We begin with new information about a man who tested positive for hiv who is then accused of having unprotected sex with women. Im derek mcginty. Im jan jeffcoat. He met those women in the bethesda area. 28yearold Daniel Cleaves is in jail, but earlier today his bond was reduced from 75,000 to 5,000. He is expected to be released from jail tonight. Kristin fisher spoke to his attorney and to an attorney for one of his accusers and joins us live now. What you to learn . Reporter were still waiting for cleaves to be released, but its already been approved by a judge. His attorney told me tonight that his parents are nearby waiting for him and that once hes released they will pick him up and drive him to their home in richmond which is where he will be held placed under house arrest pending trial. Lets make no mistake. This is not the outcome prosecutors had hoped for, especially since theyre now very worried more victims could be out there. Today in Court Prosecutors called 28yearold Daniel Cleaves a serial offender and danger to the community. Our prosecutor in court did argue this is a Public Safety threat. It is rather shocking in this day in age that an individual would knowingly transfer hiv to their sex partners. Reporter cleaves is accused of having up protected sex with at least two women while allegedly knowing that he was hiv positive, but his attorney told me his client plans to plead not guilty because hes an alcoholic who was drunk during those sexual encounters. Even though one of those encounters took place over the course of three days. As long as we can keep the alcoholism in check, which hes doing, hes going to be perfectly safe. Reporter the attorney for the 2nd victim declined to comment tonight about the release except to say this. Her primary concern at this point is her health and anything else at this point is secondary, but shes putting her faith in the system and believes that the system will play out the way its supposed to. Reporter today in Court Prosecutors said theyre worried cleaves may have exposed other women to the virus. In fact, a similar investigation is already underway in virginia. If there are any other victims out there that have made contact, my client obviously would like them to do the brave thing and come forward. Reporter are you concerned of other victims coming forward . I think with the amount of Media Coverage this case has gotten i think that is always a potential. I worry about. Reporter even his own attorney is worried more women will come forward. About as for the two women that have done as for the two women that have done, so an attorney for the second woman told me she tested negative for the virus, but it will be several months before they know for certains. As for the first victim, her for certain. As for the first victim, her condition is still unknown. Tonight new Jersey Governor Chris Christie defending his position to protect the people of his state with new strict guidelines for anyone traveling to new jersey who had contact with ebola patients in west africa. A nurse returning from sierra leone friday became the first person to experience those new rules in jersey. Kaci hickok was threatening to sue for her release. She need to understand that the obligation of elected officials is to protect the Public Health of all the people and if that inconvenienced her for a period of time, thats what we need to do to protect the public, thats what we will continue to do. Theres been no reversal or change in any way to our approach. People are symptomatically going to the hospital. If they live in new jersey, they get quarantined at home. If they dont, we subquarantine for them out of state. When hickok landed at the airport friday, she had a temperature of 101 degrees which is a symptom of the ebola virus and she had just treated ebola patients. Reporter new tonight the cdc guidelines for monitoring healthcare workers who have traveled from west africa are less restrictive than quarantines states have put in place. The guidelines call for medical workers at high risk to isolate themselves. Lower risk Healthcare Professionals would report their temperatures to local healthcare officials to see if symptoms develop. It comes after the nurse had objected to her treatment as if she were a prisoner she said. Her service and commitment to this cause is something that should be honored and respected and i dont think we do that by making her live in a tent or two or three days. Attorney scott oswald said it could put new jersey in jeopardy for a lawsuit from the nurse who has threatened legal action. We dont have a Public Health emergency declared and until that happens the state is on very dangerous territory here and detaining people without really probable cause. University of maryland medical system said in a statement the individual identified a symptom of concern and called for assistance. Safe transport was arranged and the patient is being evaluated in an isolation room at the hospital. The initial evaluation is suggestive of a diagnosis other than ebola infection. As part of the ongoing evaluation of this patient, the Public Health laboratory is performing an ebola test. They expect an update by tomorrow morning. Of course, wusa9 will stay on this story overnight and tomorrow morning starting at 4 25. Today the governors of maryland and virginia announced their own stepped up ebola guidelines. They plan to monitor travelers coming in from guinea, liberia and sierra leone and threaten to quarantine them if they of are if they refuse to comply. The governors say theyre taking these steps to keep people safe including having travelers sign an agreement to a 21 day monitoring plan with the local Health Department. We think it is the appropriate route based on the science, the facts. The chances of needing to invoke an involuntary order are limited, but we will do that if we need to. Today the cdc broke down the people that risk getting ebola into four categories. Those with the highest risk have had direct contact with an ebola patients body fluids. The cdc recommended restrictions on travel or going to big public gatherings for those folks. Doctors are urging people to get flu vaccines during the current ebola scare hoping fewer people with flulike symptoms will reduce confusion and fear, but that might not be so easy. The cdc confirmed there are delays in shipping the flu vaccine and the overall supply is behind 10 million doses for this time of year. Officials are reassuring the public this is not a shortage, just a delay in shipment. A case of viral meningitis at a d. C. Elementary school. Parents of students at peabody primary campus received a letter today. A teacher tested positive. The viral form of meningitis is serious but rarely deadly. The man charged with abducting uva student Hannah Graham will not be coming to fairfax later this week after all for a court hearing. The violation goes back to 2011 repeatedly citing potentially hazardous food improper hygiene and warned again and again failure to comply may result in your license being suspended or revoked and ultimately the Health Department did revoke their license. He acknowledged receiving repeat warnings his license could be suspended or revoked, but he faulted the Health Department for not calling for more specific changes prior to ordering him closed.
