in jeopardy. My fellow americans, i stand before you tonight to report that the state of our union is strong. [ applause ] living history. We turn now to federal prosecutor John Flannery who has been counselor to several congressional probes, Margaret Carlson who reported many of these stories, and making his debut on the beat, haze brown who covered the impeachment. John, your view of pelosis strategy which focuses more on dealing with the way 2019 works than the technical role of the senate trial. Well, i think she knows how to read the psychology of trump, and were all aware that she knew that trump was at war with mcconnell who wants to protect the reelection of his members. So, he wants as little as possible. So, i think that you also have to consider theres one day left in the house schedule. So, you really cant fault her much for two weeks given you have this statement in which mcconnell intimated that if it came it would be dead on arrival. He would find a way to dismiss it. He didnt say it, but he took it up to the waters edge to say that. We have a situation like in alice in wonderland, he wants a verdict without any evidence. Thats going to put a lot of pressure. Which character is he in alice in wonderland . Red queen i think. Most appropriately. But does that does that make the impeachment articles the rabbit because ultimately hes always late. No, i dont think down the rabbit hole. Harris is new here and hes already looking to get out of here. Wait for the musical interlude. This is bad. Im sorry i started that. Well go john and margaret. I got us off track. That was me. Okay. I thought it was fun. The next step i think is that when we come back i hope they spend the two weeks writing the kind of paper that attacks the senate. The senate for failing its constitutional obligation, we have a biased leader in the senate. We have at least four different senators who have received contributions from the president. Gardner, ernst, tillis, and purdue. With we have one senator johnson in the case and a Vice President implicated in the charges. What are they doing on the panel . That should be a motion to the justice or beforehand. I think when they tender the articles of impeachment to the senate sometime in january, i think that they have to also file the paper that make these points and others including the witnesses they want. Let me get margaret in but i think those are interesting points. Yeah. Ari, mcconnell says that pelosi has no leverage. Mcconnell handed pelosi leverage by being so outspoken, brazen, about how he was going to treat the trial. He proudly said he was coordinating with the defendant and his lawyers. And thats against the oath hes going to take which is to be an impartial juror. And then Lindsey Graham chimed in and weve had almost a continuous loop of quotes of senators that were around for the clinton impeachment when there was agreement on the rules, there was agreement on witnesses, and they were all in favor of that. And now theyre not. So, its totally political in that sense as john just pointed out. It never made sense for pelosi to send the articles of impeachment over for a quick death. At worse now its going to be a slow death. We know the outcome. I dont mean to be cynical but i think we know the outcome. Unless god comes down from heaven and you get enough votes to convict him. I dont think the senators that are worried about that are going to be worried enough to do that. Theyre more fearful of what trump can do to them as is the entire republican caucus. So, rather than commit suicide, theres a theres going to be time. And everybody understands you dont have to be a lawyer. You only need to watch reruns of law and order to know that you put on witnesses at trial and theyre cross examined. And each side has their witnesses. So, the idea of getting the witnesses now is front and center. Its before people. They understand it. And it looks unfair. Well, John Flannery would argue because i know him well enough to say this that the other thing in common with law and order is that the defendant is always guilty. Always. Defense lawyers in this case in this case, he is guilty. I know you feel that way. Im not going to prejudge. Can i just tell you the first da in law and order was named what . Adam schiff. Is that right . And Fred Thompson was in law and order. Schiff had better be a manager. They should have a tough team. They should be like Defense Attorneys with the biased tribunal. I feel like were three drinks into the most political christmas dinner ever with a little law and order with a little bit of the red queen. Sorry, sorry. The other piece to this hayes is the defense lawyers hate how on law and order theyre always guilty. A small point. Youve been tracking with regard to the instruments of u. S. Power, foreign policy, something that is supposed to be stopping at the waters edge, nonpartisan ideally, and this president stands accused. In all seriousness of extorting a foreign power with the pentagon, javelin missile level commander in chief power to get reelected. Where does this fit into this in your view as americans watch the trial. Whether or not thats going to happen, that is the case. I think thats what you saw adam schiff towards the end of the house process try to push forward on the American People that its not just about politics. Its not just about we dont like president trump. Its about the fact if we allow him to do this, this is just policy, this is how things work as you saw Mick Mulvaney try to do, that this is all just normal and fine, then we are giving something up. Were giving up the leverage we have with other countries to say this is the right way to behave. In schiffs closing arguments he spoke extemporaneously seven minutes without notes and retold the story of andrier mac who is one of president zelenskis top aides. In this story, kurt volker who was a former ambassador to help out with ukraine, he was telling yermak not to respond to rivals. When schiff heard that, it struck him. You have a lot of republicans saying youre just trying to impeach a president over his foreign policy. You dont like the way he does things. You dont like the way he does foreign aid. In trying to make that the case, theyre willfully ignoring the fact that yes he did attempt to get these political favors out of a president who is indebted to him. When they hold up president zelenski saying i felt no pressure, they are willfully ignoring the fact that a person who is being asked for a bribe is not usually very willing to come fard aorward and say im b asked for a bribe. So, they say the democrats have to say the president of ukraine is a liar in order to believe this. Yeah, sometimes in a case like this you dont want to say what is really happening. The fact they are willing to put this blanket over it is shocking. Can you speak to that point. When there are cases proven in real courts of extortion, often the person extorted was going along with it because they felt threatened one way or another. Thats true. We do have correspondents or conversations with senators in september when the clock was ticking as to whether the money would be lost by the end of the month, the fiscal year. And it was on or about the 9th or the 10th and zelenski told senator that is the money was being held up and he was in this squeeze. So, i dont believe they had that testimony public at the hearing. But that is the statement, and senators have confirmed it and its been reported. And at a trial in the senate, you dont have to limit yourself to the witnesses that you had before. But i wouldnt go gallivanting around looking to bring some person who hasnt been testified before, isnt materially relevant to the center case that the democrats have well, the question thats what weve been watching. The question is what is the relevance if the senate wants to take this seriously. Or in good conscience in all of american history. I have to fit in a broke. Everyone was in the loop. Trumps ambassador famously implicating everyone in his ukraine plot which got trump impeached yet all those key people are hiding from testifying, bolton, pompeo, giuliani, mulvaney who blames trump, his boss, for his own silence. President trump has said that hed like to see you and secretary pompeo testify in the senate. Will you . And part of me really wants to. Well do whatever the president wants us to do. If the senate decides to take live witnesses and the president directs us to do it, we will. If he directs us not to, we wont. Whatever he directs. And Congressional Republicans have relied on that defiance complaining in the house about the lack of fact witnesses and now pushing for a senate trial without any fact witnesses. And more than any other issue, democrats core demand for a trump trial boils down to something marvin gaye asked so long ago, can i get a witness or as the Rolling Stones put it, can i get a witness, or azeri yo put it in his 2016 song, can i get a witness . But one point here is clearly people ask for witnesses a lot. If you dont see trials without them, that may remind you this is a basic part of any fair trial. But tonight we want to dig into another piece of this which is for most of these Trump Officials testifying before congress as a witness, trial or not, is not only important for fact finding. It is a job requirement, literally. Take mike pompeo who sondland said was in the loop and who defied these probes. He is of course secretary of state. Like all people in both parties who have held this job, he has a constitutional duty to Face Congress as a witness even on matters far less important than this new trial to potentially remove the president from office. In fact we checked, pompeo himself testified at least six times already as secretary of state. Thank you, mr. Chairman. Thank you, senator menendez as well. I appreciate you having me here today. I look forward to our conversation. Thanks for the opportunity to discuss the administrations fy 2020 budget. I want to walk through two years of the administration. Im now nine days short of one year in my time. Thanks for the opportunity to be here. Im really happy to be. Happy to do it. He does this on the regular, testifying on routine matters like there the budget or oversight of national security. But then zero times, zero times, has he ever, as you see, testified about this ukraine impeachment scandal. What youre looking at on the screen are the inverted priorities of this trump state department. And democrats say what you are looking at is in that big zero circumstantial evidence of pompeo in on the cover up. And some of this may have gotten lost in all of the impeachment fighting. But congress is a coequal branch. Cabinet officials have a duty to testify. They could be forced to which is why so many Trump Officials have faced Congress Even as the president talks up defiance. And maybe it looks guilty for the administration to argue they can testify under oath on Everything Else but the conduct that got him impeached. Now, this fight, let me clear, is not over. The issue of these officials testimony will come up with the senate trial because the senators have the power to request witnesses right in the middle. In fact in the middle of the clinton trial there was the vote to have these three people come back again. Todays argument would be stronger for witnesses who never testified. Attorney general barr faced the press publicly denied he talked about anything relating to the bidens or his son. Call notes showed barr plenldge to help out. Why did you not want to do that . If youre talking about press reports that he asked me to have a news conference, fact is i dont remember any such request. I dont remember. Not a full denial. But if barr and giuliani can make partial denials on tv, theyve already waived any right to legal privilege on those topics and congress has the power to compel these statements under oath. Forces people under oath to get to the purpose with teeth. Theres then of course the other allegation that undid richard nixon. Democrats arguing the crime and cover up is continuing. Consider the reports of Rudy Giuliani flying back to ukraine pushing this same flight. This picture complemented by a new report accusing Rudy Giuliani returning from that trip on a pricey jet linked to a putin oligarch. So, take it all together and you can see the questions come into view. Why wont giuliani just say whos funding his work . Why were his clients indicted . Why wont barr give his impeachment denial under oath . Why wont pompeo testify six times but never once about the ukraine plot . While were at it, why doesnt the white house want witnesses to defend them . If you want to follow the facts, the questions circle back to the original question can i get a witness . Good day to both of you. Judge and professor, i would ask you first the importance of these witnesses in the context of those who are in the cabinet and have the duty to testify anyway. Well, first of all, the constitution doesnt say much about what this is supposed to look like. But it does use language that it does say that the impeachment is to be tried in the senate and elsewhere in the constitution we know what a trial is supposed to look like. And it says that the senators are supposed to take an oath above and beyond their oath to the constitution that they take when theyre elected. So, this is an oath of impartiality. But the precise rules are the rules that are determined by the senate. Im going beyond im just going to jump in to say beyond those rules there is a coequal branch power to make current officials testify thats even beneath that. Well, but theres no question about that. Theres no question that when someone like mulvaney says if the senate calls us as witnesses were going to wait to hear from the president , its extraordinary. Its one thing to talk about that in court. But to talk about that before the senate is itself extraordinary. The other thing, what i was trying to say was that there are actually four or five moderate senators who can determine what the rules of this proceeding would be if asked. And they could demand a fair proceeding and they could demand that these witnesses be called, people like mitt romney and collins, booker gardner, sorry, corey gardner. There are a number of people that could change the tenor of this. That goes to how this is going to work. Theres a snap judge out of washington focusing on mcconnell out of habit. As you say and people are starting to learn, unlike other things its whoever gets to 51. If a few of those folks say a single witness like what i just mentioned, attorney general barr making a sort of a vague denial. And then theres the fact that throughout recent history theres been a lot of pressure on the idea that people should testify before congress, that you dont want executive covering it up. Fox news analysts used to say that. Take a look. American survivors of the attacks of 911 of last year are being told by the feds to keep quiet. They havent provided the basics about benghazi. This is unacceptable. Accusations that the president s people are making threats p against benghazi witnesses. To get to the truth, youve got to have all the information. Judge. And thats different thats an ordinary investigation. This is in a constitutional trial. And the constitution talks about a trial. So, theres much more theres much greater rationale to have real witnesses come and testify. It has to be said that mcconnell does not control this process. This is a 51vote situation. Impeachment is 66 votes, but this is only 51. Let me bring in christopher. Welcome back from ukraine. Thank you for having me. You have a scoop that this has a linkage for giuliani that they arent otherwise putting out. What can you tell us . Well, regarding giuliani and his links in ukraine, i mean, you saw his trip over there where he made quite a wave or a splash in kyiv while keeping a relatively low profile. Myself and several other journalist were unable to track him down but we kept a close eye on his whereabouts. And i think what was most interesting for us was the people he was meeting and just whom hes connected to over there. A lot of the people that he is asking for evidence to back his Ukraine Campaign are pretty dodgey characters in ukraine. Anybody who spent as much time over there as myself can tell you that these are former prosecutors and former officials and current parliamentarians that do not have the best reputations. Many of them are connected to corruption themselves. Yeah, and youre putting it relatively measured. Put up some of the footage of him speaking to some of these folks. This meeting and all of this tough of the ukrainian prosecutors all for the purpose of dirtying up biden if he remains an opponent of trump, what does it tell you they were trying to hide the jet. Giuliani came in on a commercial airliner on this budget airline. That seemed to be sort of a way of staying above board. It was transparent in the sense that some of his colleagues did tell us reporters that they were coming in. But you know what it reminds me of . What . You know the rapper future, future hendriks. Sure. When he says you came in a car, you leave in a jet. The idea being that if you hang out with future you might get to be on a private jet. Although hes not accused of election meddling. What does it tell you that giuliani comes on cheap flight and leaves on a pricey jet. I think this is the big question. Just how giulianis campaign is being funded. And if you look at the characters that hes hanging around with in ukraine and the connections that this jet does show us that the owner of this jet is actually an american with ukrainian roots, alexander roof and hes here in new york. But hes tied closely with dmitry, this corrupt character. Thats what made your story interesting. I would love to keep an eye on your reporting and get you back in here whether youre in new york or kyiv. And judge gertner, thanks to you as well. What about other aspects of the plot . In the parallel probe in Southern District of new york where prosecutors already indicted two ukrainian linked clients of giuliani who is under investigation by the office he used to run. Thats an elite group of prosecutors who run the district like giuliani, comey, and bob fisk. Fisk started in the office in 1957 rising to serve as the sdny u. S. Attorney before giuliani when president ford appointed fisk in 1976, a time when new york was dangerous. Fiske led against organized crime against mobsters, one of the families, the gambino family, to nikkei barns until the sdny convicted him. His reputation led him to be sort of the bob mueller of his day. He was named independence counsel to the white water probe. Bob fiske is our exclusive guest. Thank you for being here. Glad to be here. When you ran that office, then as now, it deals with a lot of big stuff. When they are investigating something that ma i or may not relate to washington or get extra attention, how does that affect the case . How does it work . I think one of the great things about the office historically has been it has been totally apolitical. Prosecutorial decisions are made without regard to politics. And the hiring of the assistant u. S. Attorneys is done totally on the merits without regard to any political affiliation. So, basically we had a case. We just went out and did our job. Did it surprise you to see the current u. S. Attorney take on lawyers be it the president s lawyer who is controversial. Mr. Cohen is now incarcerated. Or a lawyer, michael avenue n avenue nat ty. It doesnt surprise me he would just do his job. A case comes along and it deserves to be investigated, hell do it. Ive got to ask you a question that you might think is basic or silly. Did you or any of your team ever get scared because to normal people when you look at the type of cases from national security, new york as a terror target, terrorists, mobsters, a lot of people would think that sounds like scary stuff to go after. I prosecuted as you indicated personally drug lord nicky barns, anthony scotto. I always felt that if people were sensible about it, there was no future in threatening or knocking off a prosecutor because youll just get another one and then youve got another problem on your hands besides the original charge. So, i comforted myself with that rationale for four years. Mr. Fiske, thats a very calm and even way to think about it. I would like to get into this. A lot of this is back in the news right now. You talk about rustle buff leno. Hes portrayed by joe pech pesci. I want you to meet my cousin. Theres a lot of tough guys around here. Youre not afraid of tough guys. Only two people in the world have one of these and only one of them is irish. I have one. Angelo has one. Now you have one. Its going to happen. Either way hes going. Did they get it right . We convicted him. Do you think these movies sometimes make mobsters look too cool and good . Yes. Yeah. Glamorize them. Nothing glamorous about what they were really doing. Right. Now, they glamorize them unnecessarily. And people watch this film, they have open questions about jimmy hoffa. Do you think there are still open questions there . Everybody does. But the film that leaves you with the distinct impression although the facts have never been fully established as lawyers would say that he was murdered by the mob. Thats certainly what everyone is assuming. What do you think . I dont have any personal knowledge. No, but you have a lot of experience. One other part i want to show you briefly, the irishman ends with the characters, there they are, like so many of these people, they end up old and in prison. I never wanted it to go that far. Never. I picked us over him. [ bleep ]. We see this sad portrayal of these men who had money, power, and other things. But ultimately their lives caught up with them. I wonder if you think its important that the public see and understand the consequences. Absolutely. Absolutely. And they do. And most of these guys, they wind up dead or in jail. Absolutely. And thats been the record in the Southern District ever since. I mean, lots of mob figures after i was there were prosecuted and went to jail as well. My final question for you is really big picture. Folks watching can see what a legal legend you are and the work youve done. There are a lot of people in the country who look at where america is and theyre concerned that the rules arent being applied or the rule of law is in danger. What do you say to them . What do you say to the people who might be the next generation of lawyers or might say its not worth even bothering. Oh, thats an easy question. I have enormous faith in the system, and i have an enormous faith in the u. S. Attorneys around the country that are doing their job. And i think theyre doing their job just as effectively now as they ever have. And i think the public should have great confidence in that. And you think whether its sdny or these other offices, theyre unbound. I think thats true of every other office that i know of. It wasnt just about politic. Drake has displaced the beatles with 28 billion music streams while Billie Eilish is one of the most popular artists of the year. The 18yearold newcomer wracking up 6 million streams. Which brings us to a special story tonight. An exclusive interview with artist yasiin bey. If i know your gene aelg or where youre from i know something about you and i cant pretend to know a person just because i know something about them or reduce them to a set of like scientific responses. And its ridiculous. I mean someones skin color, its like people with acne are bad people. Were human beings. You know, it seems like being a racist is really laborintensive and just kind of draining, you know what i mean . Draining . Yeah, not very rewarding. Dont see a lot of joyous racists you know what im saying . Lets go hate today. Theyre not very even when they have the tiki torches they dont seem they dont seem like theyre having a really good time. Thats the difference between if youre ever like at the hardware store. If someones getting like four tiki torches, thats a dinner party. But if you see them buying like 20 tiki torches thats like an antisemitic antiblack hate rally. Thats how you know. Its too many.
