After a number of minor delays due to the holiday period and the required sourcing of available candidates with the agreed profile, the International Centre for Settlement of Investment Disputes (ICSID) has provided a final list of candidates for the third and final arbitrator to chair the Tribunal.
With this list complete, the parties will indicate their preferences and ICSID will then make the final decision as to the third arbitrator within the next few weeks. Please note that Lupaka and the Republic of Peru have previously appointed their respective arbitrators. Once the chair is appointed, the Tribunal’s initial steps will be to organize the procedural rules and calendar for the remainder of the proceedings.

German energy company RWE is demanding damages from the Dutch state because of plans to phase out the use of coal in electricity generation, junior economic affairs minister Bas van ‘t Wout told MPs in a briefing on Thursday.
The Netherlands disagrees and has referred the case to the International Centre for Settlement of Investment Disputes (ICSID) in Washington, Van ‘t Wout said.
The cabinet has given energy companies enough time to make the switch, the junior minister said. Nor, he said, does RWE properly support the €1.4bn damages claim.
RWE owns a coal-fired power station in the Eeenshaven in Groningen, having entered the Dutch market in 2009 with the purchase of energy company Essent. In total, the Netherlands still has three coal-fired power stations in operation.

FRANKFURT, Feb 4 (Reuters) - RWE has filed a lawsuit to seek compensation from the Dutch government for the planned shutdown of a coal-fired power plant in the Netherlands as part of the country’s phase-out of the fuel.
RWE, Germany’s largest power producer, said its 1.56 gigawatt Eemshaven plant, which cost more than 3 billion euros ($3.6 billion) to build and has been in operation since 2015, would be affected by the Dutch phase-out plans from 2030.
“Unlike the German coal exit law the Dutch law does not envisage adequate compensation for this interference with the companies’ ownership,” RWE said. “We view this as unlawful.”

The Supreme Court has sided the cassation appeal of Tedis Ukraine against the Antimonopoly Committee of Ukraine and invalidated the earlier decision of the committee to impose a fine of UAH 3.4 billion on the tobacco distributor. Today the Supreme Court put an end to the dispute between Tedis Ukraine and the Antimonopoly Committee of Ukraine, which accused the company of allegedly committing anti-competitive concerted actions and imposed a fine of UAH 3.4 billion. This decision is final and not subject to appeal, the company said in a press-release on Tuesday.
