Federal Court Advances COVID-19 Business Income Suit Despite Virus Exclusion
A federal district court in Virginia has ruled that a spa’s COVID-19-related business income loss lawsuit can move forward despite a virus exclusion in its insurance policy.
The United States District Court for the Eastern District of Virginia, Norfolk Division, denied a motion to dismiss by the spa’s insurer, calling the matter “ripe for judicial determination.”
Since 2016, Elegant Massage LLC has owned and operated Light Stream Spa, which provides therapeutic massages in Virginia Beach, Va. On July 22, 2019, Elegant obtained an all-risk commercial property insurance policy from State Farm, covering loss or damage that results from all risks other than those expressly excluded. The policy was effective through July 22, 2020, and Elegant paid an annual premium of $475.

A key committee in Virginia has voted to have the statue of Robert E. Lee that now stands in the U.S. Capitol replaced by a statue of a local civil-rights leader.
Barbara Johns, whose 1951 student protest over the inferior conditions of her all-Black high school in central Virginia would become one of the five cases at issue in the Brown v. Board of Education decision, is poised to represent Virginia in the National Statuary Hall Collection, according to a press release from the governor.
Johns was recommended to replace Lee by the Commission on Historical Statues in the United States Capitol, a collection of legislators and citizens in the commonwealth who’d been working since July to determine which Virginia historical figure to should replace the former Confederate General.

Virginia Governor Northam says he will absolutely take COVID-19 vaccine when available

WASHINGTON - Virginia Governor Ralph Northam said he would absolutely get the COVID-19 vaccine once it is made available to him. Speaking with FOX 5 on Thursday, Northam said the state received 70,000 doses of the Pfizer vaccine on Monday. He says he hopes to get an addition 140,000 doses of the Moderna vaccine for the state once it is approved. Northam, a physician, says he has followed the data released regarding the vaccines and is confident they are safe. He also encourages all Virginians to get the vaccine once it is available to them.
