Bombay HC directs Palghar Police to stay probe against Indiabulls Housing Finance

Synopsis The mortgage lender had approached the court after a company shareholder approached the local police station in the Palghar District alleging siphoning of funds and sought the lower court’s intervention to direct the police to investigate the matter. ANI IHFL moved the high court to challenge the lower court’s order and sought quashing of the FIR against the company. In a relief for the Indiabulls Housing Finance Ltd (IHFL), the Bombay High Court has stayed an investigation against the company by the Palghar police until the case is heard. The Court in its order, while staying the probe by local police observed that the complaint on which the case was filed “appeared to be malafide and deficient”.

Bombay HC stays investigation under FIR against Indiabulls Housing

A Division Bench of the Bombay High Court on Tuesday stayed all investigations by the Palghar police regarding a first information report against Indiabulls Housing Finance (IBHL) for allegedly siphoning off funds and for accounting irregularities. In its order, the court cast serious doubts on the bonafides of the complainant Ashutosh Kamble, a shareholder of the company. IBHL had approached the court and the petition was taken up for urgent hearing. The court noted that the Supreme Court has laid down that “interference at the stage of investigation can be justified only in exceptional cases …” Noting the malafide intent of the complainant, the court said it is prima facie of the opinion that the complaint “appears to be malafide and deficient”.

Police book Indiabulls promoters, directors; firm moves court to quash FIR

The Maharashtra Police has booked Indiabulls group companies, including its flagship Indiabulls Housing Finance (IBHL), for allegedly siphoning off funds and for accounting irregularities committed by the promoters and directors of the company between 2014 and 2020. A first information report was registered by the Palghar police on April 13 under various sections of Indian Penal Code dealing with cheating, fraud and criminal conspiracy. The move comes after Palghar’s judicial magistrate passed an order under Section 156 (3) of the Code of Criminal Procedure (power to direct police/agency to investigate the matter), following a complaint filed by Ashutosh Kamble, a shareholder of IBHL.
