An internal investigation has cleared a Des Moines Police shooting. Vanessa miller shot 28yearold ryan bolinger. Who was unarmed. When he charged her squad car. It all started with a traffic stop. Captured on video by a squad car dash camera. Police say bolinger was acting erratically. Then lead them on a pursuit on the Northwest Side of des moines. Bolinger eventually stopped. But police say he came at millers squad car. Miller opened fire from inside her vehicle. Shooting bolinger through the window. Des Moines Police chief dana wengert says millers actions were well within the departments use of force policy. How would a reasonable person react under those circumstances in that moment, not 20 minutes before or 20 minutes after but in that moment. That split second to make that decision. When you take all that into consideration, factor all that in and compare it to our policy, her actions do not violate our policy. The attorneys for ryan bolingers famiy have released this statement in reaction. The opinion of the Des Moines Police department on the matter is not a surprise to us. Only by verdict of a jury of the officers peers will justice truly be had. We have prudently taken this situation one step at a time, and we will continue to act reasonably as we move forward in our pursuit of justice. Officer miller has been cleared for duty but has decided to go on personal leave at this time. After two full days of deliberations there is still no verdict in the pete polson trial. Polson is charged with three counts of attempted murder as well as six other charges including weapons charges. After police say he in Pleasant Hill last november. Polson is using an intoxication defense and claims he doesnt remember what happened after a bad hit of meth. Today, the jury asked a couple of questions including an explanation on what intoxication means, if the jury needs to be unanimous on every count, and if attempted murder necessitates premeditation and motive. The judge told them to go back and re read the jury instructions and continue deliberations. The jury will deliberate until 4 30 today. A newton man is facing three counts of attempted murder after police say he tried to run over three people. Including a 5monthold child. Police arrested john britton just before 10 00 last night. They say he hit a man in the 600block of south third avenue east. And repeatedly struck a vehicle carrying the infant and a 50yearold woman. They were not injured. Police say britton told them he intended to quote. Kill them all. This weekend marked the 20th anniversary of a western iowa cold case. Involving the mysterious death of an unnamed his body was found inside a lake on october 17th, 1995. Tiffany lane has more on the continued effort to identify the baby. And bring him justice. Baby does life and death remains a mystery for the storm lake, iowa community. But law enforcers say they will not stop until they find answers. To leave that child alone in that closet, where he died, was a you talk about it or when we revisit the investigation and things like that, it just brings an overwhelming feeling of Public Safety director for storm lake, iowa. Lieutenant chris cole was one of the officers who found baby doe two Vista EstatesMobile Home Park. And as years continue to pass, his anticipation of getting justice for the infant is still just as strong. Su this is the Mobile Home Park where 20 years ago, officers came across something they would never have imagined. And even after all theyll never forget. I think theres always hope anyday somebody could come forward and provide information about what happened or someone may have a suspicion as to whos involved, said lt. Chris cole of the storm lake were hoping for. Cole and police chief mark prosser have been looking into the case since the beginning. They say they have had leads in the past, but none turned out to be hopeful and believe they will complete the investigation, they still reflect on the day of baby does funeral at the buena vista Memorial Park cemetery. It was just a sad, somber day small child, whos only family at the time were only people who were with him at the time were police and other community strangers to that child. A day which showed how one baby could bring a community together. Lt. Cole says he wants to solve this case before he retires. He says anonymous tips can be made any time to the Storm Lake Police department. An eastern iowa woman was found dead inside her burning home this morning. Waterloo firefighters found rebecca lavenz dead inside her home as they were putting out a fire this morning. Initial reports show the fire was accidental. But investigators havent found the exact cause. 22 iowans have died in fires so far this to climb around this time of year as home heating season begins. This morning governor branstad continued his statewide series of in boone. One of the first things the governor was quizzed on. The game of Musical Chairs that the Iowa National guard is playing. Last summer it was announced the black hawk helicopters would be moved from boone to the Des Moines International airport. The guard says something will replace those helicopters, but wont say what.
