The complaint is filed in Federal District Court in Akron. No trial date has been set.
Margaret Montgomery of Wooster filed the Fair Labor Standards Act and state Minimum Fair Wage Standards Act complaint on behalf of herself and all others in a similar situation, according to court documents, and seeks damages, which include back overtime pay, from Homes County Sheriff Timothy W. Zimmerly.
Montgomery submitted her notice of resignation to the Sheriff s Office in early September.
Zimmerly said he didn t have any complaints from Montgomery while she was employed, and there were no complaints filed with the union. I will say she was always here way before her shift started, sometimes as much as 30 minutes early, Zimmerly said. In our view, there was never an issue. Then, all of a sudden, she quits and files a lawsuit in federal court.
