The Kansas Court of Appeals ruled in July that it was “obligated” to reverse a Eudora man’s murder conviction and vacate a nearly 19-year prison sentence because his trial started three days late. But on Tuesday, the Douglas County district attorney’s office will ask the Kansas Supreme Court to reverse that decision and keep Danny W. Queen, 39, behind bars. The state also says the circumstances of the case are unlike any before it, making it “ripe” for the court’s consideration.

Brandon Jimenez, pictured in September 2020 An Overland Park man was sentenced to 67 months in prison Friday for a December 2019 shooting that injured a teenage boy in Lawrence. Lawrence police told the Journal-World at the time that Lawrence Memorial Hospital staff had reported that the boy came to the emergency room with a gunshot wound in the early morning of Dec. 9, 2019. The boy was treated for a minor injury and was released from the hospital, a department spokesperson said. Brandon R. Jimenez, 34, pleaded no contest to three charges in connection with the shooting. He was convicted of attempted aggravated battery, attempted robbery and aggravated assault with a deadly weapon in October. All three are less severe felonies than his initial charges, attempted second-degree murder, conspiracy to commit aggravated robbery and attempted aggravated robbery.

Myrtle Creek man pleads guilty to manslaughter after July DUII crash

A Myrtle Creek man entered a guilty plea Tuesday to charges of second-degree manslaughter and DUII stemming from a fatal car accident which occurred July 10 in southeast Roseburg. Michael Wayne McCollum, 21, entered his plea before Douglas County District Court Judge George W. Ambrosini and was sentenced on the manslaughter and DUII charges, while a charge of reckless driving was dismissed. The guilty plea comes just two days before McCollum was set to stand trial. The charges stemmed from the July wreck which killed 25-year-old Jacob Bickell, also of Myrtle Creek. According to the police report, the accident happened after 2 a.m. near Southeast Pine Street. Bickell was declared deceased at the scene. McCollum was transported by air ambulance to Peace Health Sacred Heart Medical Center at Riverbend, where at the time he was reportedly in critical condition.

A judge bound a Lawrence man over for trial in a rape case Wednesday in Douglas County District Court, following testimony from a witness and the woman he is accused of raping. Andrew E. Ferguson, 22, was charged last December with rape of a victim who was unconscious or physically powerless. Ferguson faced an alternative charge of rape of a victim who was incapable of consenting because of the effects of drugs or alcohol. Both are severe, level-1 felonies.
