That goes to show precision being used to address these issues being brought up by the neighborhoods affected by the project. And thats incredibly important. And, so, while speed can be sometimes a bad thing, that a slow process in and of itself is not necessarily a good thing either. That just because something has slowed down doesnt mean that that project is then deliberated appropriately. As long as the appropriate deliberations is happening, that is more than enough. And thats whats happening right now. Ways in which the term substantial evidence is used in ceqa. One is an evidencery standard. One is an appellate standard. The way in which this is introduced in this legislation has to do with evidence and very simply, if you want to make a case for conclusion, whether you is the city or you is the appellant, you need to substantial evident to support it. Thats all that this ordinance says. Thats what the state statutes say, thats what the state guidelines say, thats what the statute says. It doesnt produce any permissible standard. The other way in which substantial evidence is used in ceqa is as a standard of review. And in very simple terms, theres two basic standards. Theres substantial evidence which is defresidential to a lead agency, it primarily applies to eirs and addenda and infill exemptions. And theres fair argument which primarily applies to negative declarations. This does not addressing that. In fact, more broadly, this ordinance does not address the substance of how ceq
Extent that the local build out is the reason people might sign up for us, we do have to recognize that for all of the Unanswered Questions that we have on this part this is the simple one. This is by comparison a piece of cake, both to analyze and to implement. Much more difficult. The program thats been put forward for the local build out, this is a very aggressive program. How many what was the bond size . A billion dollars. A billdollar bond issue, thousands of Small Projects that have to be managed in a its a very ambitious program. So that all of the difficulty were having grasping just this first phase, if the first phase becomes dependent on the second phase, we have to get a lot smarter before we do that.
