Appeals court rules Kentucky prisons can deny hepatitis C medication

A federal appeals court has ruled the Kentucky Department of Corrections can deny a life-saving medication for inmates with hepatitis C because it is expensive  a decision a dissenting judge says will condemn hundreds of prisoners to long-term organ damage and suffering. In a 2-1 ruling, the 6th U.S. Circuit Court of Appeals panel said Tuesday the department can deny the treatment, which cures nearly 100% of patients but costs $13,000 to $32,000. The majority found that denying it to most of Kentucky’s 1,200 inmates with hepatitis C does not constitute cruel and unusual punishment in violation of the Eighth Amendment.  But in a sharply worded dissent, Judge Jane Stranch of Nashville said by “flouting the recognized standard of care,” the Corrections Department “consigns thousands of prisoners with symptomatic, chronic HCV to years of additional suffering and irreversible liver scarring.”

According to the evidence presented at trial, Leah Hagen, 49, and Michael Hagen, 54, of Arlington, Texas, were owners and operators of two durable medical equipment (DME) companies: Metro DME Supply LLC (Metro) and Ortho Pain Solutions LLC (Ortho Pain), both operated out of the same location in Arlington. The defendants paid a fixed rate per DME item in exchange for prescriptions and paperwork completed by telemedicine doctors that were used to submit false claims to Medicare. The defendants paid illegal bribes and kickbacks and wired money to their co-conspirator’s call center in the Philippines that provided signed doctor’s orders for orthotic braces. The ev

Marion nursing homes struggle to secure EMS services

For the last four months, Shannon Kellogg has been struggling to find a reliable EMS service.  In March, medical transportation service MedCare stopped transporting residents from the Presidential Post-Acute nursing home in Marion to dialysis and doctors  appointments. Then last month, Life Line Medical Ambulance said they will be cutting its services, too, the administrator said.  There is nobody servicing my building right now, Kellogg said. They state they don t have enough drivers to be able to do it.  At least they gave us that explanation, but it still doesn t help.   Like many other industries right now, EMS agencies across Ohio and the country are experiencing staffing shortages. In May, eight Cleveland ambulances went out of service due to short staffing, reported WJW-TV. That is about a third below what the city plans on each day to handle emergency calls.
