the main entrance to the doral golf club and trump resort off of 87th avenue in miami. saw some police motorcycles come out, maybe they may be prepositioning to handle traffic. the president not expected to leave for a little while yet. jonathan, we talked about this yesterday but bears repeating, this idea of time being the greatest enemy and also the greatest benefit to the former president. if he can use delaying tactics to push this thing back, he can t pardon himself on state charges, so the case involving stormy daniels, he could not pardon himself from but he could conceivably pardon himself if he manages to be president again on this case. how does he work the system, if you will, to make sure none of this sees a jury or a courtroom until after he becomes elected or the election is over? john, it wouldn t be that hard if the trump team plays its
cards right. as andy just noted, even if the judge was inclined, you have to try to find a space between a rather crowded litigation docket. on top of that, you have a doj rule that says they are not supposed to take actions in court that influence election. the first election is in february, the first primary for the republicans, and usually you count back about 90 days from that, which puts you in november, and that just does not seem like in any realm of reality that that would take place. on top of that, while the special counsel invokes the speedy trial act, the speedy trial speedy trial protection of the constitution, and there s also an act that essentially establishes a 70 day period to bring a case to trial, that s a protection for the defense, not the prosecutor, and it is universally waived because the defense needs more time and so i
relevant than it usually is in a given case. because if he s elected, or a republican is elected they would issue a pardon in the case. so, that s one court that has some meaning here. in terms of the allegations of selected prosecution, it s unlikely a jury will hear those arguments. those motions are routinely denied. i ve brought a couple of those, they are very hard to get a court to take seriously. they don t like looking at the motivations of the government, they say look, don t get to us on motivation, just tell me, is there a basis here for a charge. so the jury itself is not likely to hear those arguments. but the jury is part of the public at large. they have to pick 12 people and alternates. we just discussed the polls showing almost half the country views this case as politically motivated. so, just as i ve said the president has to run the table at his age, at 76, to knock down
time to get this case to trial next year. but let s not forget. in two weeks he s back he s in federal court in manhattan trying to get the manhattan d.a. case removed into federal court. in the first or second week in august we expect to see indictments in fulton county in connection with the 2020 election. on october 3rd he begins trial in new york on letitia james, the new york attorney general s big fraud case that she brought against him civilly in new york. that trial will take a few weeks. in december he s supposed to be back in front of the judge in manhattan to have motions in that case, which is scheduled for trial two weeks after super tuesday, on march 25th. so this federal case we have just gotten, it s not like there is a clear calendar they can push it through. i don t know where they are going to fit this all in. john: we are taking a look at
don t see how you are going to fit this in. and going back to what andy said about the georgia case, this may be a serious problem for the democrats. if this case is sandwiched between the new york and georgia cases, that is really bad optics. those two cases have a strong political patina. the new york case in my view is a political prosecution, i think trump is absolutely right about that. in terms of the bragg prosecution. the georgia prosecution dubious in my view, unless they found new evidence. if those cases are book ends of this one, it s going to undermine the special counsel. almost half the country believes these charges were politically motivated. that s a really tough audience for smith in making his comments that there s only one system of justice. a lot of people don t buy it.
