U S Appeals Court Hands Cuomo Second Defeat Over Church Gatherings

U.S. Appeals Court Hands Cuomo Second Defeat Over Church Gatherings   Andrew Cuomo received his second defeat regarding his arbitrary rules limiting church gatherings. The 2nd U.S. Court of Appeals, in a 3-0 ruling, put the kibosh on Cuomo’s religious gathering dictates. “The governor limited attendance to the lesser of 10 people or 25% capacity in “red” zones where the coronavirus risk was highest, and 25 people or 33% capacity in slightly less risky “orange” zones, even in buildings that seat hundreds. Circuit Judge Michael Park said the plaintiffs established irreparable harm by showing the restrictions impaired their free exercise of religion.

United States Supreme Court Passes on Review of FCA Dismissal from Fifth Circuit Involving Alleged Medicare Overbilling | King & Spalding

To embed, copy and paste the code into your website or blog: On December 7, 2020, the United States Supreme Court declined review of the U.S. Court of Appeals for the Fifth Circuit’s affirmation to dismiss a $61.8 million False Claims Act case alleging Medicare overbilling against a Texas hospital system. The lawsuit, initially brought by relator Integra Med Analytics (Integra) against Baylor Scott & White Health (Baylor), alleged that Baylor engaged in a scheme to overbill Medicare by fraudulently increasing the use of certain “secondary” diagnosis codes for complications and comorbidities, which result in higher Medicare reimbursement on the claim. The Supreme Court’s decision not to undertake review of the Fifth Circuit’s decision signals that the nation’s highest court has no aims to alter the legal landscape of the False Claims Act’s pleading standard at this time.

Cuomo s policy permitted to the lesser of 10 people or 25% capacity in zones where COVID-19 risk was the highest and 25 people or 33% capacity in the less risky zones.

Michigan Supreme Court refuses to hear case challenging mailed absentee ballot applications

Michigan Supreme Court refuses to hear case challenging mailed absentee ballot applications Print this article The Michigan Supreme Court rejected a Wayne County resident s bid to revisit the certified electoral outcome of the 2020 presidential election. Robert Davis, a Detroit-area activist who previously sued former Gov. Rick Snyder, claimed Michigan Secretary of State Joyce Benson exceeded her legal purview by mailing absentee ballot applications to all residents. In a 6-1 ruling handed down on Tuesday, the court disagreed, stating that most of the judges were not persuaded that the questions presented should be reviewed by this Court. The initial challenge was filed in June when Davis asked the Court of Claims to issue a preliminary injunction that would have ceased the mailings. Davis lost in two separate rulings where several judges found the secretary of state was vested with the power to mail out applications.
