In a major relief to ruling Maha Vikas Aghadi government in Maharashtra, Bombay High Court has dismissed the petition challenging Shiv Sena MLC Dr Neelam Gorhe s election as Deputy Chairperson of Maharashtra Legislative Council.

Can the high court or the Supreme Court issue a notice to the presiding officer of a legislature while hearing a pending matter? If issued, is the presiding officer bound to answer it? These questions have repeatedly come up over the years, without convincing answers emerging either from the legislature or the judiciary.
“The Constitution has set clear cut boundaries for the three organs of the government – the judiciary, the legislature and the executive. Each organ should honour these boundaries. No one should encroach on each other’s territories,” said Speaker Nana Patole.
“…publicly, the legislature, secretariat, its secretaries and other officers responding to court notices and other correspondence means, in a way, accepting that the judiciary can keep a check on the legislature and it would be inconsistent with the Basic Structure of the Constitution,” said Chairman Ramraje Naik Nimbalkar.

In the State Assembly, the proposal was declared as “passed unanimously” by Speaker Nana Patole. It stated that Speaker Patole and Deputy Speaker Narhari Zirwal would not respond to any notice or summons issued by the Supreme Court.
Legislative Council Chairman Ramraje Naik-Nimbalkar said action will be taken on the matter as per rules.
Leader of Opposition Pravin Darekar on Tuesday moved a breach of privilege motion in the Legislative Council against BMC Commissioner Iqbal Singh Chahal for allegedly not responding to several letters written by him on many issues.
“Being public representatives, we have the protection that we must get a response within a stipulated time frame. Working as the Leader of Opposition in the state, I have written several letters giving a suggestion or seeking information on purchases made for Covid-19 centres, irregularities and on other issues,” said Darekar while moving the motion.
