>> one of our top stories tonight on espnews, commissioner roger goodell suspending donte' stallworth the entire 2009 season, including the playoffs. the wide receiver pleaded guilty to d.u.i. manslaughter and served 24 days in prison. it was in the early morning hours on march 14th when stallworth's car struck and killed 59-year-old mario reyes in miami. in an exclusive interview, e60 sat down with donte' stallworth, who spoke publicly about what happened. >> from his 25th floor condo in downtown miami, donte' stallworth can't escape the view. what runs through your mind when you look in that direction? >> the trip that i took to get from here to that spot and just wishing that i didn't make the decision to get in my car that night. >> on march 13, 2009, donte' stallworth was one day away from heading to cleveland for workouts with the browns, his fourth team of his seven-year career. it was a friday, and the 28-year-old stallworth was going to party with friends, among them teammate and fellow wide receiver braylon edwards, at the fontainebleau hotel in miami beach. >> we grabbed some dinner and had two margaritas with a couple guys and decided to go home after two hours. >> when you left the fontainebleau, were you intoxicated when you left? >> no, no. >> while stallworth was heading home, mario reyes, one week shy of his 60th birthday, was working as a crane operator at the port of miami. >> mario reyes was a hard-working individual. he lived for his daughter. he lived for his family. excellent father, just hard-working, blue-collar guy. >> after 1:00, shown here in the building's surveillance video, stallworth got a text message from a friend and went back to the fontainebleau to rejoin edwards. >> braylon's liquor bill was around $3,000. yours was $616. how much had you actually had to drink? >> four shots. with a couple different groups of friends. >> four total, not four each group? >> no, four total. >> did you feel drunk when you left the bar? no, not at all. >> stallworth returned to his miami condo at 6:18. at 7:00 a.m., reyes was just finishing his shift and planned to take the bus back home. at 7 which can't 10 a.m., stallworth left his condo get breakfast. >> what did it look like outside? >> the sun wasn't up yet. dark enough to where every vehicle on the road still had their lights on. >> stallworth drove east in the left lane of the mcarthur causeway. a four-mile stretch of highway that connects miami to miami beach. >> i'm coming around the bend at about 40mph, and i see mr. reyes in the bus lane to my right, and suddenly he runs into the street. i flicked my lights and honked my horn in an approach the try the warn him, and i applied my brakes. >> police found no skid marks and stallworth says he had at most two seconds to react. >> we collided and that's one of the many vivid things that still plays in my head to this day is the sound of that accident. >> how soon after did you call 911? >> i immediately reached into my bag that was in my passenger seat and i called 911 right away. >> 911. miami beach. what's your emergency? >> on the causeway. >> where on the causeway, sir? >> damn, you know what, i'm right in front of the alton sign, beaches and art deco history sign. >> okay. did you pass the marina? >> um, i don't know what the marina is, sir, but... >> okay, listen, listen, this guy just ran in front of my car, and he's [bleeped] laying in the street. >> so your vehicle hit someone in the street. >> yeah, you got it. you got to send an ambulance right now, man. >> we played the 911 call for stallworth. what does it feel like to relive that? >> it's horrific for the mental images in my mind and it's like a slow motion video from... just from the very beginning to him running in the street to the sounds. you know, she'sing in you have have -- i have to live with for the rest of my life. >> oh, no. oh, my god, this guy... he's hurt. >> i'm talking to 911 right now. >> i am 911. what happened. >> i was driving. he came out of nowhere. he ran from over here. he came out of nowhere. >> stallworth cooperated fully with police. he was given field sobriety tests and allowed the miami beach police department to search his car. while paramedics tried to save reyes' life. >> he knew he had critically injured somebody. he didn't foe that person was dead at the time, but he knew somebody was in a bad shape. >> stallworth was taken to the police station shortly after 10:00 a.m. and gave a statement without an attorney present. he was then notified that reyes had died. >> had you not had any alcohol, do you think it would have been different? >> i feel like the situation was unavoidable, but if i would have used better judgment prior to that, it would have been a different outcome. >> stallworth was released that morning. a toxicology report later showed that stallworth's blood-alcohol content was .126, well above florida's legal limit of .08, and he also tested positive for marijuana or t.h.c. >> when was the last time that you had smoked marijuana? >> i was out of town prior to that evening several days before, but nothing that night. no. >> nearly three weeks after the incident on april 2nd, prosecutors charged donte' stallworth with d.u.i. manslaughter, a second-degree felony punishable by up to 15 years in prison. soon after police obtained a video, now sealed by the judge, that showed reyes running in front of stallworth's bentley, making it difficult for prosecutors to prove stallworth was solely to blame for reyes' death. >> what you have here is no independent witnesses that saw anything, a video which depicted mr. reyes darting out from behind a palm tree. he wasn't in the crosswalk. it would have been better if he had waited. he made a mistake. >> by the end of april, stallworth's attorneys reached an undisclosed civil settlement with the ray -- reyes family, and on june 16th, prosecutors and stallworth's attorneys reached a plea agreement. stallworth pleaded guilty to d.u.i. manslaughter. his sentence, 30 days in jail, two years of community control, which means he can't leave his residence without permission, another eight years probation, a lifetime ban of his florida driver's license and 1,000 hours of community service. >> i think it raises some troubling issues about whether you can buy you way out of trouble and whether this is justice by checkbook. i just think a 30-day jail sentence for an infraction like that is way too light. >> what do you say to people who feel like you got off easy? >> you know, i feel that everyone is entitled to their own opinion, but at the end of the day... >> at the end of the day, we have you driving under the influence and a man is dead. how do you think that looks to people on the outside when you get a 30-day jail sentence? >> well, as the case goes, there's a lot more to it than that. at the end of the day, i think that i have to take full responsibility for the choices that i made that morning. >> this was not a lenient sentence by any stretch. people tend to focus on the 30 days in jail, but there's quite a bit after that that he's going to have to live with for a long time to come. >> stallworth began serving his sentence at turner guilford night correctional facility in miami on june 16th. he spent 23 and a half hours a day alone in his cell. >> every day was second by second, minute by minute. the days were slow, and there's not one day, one hour that went by fast. >> at 6:00 a.m. on july 10th, after serving 24 days of his sentence, stallworth was freed from jail. what does it feel like to be released from jail? >> it didn't feel different. you know, the jail time had no effect on the tragedy. >> as a result of his d.u.i., stallworth also has been placed back in the league's substance abuse program, subjecting him to frequent drug testing. he spent two years in the program for marijuana use but completed it in 2007. there are few precedents with nfl suspensions on d.u.i. manslaughters. the lone example, in 1999, leonard little was convicted of the same c test. ri events that changed his life and ended the life of mario reyes. how does that feel that you played the role in the death of another human being? >> it's terrible. you know, it just goes back to all of the mental pictures that i get. it's very hard the deal with every day, every single day. i've been meeting with a psychaiatrist once a week, and he's been very helpful. >> do you ever feel like you have no right the feel sorry for yourself? >> yeah, there's been that feeling. >> because all people look at this and feel that way. people look at this and say, you know what, you might have it tough, but a guy is dead. >> exactly, exactly, and that's why i say i can imagine how they feel. if i ever so much as take a sip of alcohol and i get behind the wheel and drive after what had happened on march 14th, i would be spitting on mr. reyes' grave. >> michael smith reporting. again, the news today, stallworth suspended the entire 2009 season, including the playoffs. browns' coach eric mangini isn't saying if cleveland will bring back the wideout in 2010. cleveland visiting green bay saturday in its preseason opener. after the break, tom brady there in philadelphia warming up to take on the eagles. you'll see action for the first time since the knee injury. time since the knee injury. we you do get a hint of drinkability right away. does my pen have write-ability?
