Protecting Wider U S Interests after a Troop Withdrawal

May 26, 2021 The Biden administration is committed to withdrawing all remaining U.S. armed forces and contractors from Afghanistan by September 11, 2021, a process that began in late April. Many Democrats and Republicans have praised the move for “ending” the 20-year war in Afghanistan. But the removal of personnel only signals that the United States is taking its military options off the table, the best source of leverage in the peace process; this action will not bring about an end to Afghanistan’s ongoing violence or the involvement of other states in the conflict. In fact, violence is escalating, and U.S. interests are still at play. A mismanaged withdrawal risks a return to civil war, the empowerment of terrorist groups, a renewed refugee crisis, and severe political consequences for the United States. Without ongoing international support to the Afghan security forces, other terrorist groups, neighboring states such as Pakistan and Iran, and emerging citizen self-d

Xiaomi shares up after court suspends Trump-era investment ban

Xiaomi enjoyed a sharp rise in its share price on Monday after a US court temporarily blocked the Department of Defense from forcing American investors to divest from the China-based smartphone manufacturer. It followed President Trump s decision on January 14, just days before he left office, to add Xiaomi to a list of Communist Chinese Military Companies under the 1999 National Defense Authorization Act s Section 1237. Fear and sadness: Trump is gone – and so is the ban on investing in Xiaomi, at least for now. (Source: The White House) Xiaomi had argued that the decision was factually incorrect and has deprived the Company of legal due process. Unless reversed, the move would have prevented US investors from buying Xiaomi shares by March 15, forcing them to divest their holdings by January 14, 2022.

New Year, New NISPOM | Stroock & Stroock & Lavan LLP

To embed, copy and paste the code into your website or blog: On December 21, 2020, the National Industrial Security Program Operating Manual (“NISPOM”) was published as a final rule in the Federal Register.  A revision to the NISPOM has been expected for a number of years, and is effective today, February 24, 2021.  A number of changes were made to this iteration of the NISPOM, but most of the changes merely formalize current U.S. government policies that were not previously described in the manual.  In any case, companies who currently possess, are in process for, or are seeking a facility security clearance should review how the NISPOM changes apply to their specific circumstances and goals going forward.

Xiaomi sues US to reverse Trump blacklisting

Donald Trump spent his last days in office blacklisting Beijing smartphone maker Xiaomi and other Chinese technology companies. Not content to wait and see if the new administration of President Joe Biden overturns it, Xiaomi has decided to try its luck in court. The world s third-largest smartphone maker brought the action on Friday in the US District Court for the District of Columbia, against Lloyd Austin s Department of Defense and Janet Yellen s Treasury. Fight or flight: Xiaomi isn t taking Trump s farewell blacklisting lying down. Trump s decision on January 14, four days before he left office, added Xiaomi to a list of Communist Chinese Military Companies under the 1999 National Defense Authorization Act s Section 1237.
