State Farm sues policy holder over payout from other driver s insurance

Morrissey EDWARDSVILLE State Farm is suing one of its policy holders who was involved in a collision, rejecting an arbitration decision and alleging she was not legally entitled to receive compensatory damages from another driver s insurance company.  State Farm Mutual Automobile Insurance Company filed a complaint  Jan. 29 in the Madison County Circuit Court against Frances Jean Campbell. According to the complaint, Campbell was involved in a vehicle crash on July 12, 2017, and filed a claim under her auto insurance policy held by State Farm. The policy includes bodily injury limits of $100,000 per person and $300,000 per collision. State Farm alleges that Campbell released all claims against the other driver involved in the collision and received a $25,000 payment from Geico General Insurance without State Farm agreeing to the amount of compensatory damages. 

Ex-insurance agent from Helena charged with fraud and theft

Ex-Insurance Agent From Montana Charged With Fraud And Theft Independent Record (Helena, MT) Feb. 10 Former Helena insurance agent Mark Anthony Biegler has been charged with multiple felony counts of fraud and theft, according to a press release from the Office of the Montana State Auditor. Biegler is charged with four felony counts of criminal insurance fraud and five felony counts of theft of insurance premiums. Each felony count carries a potential penalty of up to $50,000 in fines or up to 10 years in prison. A trial for Biegler is scheduled to begin in August in the Lewis and Clark County District Court.

Federal Court Advances COVID-19 Business Income Suit Despite Virus Exclusion A federal district court in Virginia has ruled that a spa’s COVID-19-related business income loss lawsuit can move forward despite a virus exclusion in its insurance policy. The United States District Court for the Eastern District of Virginia, Norfolk Division, denied a motion to dismiss by the spa’s insurer, calling the matter “ripe for judicial determination.” Since 2016, Elegant Massage LLC has owned and operated Light Stream Spa, which provides therapeutic massages in Virginia Beach, Va. On July 22, 2019, Elegant obtained an all-risk commercial property insurance policy from State Farm, covering loss or damage that results from all risks other than those expressly excluded. The policy was effective through July 22, 2020, and Elegant paid an annual premium of $475.
