The Botswana Public Employees Union (BOPEU) has challenged Babereki Investment (Pty) Ltd for contempt of court.
The union alleges the company has failed to obey a Court of Appeal order issued by Judge President Ian Kirby instructing Babereki Investment (Pty) Ltd – a wholly owned BOPEU company and chairperson Masego Mogwera to convene an annual general meeting on 24 April 2021.
This development comes after Babereki Investment team led by Masego Mogwera (one of BOPEU directors) submitted two lists of members who are allegedly eligible to attend and vote at the annual general meeting (AGM) which was expected take place on Friday 24
On Wednesday the 9
th of December 2020, Mogwera’s team filed a Notice of Withdrawal of Action against Sedimo and his team with the High Court.
In the notice of withdrawal, it is written that the applicants, which are Babereki Investments, Masego Mogwera, Martin Gabobake and Thabologo Galekhutle, hereby withdraw the application against the respondent (Botswana Public Employees Union) filed with the Court on the 27
th November being an application for leave to appeal to the court of Appeal.
On the 17
th of July 2020, Babereki Investments, together with Mogwera, Gabobake and Galekhutle, filed an urgent application before Justice Dube at Lobatse High Court to have a decision to remove them from the Babereki Investments board declared unlawful and set aside.
