And the difference there is that rod rosenstein is a senate confirmed appointee. having gone through that process when he was appointed back at the beginning of 2017. and so to have someone in that role now who is not senate confirmed removes that check and balance that we have written into our constitution to protect us against abuse of power by the president. i dont know that the argument is clear-cut. there could certainly be exceptions for temporary vacancies. this statute puts a limit of 21...
