Class action alleges Nationstar violated state Consumer Credit and Protection Act

Karolina Grabowska/Pexels WHEELING A woman filed a class action against NationStar Mortgage alleging West Virginia Consumer Credit and Protection Act (CCPA) violations. Maureen Vannest claims Nationstar charges a pay-to-pay fee between $14 and $19 each time a customer makes a payment over the phone, constantly violating West Virginia s CCPA, according to a complaint filed in Ohio Circuit Court. Despite its uniform contractual obligations to charge only fees explicitly allowed under the mortgage, applicable law, and only those amounts actually disbursed, Nationstar leverages its position of power over homeowners and demands exorbitant Pay-to-Pay Fees, the complaint states. Vannest is seeking compensatory damages with pre- and post-judgment interest, as well as civil penalties. She is represented by Jason E. Causey of Bordas & Bordas and Jonathan R. Marshall and Patricia Kipnis of Bailey & Glasser.

However, the West Virginia Legislature concluded its 2021 regular session without any meaningful change to West Virginia’s prohibitive recreational marijuana use laws or to the State’

Tech your username 6 hours ago Software user plaintiffs will have a chance to re-plead some of their privacy claims against Microsoft Corporation after Judge Yvonne Gonzalez Rogers issued a motion to dismiss ruling on Wednesday. The court held that the plaintiffs lacked standing and failed to state a claim for relief in its 13-page opinion. As previously reported, the plaintiffs, businesses who use Microsoft’s software, filed suit alleging that the company shares customers’ data without their consent. The class action complaint contends that subcontractors, developers, and third-parties, including Facebook, received the information from Microsoft despite privacy policies promising otherwise. They state claims for relief under the federal Wiretap Act, the Stored Communications Act, and several Washington consumer protection and privacy laws.
