– A trio of appellate court judges ordered that a Peoria man s post-conviction petition be reinstated and heard because his attorney failed to properly represent him.
The judges from the 3rd District Appellate Court in Ottawa wrote in a June 1 order that Shontel Diggins, now 45, should have a new attorney appointed and his case set for an as-yet unscheduled hearing under the state s Post Conviction Act.
Diggins is serving a 50-year prison term after being sentenced in 1998 for aggravated battery with a firearm in connection with a July 16, 1995, incident at a North Valley club where two men were shot during a robbery.
