EFF is standing with a huge coalition of organizations to urge Congress to oppose the Online Content Policy Modernization Act (OCPMA, S. 4632). Introduced by Sen. Lindsey Graham (R-SC), the OCPMA is yet another of this year’s flood of misguided attacks on Internet speech (read bill [pdf]). The bill would make it harder for online platforms to take common-sense moderation measures like removing spam or correcting disinformation, including disinformation about the upcoming election. But it doesn’t stop there: the bill would also upend longstanding balances in copyright law, subjecting ordinary Internet users to up to $30,000 in fines for everyday activities like sharing photos and writing online, without even the benefit of a judge and jury.

Although they were easy to miss in the end of year kerfuffle, serveral new copyright bill and proposals were not only announced, but in some cases have already gone into law. Here, here we answer some questions about what the copyright landscape will look like moving into 2021.
In all the madness that made up the last month of 2020, a number of copyright bills and proposals popped up some even became law before most people had any chance to review them. So now that the dust has settled a little and we have some better idea what the landscape is going to look like, it is time to answer a few frequently asked questions.
What is the CASE Act?
The Copyright Alternative in Small-Claims Enforcement Act (CASE Act) was included as part of a omnibus spending and COVID-19 relief bill in December 2020, which was passed by Congress on December 21, 2020. It establishes a voluntary small-claims board within the copyright office to give copyright owners an alternative method to resolve claims for all categories of copyrighted work.
Who Serves on the CASE Claims Board?
Under the act, three full-time copyright claims officers will serve on the copyright claims board and no fewer than two full-time copyright claims attorneys will assist in the administration of the board. The copyright claims officers must have substantial experience in the evaluation, litigation or adjudication of copyright-infringement claims and have represented or presided over a diversity of copyright interests, including those of both owners and users of copyrighted works.

What Happened?
In December 2020, Congress was rushing to pass a massive spending bill and coronavirus relief package. This was “must-pass” legislation, in the sense that if it didn’t pass there would be no money to do things like fund the government. Passing the package was further complicated by a couple of threats from President Trump to veto the bill unless certain things were in it.
