The Fifth Circuit Court of Appeals imposed sanctions against Perkins Coie partner Marc Elias and other attorneys representing Democrats in a case where they challenged a Texas election law going into the 2020 elections.
The case centers on a state law barring straight ticket voting, a practice that had allowed voters to automatically vote for every member of a particular party who is on the ballot by marking a single box instead of voting for each one individually. On Feb. 10, Elias and other attorneys filed a motion to supplement the record in the case, without mentioning that they had already filed what the court called a nearly identical motion in September 2020 that had been denied.

A federal appeals court has sanctioned Perkins Coie attorneys who represent Democratic groups for a “redundant and misleading” motion in election litigation.
The 5th U.S. Circuit Court of Appeals at New Orleans imposed the sanctions on lawyer Marc Elias and his legal team in a March 11 order, report Law360, Bloomberg Law and Law.com. A March 12 press release is here.
The court imposed the sanctions in a case in which Perkins Coie lawyers argued that the elimination of straight-ticket voting in Texas disproportionately affected minorities.
Top Democratic Party Election Lawyer Sanctioned by Judge
One of the Democratic Party’s top lawyers, Marc Elias, has been sanctioned by a federal court for an ethics violation and for submitting a “redundant and misleading” filing.
Marc Elias, an attorney for Perkins Coie LLP who was involved in election-related lawsuits during the 2020 elections, was punished and criticized by the U.S. Court of Appeals for the 5th Circuit on March 11. Several of his colleagues also were admonished.
“Appellees did not notify the court that their latest motion to supplement the record filed on February 10, 2021 was nearly identical to the motion to supplement the record filed several months ago by the same attorneys, on September 29, 2020. Critically, Appellees likewise failed to notify the court that their previous and nearly identical motion was denied,” Judge Edith Clement and Judge Jennifer Elrod ruled (pdf).
