Amtrak paid out big bucks in civil judgments but the philly District Attorneys Office declined to file criminal charges. Citing a lack of evidence. Legal maneuvering by attorneys representing the family of a crash victim led to the state attorney general filing charges. But the case was challenging from the start. Federal crash investigators ruled bostian was not drunk or high or playing with his mobile phone at the time of the crash. They believe he may have have been distracted by reports of vandals throwing rocks at septa trains nearby. Look closely at this map from the ntsb hearings in may have last year. Bostian had the train going 106 in a 50 miles an hour zone approaching the curve. But if he thought he was farther along the tracks, beyond the curve as investigators believe, his speed would have been completely appropriate in what was a 110 miles an hour zone. Still plaintiffs Attorney Tom Kline said the families he represents will be saddened and disappointed by the judges ruling. It was by definition reckle recklessness and reckless disregard of human safety and reckless disregard of human safety does rise to the level of a crime. This is going to be frustrating event. Its going take some time to allow people back into their homes particularly in the florida keys. Jacksonville, florida, meanwhile also realing after irma triggered historic flooding there monday. Power outages. Lots of trees down in our area. And this is going to be an ongoing event. I just cant let her just jump straight to the ground. Reporter warren says they both fell to the ground. But he helped break the womans fall and dragged her to safety. Little did this hero neighbor know the womans husband had just gone back in to the house to save his wife of some 30 years. If hed have waited 30 seconds hed have seen her coming out on the roof and me and him both would have been catching her instead of me catching her and him dying inside. The suit claims young women at Strawberry Mansion played the same schools over and over again and were denied support. Games canceled. Buses canceled. Um, playing the same teams over and over again which i then deemed the negro league based upon only playing girls of color. Reporter smith who runs a league for la teen known africanamerican girls Playing Field hockey and lacrosse says, she was fired when she complained to the district. A source with knowledge of the situation tells fox 29 smith contract was simply not renewed. In a statement the district writes one of our core values is a School District is increas ing tune in the classroom and on the Playing Field for all our students regardless of race or gender. Lawyers also claim mc gray lost out on a chance to play lacrosse at the university of hartford in connecticut on a full ride because the district failed to provide documents to the university. It made me feel that like we werent good enough to play lacrosse because we were discouraged so many times from not playing and like not being noticed for like the Great Potential that we have. How about 79 with that filtered sunshine in wrightstown. The ocean water temperature 72. As we look at the remnants of irma those out bands lifting toward the north and the east. Its going to take some time to moisten up the atmosphere. We have dew points right now because the air is so dry in the 40s and the 50s but those dew points will be increasing. Look at right here millville at 61. 60 tends to be muggy when you get towards 70 thats when its uncomfortable and that humidity is going to go in that uncomfortable range tomorrow afternoon and thursday afternoon as that air gets really moist and tropical from irma. As we go hour by hour in the fox future cast you can see the clouds rolling on in. Then by tomorrow morning, some pockets of rain especially to the north and west of philadelphia during that morning rush. By the evening, a few more showers. You can see that southerly wind lifting in with the warmth and the humidity. By thursday, some showers moving through here or there. Then possibly additional rain thursday night when the core of the remnants an front move through. Friday is actually looking better. So for wednesday and thursday into early friday, about a quarter of an inch to half an inch of rain locally higher amounts up to an inch.
