Maricopa County Superior Court Judge Michael Kemp on Tuesday rejected last-ditch arguments by the Senate and Karen Fann, its president, that he should hold off issuing a final order. The judge said there is no need for further litigation, saying that the question involves “undisputed issue of fact.”

Attorney Roopali Desai, who represents the city, wants a judge to void a provision in the new state budget assessing the city more than $1.1 million. That is supposed to represent the additional costs borne by the state between the current $12.15 an hour in Arizona law and the higher figure approved by Flagstaff voters in 2016, currently set at $15.

2 More Phoenix School Districts To Require Masks

The Osborn and Roosevelt elementary school districts are the latest to issue mask mandates for their students and staff in response to the recent spike in COVID-19 cases and the more transmissible delta variant. Both districts serve preschool through eighth-grade students who are too young for COVID-19 vaccines.  The Osborn superintendent will work with district counsel to develop an opt-out option for parents, the district said in a Facebook statement.  The Osborn school district serves about 2,600 preschool through eighth-grade students. The Osborn district’s first day is Monday, Aug. 9. The Roosevelt school district, in south Phoenix, serves about 7,500 preschool through eighth-grade students and had its first day on Monday, Aug. 2.

Teacher Files Lawsuit Against Phoenix District Over Mask Mandate

A teacher has filed a lawsuit against the Phoenix Union High School District over a mask mandate it issued last week. In the lawsuit filed Monday in the Maricopa County Superior Court, high school biology teacher Douglas Hester said the district’s governing board lacks the authority to enforce face coverings. That’s because under state law, public schools are prohibited from requiring them. No school district is above the law and we are pleased to take action on behalf of this brave teacher to ensure government bodies follow state law, said Alexander Kolodin, Hester s attorney.  The district has local authority, Superintendent Chad Gestson argued in a Friday press conference.
