In May, Alpha Inc, one of BYJU’S companies in the US, was taken to the Delaware court in relation to recovery of $1.2 billion.

The timeline for reaching an amendment was formally announced on July 24 by a steering committee of ad hoc term loan lenders who collectively own more than 85 percent of Byju’s $1.2 billion term loan. The committee had said that it and the company agreed to work collaboratively toward a signed and completed term loan amendment (the “Amendment”) prior to August 3, 2023

The statement from lenders comes a couple of days after Byjus skipped paying $40 million in interest payments on the term loan it had raised in November 2021. The company instead filed a case against one of its lenders in the New York Supreme Court and also sought disqualification of the lender.

Byjus cannot be expected to and has elected not to make any further payment to the TLB lenders, including any interest, until the dispute is decided by the court, the company said

Alpha Inc faces a lawsuit from an agent acting on behalf of lenders who are owed $1.2 billion. The suit was lodged by Glas Trust Company and investor Timothy R. Pohl, naming BYJU'S Alpha, Tangible Play, Inc., and Riju Ravindran as defendants. Ravindran is the director of Alpha Inc.

Responding to the allegations made by the US-based Delaware Court, the edtech giant said that it has met all the payment allegations of the $1.2 billion loan and its recent fundraise will help them become financially stable.

Delaware Chancery Court Judge Morgan Zurn sided with the lenders after it ordered BYJU's Alpha's managers to not make any substantive changes at the company.
