A year long wusa9 investigation into repeat restaurant offenders is getting answers and acquisition tonight. Turns out d. C. Health is not action tonight. Turns out d. C. Health is not doing what it said it was going to do to address the problems. It took Investigative Reporter russ ptacek months to get an explanation and a few seconds to get some action. Im going to show you evidence of that action. Look at this. This is a Health DepartmentImminent Health Hazard placard, a Food Establishment closure notice, one of two sent sent out so far in response to the interview youre about to see prompted by the Health Departments claim they would put out a request to permanently close restaurants with repeat closure histories, a policy that we found doesnt exist at all. Russ ptacek, im with wusa9. A lot has changed since we first confronted d. C. s Health Department director Joshua Garcia in june. Your department refused to interview. Refused interviews about the departments policies for repe offenders like these d. C. Food establishments closed twice, three times, or even four times for health risks and allowed to reopen. The Health Departments director says the process should be transparent. Its very transparent. Reporter you havent been with me. Your agency has not been with me. I apologize on behalf of my agency. The buck stops with me. So anything that happened is my fault. So its corrected now. Reporter thats d. C. s Health Department director now after agreeing to sit down with us and finally answer our repeated inquiries about this claim from the agencys spokeswoman that when there are repeat offenders, yes, they are recommended to dcra, the department of consumer and regulatory affairs, not to renew their licenses. Theres no record of any time ever where youve requested that their licenses not be renewed. I think that was a confusion that we had probably internally. Reporter youre saying thats not true . Im not recommending right now shutting down anyone. Reporter so he says the agency is not recommending permanent closures. Instead focusing on educating restaurants about food safety to bring them into compliance with spot checks and special attention given to problem kitchens. We go on visits. The high risk people we visit more frequently. Reporter but our investigation found like repeat offenders like new big wong in chinatown and heritage india on pennsylvania avenue both cited for rodents Department Records show not one regular inspection since the week they were ordered closed months ago. After a place has been closed once, twice, three times it seems to me if youre not going to put in a request that their license be permanently revoked, that youd be going there pretty soon after that closure. We will change the protocols here. I think its a great idea. This is what i would recommend. Within 90 days after a repeat offender has been inspected just go and review them again. Reporter youre thinking about changing policy right now. Yeah. Reporter you just y eah. Reporter not only did he change policy in the middle of our interview, a few days later thats him in the field with inspectors. The agency closed two repeat offenders, one at union station, making a third closure for victoria pizza cited with failing to minimize the presence of insects, rodents and other pests on the premises and now for the fourth closure suspending heritage india and its sister restaurant on p street northwest. You may remember this from what i found in the alley behind it last summer. That was after back to back closures at heritage india citing gross unsanitary conditions and rat droppings in the kitchen. After dr. Garcias visit the sign in front said closed for mechanical problems. Heritage indias fourth official closure cited it and cafe mirakol with operating food which may endanger the Public Health. That photo of dr. Garcia taken here on 17th and p, look at this ledge over here while weve been here in the half hour setting up, weve seen three rats crawl along that ledge. So they are fighting an issue in this neighborhood. As far as when theyll reopen, theyve been now closed five days, which is really long for Health Department closure and so far no word on when theyll reopen. So i got to make this clear. You had no idea he was going to change policy midinterview, so how is this new policy going to work . Reporter that was a surprise to us and the way in fact, i just asked him about that the other day and they are still hammering out the exactness of the policy, but this closure is evidence they are going back and in a nutshell their plan is to return to these places within 90 days of them reopening to make a surprise visit and obviously the surprise visits here didnt turn out too well. They found problems that they felt put the Public Health in risk. Russ ptacek reporting live for us from the district, thank you. Commuters already know very well traffic on i66 in virginia can drive you crazy on a good day and today was not a very good day on that highway out in centreville where the temporary white stripe traffic lanes that had been laid down on the interstate last week to divert traffic around the Road Construction just started peeling up off the road about 1 4 miles worth during the morning rush. Look at that. It is just incredible. Ive never seen anything like that. We cant afford to have any kind of confusion on the roads. Those lines there are to guide you safely through the area. So if anybody is confused about which lane they were supposed to be in, not good. No, it was not good. Needless to say, in fact, it was a bit of a traffic mess, but tonight as you can see vdot crews were back at work with a fix we hope will be all in place in time for your morning commute. Vdot meantime says were really sorry about that. If that didnt drive you crazy, i bet gas prices are. The American Academy of pediatrics is saying high schools should start later in the morning. They point to a lack of sleep leads to poor health, depression, poor grades, even car accident theres a solid body of research which now shows that delaying School Start Times at both the middle and High School Level reverses a lot of the negative consequences. The academy says adolescents and teenagers need about 8 1 2 to 9 1 2 hours of sleep per day, but most obviously dont get that. Theyd like middle schools and high schools to start the day no later than 8 30 in the morning. Right now that only happens at 15 of high schools. Students in Montgomery County start class at 7 19 of morning and today the School District superintendent told us he wishes students could start later, but thats not something officials could make happen, at least not right now. Unfortunately the cost is prohibitive for us at this time. We cant afford us. The board asked us to look at it, see if we could do it a little cheaper. The goal is to make the change for under 10 million. In the meantime set your alarm clocks. A 13yearold boy sadly one of several people still in the hospital tonight because of that magnitude 6 earthquake in california over the weekend. Theyve got to mop up bottles and barrels that broke and spilled. Cristobal is now a hurricane out in the caribbean and topper is tracking where its headed. The good news, its a fish storm as we call it. I tweeted about this. If youre a fish, youre in trouble. If youre on land, youre okay. Its the same track essentially bertha went. Its still a minimal strength hurricane, 75 miles per hour, only the third hurricane this year. Where is it going . To the north and eventually north and east and by tomorrow afternoon still maybe a category 1. At 1 time the nash Hurricane Center had it weakening to national Hurricane Center had it weakening to a tropical storm. Wednesday night it will continue to go off in the shipping lane, so again never becomes a strong storm and will not affect us except for strong surf and maybe rip currents. How many hurricanes form on average per month . 4 in june, 6 in july, 29 , though, do form in august. September is the big month statistically, 36 form and even october not bad, 19 of all hurricanes form in october. Its been a slow year. We still have a lot of months to go. Lets start with a live look outside, our live michael and son weather cam, 76 downtown, relative humidity comfortable at 58 , winds pretty much dead calm. Winds are not a factor the next few days. Cold front goes through wednesday, knocks temps down to 85, so not as hot, not humid, great looking day thursday. Next seven days we might make it through the week without any showers. Friday were near 90, isolated shower possible saturday. Were pretty toasty and then sunday a better chance for showers and now labor day should be clear with temperatures back in the mid80s. Its kind of our last summer weekend. So i like it warm. I do, too. Labor day weekend should be the final big hurrah. The nse did look good this weekend, but its taking a hit tonight, redskins players res now wusa9 game on sports with Kristen Berset brought to you by xfinity. The Washington Redskins defense is praised for their performance saturday night against the baltimore ravens. They stuck with the running game and today its making news for the wrong reasons. The nfl suspended safety Brandon Meriweather the first two games of the season after a penalized hit on ravens receiver torrey smith, his sixth violation of the rule. After game meriweather seemed quite frustrated telling the media hes been working on avoiding these types of penalties. After going through this offseason and working on the things that i need to work on and the first chance i get, the first test i get, it seems like i failed. I thought he tried in his best interest, he tried his best to lower his target and avoid the helmet to helmet contact, but sometimes when youre lower and the receiver lowers at exactly the same time, its very difficult. Meriweathers punishment has been criticized especially by his teammates. Angelo hall tweeted fair is fair. I cant speak on meriweathers past hits, but from what i saw that hit was not malicious. Chris baker tweeted what else was Brandon Meriweather supposed to do. He lowered his target, still gets suspended for a good hit. Well see how the appeal goes. Meriweather is also responsible for knocking running back Bernard Pierce out of saturdays game. Pierce has been diagnosed with a mild concussion but expected to be ready for week one.
