A foundational myth of Canadaâs Covid protest movement has it that at some climatic point in this horror-show the judiciary will rush in to vanquish our medical tormentors. A recent ruling by Justice Kirker of Albertaâs Court of Queenâs Bench pours pails of ice-water onto this fever-born fantasy.
On December 7 the Justice Centre for Constitutional Freedoms (JCCF) et al filed an Originating Application in pursuit of declarations vitiating Albertaâs Covid-related Public Health Orders on the grounds that these Orders violate Charter-protected rights and freedoms.
Acknowledging that this proceeding will take time to adjudicate, JCCF filed a Notice of Application, on December 10, seeking immediate suspension of the impugned Health Orders pending the outcome of the overall case. The hearing on this interim relief, pitched as a bid to âSave Christmas,â was held via video on December 21.

Our federal and provincial governments and the corporate media persist in describing COVID-19 as a “deadly” condition. For the vast majority of the population, this is simply not true. The coronavirus is far less deadly than most people understand. The risk is restricted mostly to the elderly who have fragile health. According to a report published by the Justice Centre for Constitutional Freedoms, “Only 3.3 per cent of Canada’s deaths attributed to COVID-19 have been of people under the age of 60, which is 374 people in a population of 37,5000,000.” This is comparable to an annual influenza season.

CALGARY An Alberta judge dismissed a legal challenge filed by two southern Alberta churches and three individuals arguing that COVID-19 restrictions violate the Charter of Rights and should not have been imposed. Court of Queen’s Bench Justice Anne Kirker ruled on the matter shortly after 3 p.m. Monday afternoon, rejecting it. I am of the view that there is a greater public interest in maintaining the integrity of order 42 than there is in staying the part of it the applicants asked me to suspend so that they and other citizens of this province are able to gather and celebrate the holidays and to otherwise exercise their religious freedoms, Kirker said.
