SEATTLE , Apr 7 2021 (IPS) - “A crime against humanity” and “a disgrace to our great country”: that’s how 99-year-old Benjamin Ferencz, the last surviving prosecutor of the Nazis at the Nuremberg war-crimes trials, characterized the Donald Trump administration’s coercive separation of thousands of immigrant children from parents seeking asylum. Former U.N. High Commissioner for Human Rights Zeid Ra’ad Al Hussein cited a statement by the American Association of Pediatrics that the family-separation policy was a form of “government-sanctioned child abuse” which could cause “irreparable harm” with “lifelong consequences”. He added: “The thought that any State would seek to deter parents by inflicting such abuse on children is unconscionable.”

Pakistan: No defence acceptable for crime of torture says…

15 March 2021 Lahore: The World Organisation Against Torture (OMCT) and Justice Project Pakistan released a joint report titled “Criminalising Torture in Pakistan: The need for an effective legal framework.” Published a day after a teenager was reported to have died in police custody in Peshawar, the report sheds light on the lack of appropriate legislation against torture in Pakistan. “Torture by police is rampant in Pakistan », said former senator and Pakistan Peoples Party senior leader Farhatullah Babar at the online panel discussion organized for the launch of the report. “Nothing can be accepted as a defence for this crime.” As a party to international treaties, Pakistan has an obligation to criminalize torture. However, attempts to do so have historically failed. A bill tabled by Senator Sherry Rehman is currently pending in the Senate. If passed, it would make torture by law enforcement agencies a crime for the first time in Pakistan. But first, it needs to

Solitary confinement replaced by new system where 1 in 10 prisoners experience torture

In November 2019, structured intervention units (SIUs) officially replaced solitary confinement in Canada. Prior to SIUs, solitary confinement operated through administrative segregation and disciplinary segregation. The new system claimed to add safeguards, mental health supports and provide prisoners with four hours outside their cells per day, including two hours of meaningful interaction. Despite being in place for over a year, recent data shows this system is a failure: one in 10 prisoners in SIUs experience torture. It is crucial for corrections to respond to this human rights failure. As a socio-legal scholar and a critical policy analyst who studies carceral policy, we believe possible solutions include reducing the number of people confined in SIUs, hard caps on days permitted in SIUs, penalties and oversight. Our goal is to push for institutional accountability and transparency, which has long evaded corrections.
