Edgartown’s shellfish constable, Paul Bagnall came before Edgartown District Court Judge Benjamin Barnes remotely Friday morning for a pretrial conference on a charge of property defacement.  Bagnall is accused of using a town vehicle to tear up a lawn. Bagnall’s attorney, Martin (“Skip”) Tomassian, told the court he “just came into possession of some exculpatory evidence” in the case. He did not articulate what the evidence was. Bagnall pleaded not guilty to the defacement charge at his Dec. 31 arraignment. This followed a Dec. 9 probable cause finding at a clerk magistrate’s hearing. Updated  Edgartown District Court Judge Benjamin Barnes will allow the commonwealth to access the medical records of Zachary Dupon on the night of a crash that resulted in the death of 22-year-old Oak Bluffs resident Emma Hall. Barnes also allowed a separate motion for access to a set of five medical and EMT records of two passengers who were injured in Hall’s vehicle. Barnes originally took the issue under advisement, but made the ruling on Monday.

Film and television stuntwoman Kim Washington Longino, a.k.a. Kym Washington Longino, came before Edgartown District Court Judge Benjamin Barnes via Zoom Monday for a motion hearing seeking to suppress evidence in her ongoing drinking and driving case.  Longino was charged with driving under the influence of alcohol following a Tisbury Police stop on July 24. She was subsequently charged with operating on a suspended license after allegedly being observed at the wheel of a vehicle by a Tisbury Police officer on August 25. Dupon changes lawyers - The Martha s Vineyard Times

The Martha s Vineyard Times Zachary Dupon has changed lawyers. screenshot For reasons that weren’t described in court, Zachary Dupon has switched to a new attorney. Dupon, the 25-year-old Oak Bluffs man charged with motor vehicle homicide by reckless operation in the head-on collision death of Emma Hall, was initially represented by Vineyard Haven attorney Casey Dobel.  On Thursday, Jan. 14, Dupon’s new attorney, Rachel Self, came before Edgartown District Court Judge Benjamin Barnes remotely on behalf of her client. Dupon was also present via a link to the Dukes County Jail.  Self, an Edgartown immigration and trial lawyer, was featured in The Times in June regarding medical passage woes she and her partner had with the Steamship Authority. Last Thursday, Judge Barnes entertained a brief discussion of motions Self filed, and set the next date court for Jan. 25. Self requested Dupon be present in the courtroom.

Judge Barnes asked Palazzolo if restitution would close the case.  “If the defendant is able to raise restitution to make both victims whole, we’d certainly enter that as a plea, otherwise it would likely be a jury trial [where] we’re asking for jail time,” Palazzolo said.
