THE legal team representing Norma Mngoma has suggested that since the Gauteng North High Court has pronounced her arrest and detention unlawful, criminal charges against her should also be dropped by the Pretoria Magistrates Court. Former minister Malusi Gigaba’s wife made a brief appearance on Friday, 12 February, following the High Court judgement on Thursday that declared her arrest unlawful. Mngoma was arrested by the Hawks last July, and had her electronic devices confiscated and later given back after some data was deleted.

NORMA S FIRST ROUND VICTORY By Kgomotso Medupe THE Gauteng North High Court has set-aside and declared the arrest of Norma Mngoma unlawful. The judgment was delivered by Judge Cassim Sardiwalla in her absence, yesterday in Tshwane. Norma, the estranged wife of former minister Malusi Gigaba, approached the High Court last year after she was arrested by the Hawks in July for allegedly damaging a luxury car belonging to Gigaba’s friend. It was later revealed that her husband was the one who laid the charges against her. She was charged with malicious damage to property and crimen injuria. Mngoma argued in court that her arrest was a scheme to intimidate and bully her, and get illegal access to her computers and phones.

In a statement, the Council of Education said it agreed that the matric class of 2020 had been confronted by many challenges brought by the COVID-19 pandemic and it would be unfair to subject them to further uncertainties. Mhlanga said the re-write was to protect the credibility of the national senior certificate. “Remember, we do not certify our results; Umalusi (examinations quality assurer) does that. If we do not proceed now with the exam, then in January Umalusi says they are not going to sign off the results because they were tainted and then the children would have to re-write them next year.” The department came to the decision following preliminary report findings that the viral spread of information on the cyber networks made it impossible to accurately identify the number of learners that had access to the leaked question papers.
