NV International”).
1 The Supreme Court clarified that an aggrieved party must file an appeal under Section 37 of the Arbitration and Conciliation Act, 1996 (“
A&C Act”) within 60 days from date of order. The Supreme Court further held that a delay in filing appeals under Section 37 of the A&C Act can be condoned by the appellate court. However, such condonation must be granted only by way of exception and is permissible if the delay is ‘short’.

The Bombay High Court on Tuesday refused to grant interim relief to pharmaceutical company Cutis Biotech and restrain Serum Institute of India (SII) from using the trademark Covishield, for its coronavirus vaccine.
A division bench of
Justices Nitin Jamdar and C. V. Bhadang said that the Nanded civil court s order, refusing Cutis an injunction against Serum Institute was not arbitrary or perverse warranting the HC s intervention.

Citing the threat posed by the COVID-19 second wave to litigants and lawyers, the Supreme Court Advocates on Record Association has approached the Supreme Court seeking the extension of limitation period for filing of cases in courts and tribunals.
The Association seeks the restoration of the suo moto order passed by the Supreme Court on March 23, 2020, which had extended the limitation period with effect from March 15, 2020, until further orders.
Last month, on March 8, 2021, the Supreme Court ended the extension of limitation with effect from 14.03.2021 by closing the suo moto case, observing that the COVID-19 situation has improved.
The apex court had on March 23 last year invoked its plenary power under Article 142 of the Constitution to extend the limitation period of appeals from courts or tribunals on account of the pandemic with effect from March 15, 2020
