Cape Town Convention: court rules that AirAsia X restructuring scheme is insolvency-related event

In its recent decision in AirAsia X Berhad v BOC Aviation Limited (Originating Summons WA-24NCC-467-10/2020), the high court held that a scheme of arrangement under Section 366 of the Companies Act 2016 is an insolvency-related event for the purposes of the Convention on International Interests in Mobile Equipment (the Cape Town Convention) and the Protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment (Aircraft Protocol). The Cape Town Convention is an international treaty intended to standardise transactions involving movable property. Malaysia acceded to the convention and the Aircraft Protocol on 2 November 2005 and they both entered into force in Malaysia on 1 March 2006. The International Interests in Mobile Equipment (Aircraft) Act 2006, which was enacted to implement the convention and the Aircraft Protocol, came into force on 19 October 2006.

SEPANG – KL International Airport (KLIA) has been named as one of the world’s top 10 airports in the global Airport Service Quality (ASQ) survey by Airports Council International (ACI) for the category of over 40 million passengers per annum (mppa) in Y2020. The announcement made by ACI early this month is borne out by the airport’s continuous efforts in carrying out improvement initiatives despite being severely affected by the COVID-19 pandemic. The passenger traffic remains low due to prolonged domestic and international travel restrictions with only 1.6 million passenger traffic recorded in February for the Group, nevertheless the airport still forged ahead with mission critical projects. PETALING JAYA: KL International Airport (KLIA) is one of the world s top 10 airports in 2020 amidst extreme conditions, according to the global Airport Service Quality (ASQ) survey. The survey by Airports Council International (ACI) named KLIA as one of the top 10 in the world in the category of airports with over 40 million passengers per annum in 2020. In a statement issued on Monday (March 15), Malaysia Airports Holdings Bhd group chief executive officer Datuk Mohd Shukrie Mohd Salleh stated that the placing was due to the airport s continuous efforts to improve despite being hit severely by the Covid-19 pandemic. Mohd Shukrie said this led to KLIA achieving an annual score of 4.98 over 5.00 in 2020, an improvement over 2019 when the airport ranked at 17th place with a score of 4.76.
