檢警調查，莊男今年初酒後，已有醉意，打電話給獨自租屋居住的女同學，請求「收留」他到她家睡一晚。女同學同意讓莊男睡地板。莊男抱怨地板太硬，睡了不舒服，讓他上床睡才能好好休息。
女同學因稍早吃了安眠藥，想快點休息，因此和莊男約定，2人可以同床，但1人睡1邊不能越界，不能碰她，莊男滿口答應，但莊男上床後就開始不規矩，一開始觸碰試探女同學，最後不顧女同學拒絕，硬上性侵得逞。
隔天一早，女同學跑出去向朋友哭訴，莊男則是一再向女同學致歉，女同學憤而報警提告。檢察官調查時，莊坦承曾和對方發生性關係，辯稱沒有強迫對方，但被害女同學痛哭，指她以為可以信得過莊男，沒想到莊卻對她做出這種事情。
檢察官根據相關證人證詞，加上莊男事後曾向被害人道歉，而且女同學情緒激動，符合性侵案被害人狀
