Ralph Northam’s declaration of a state of emergency has triggered Virginia’s anti-price gouging statutes designed to protect consumers from paying exorbitant prices for necessities during an emergency. Enacted in 2004, Virginia’s Anti-Price Gouging Act prohibits a supplier from charging “unconscionable prices” for “necessary goods and services” during the 30-day period following a declared state of emergency. Items and services covered by these protections include but are not limited to water, ice, food, generators, batteries, home repair materials and services, and tree removal services.

Kate Brown declared an abnormal market disruption Tuesday because of the severe weather in nine Oregon counties. That means the state now has the power to investigate claims of price gouging. Brown said she hopes the executive order sends a clear message to businesses not to raise the price of hotel rooms or goods and services because of increased demand. The governor says this executive order is in addition to the abnormal market disruption declaration due to the pandemic and wildfires. Those orders are still in effect.
