Does Oklahoma Legislature consider constitutionality of legislation?

Oklahoman Local state and federal courts have found these laws, crafted by Oklahoma s Legislature, are partially or wholly unconstitutional, although some of the rulings are still under appeal.  The Oklahoma Legislature has a history of passing bills that are later struck down by the courts as unconstitutional. Passing laws that are later overturned by the courts is not an issue specific to Oklahoma. Nor is the trend limited to the current Republican-led leadership at the state legislature. But critics say the legislature sometimes knowingly advances unconstitutional legislation, which they argue is a waste of time and taxpayer money when Oklahoma s attorney general has to defend those laws in court.

With less than a month before the end of session, House Speaker Charles McCall, R-Atoka, said he’s still holding out hope the Senate will take up his plan to effectively eliminate the state’s corporate income taxes and reduce personal income tax. “I think it’s very early to cast judgment on the level of appetite on those,” McCall said. However, earlier this month, Senate President Pro Tem. Greg Treat, R-OKC, said, “There is not an appetite to do the corporate income tax cut in the Oklahoma state Senate, there’s not the appetite was in my caucus.”

Oklahoman Leaders of the Oklahoma Legislature are in the midst of a political showdown that has one conservative activist calling for the head of the state Senate to be removed from his leadership position.  Senate Pro Tem Greg Treat’s decision not to hear House Bill 1236 in its original form has the president of the powerful Oklahoma Second Amendment Association calling for Treat to be removed as Oklahoma’s top senator.  Grassroots opposition On the Senate floor Tuesday, Treat defended his decision to amend the bill to create a unit within the attorney general’s office to evaluate federal actions and defend the state’s rights.
