He says that he crept out on to the road. the state suggests that mr. bryan either hit mr. arbery or tried to hit him, and pushed him with his 5,000 pound motor vehicle. well come back to that in a second, but i think the evidence is inconsistent with that. now, i do want to talk about the indictment for a minute. lets take a minute to review the indictment. it is what we sometimes call a kitchen sink indictment. everyone, all three dfefendants are charged literally with everything in the indict...

This, understands that sometimes you cant see the phone at all. but assuming that mr. bryan has 20/20 vision and assuming that he has every bit as good a view of as phone as hes driving as you see here, where is travis mcmichael? i cant see travis mcmichael in this picture. really, honestly, i cant see greg mcmichael in this picture. and i certainly cant see any guns. now whats our post on this one? this is at 1:15 into a minute and 43-second video. and mr. bryan at this point has no reason to k...

Doubt that mr. bryan, having turned away, that he didnt come back for the right reasons. how can one say that he has lied on february 23rd when he says he was trying to get a recording of mr. arbery that he was trying to document what was going on because he thought mr. arbery was going to get away, and he wanted the flpolice to have tha information. those werent my words. those were his words way back, moments after the shooting. having seen that mr. bryan was going away and then turning around...

Substantial and necessary cause plaintiff arberys death. whether that is the fault, for lack of a better phrase, of mr. mcmichael, the fault of mr. arbery or the fault of both or simply without any fault on either part and an unavoidable tragedy. why should roddie bryan be held responsible for that? i would submit to you under the law that mr. bryan cannot be guilty of any of the felony murder counts for that reason alone. all right. count six. count six alleges aggravated assault by shooting. n...

But when you look at the lowry interview, when you look at the minchu discussion on the side of the road, you know what the truth is here. now, if im out of order, irrespective of chaos, mr. bryan doesnt know what happened up the street at the english residence. he doesnt know mr. albenzy is out there, he doesnt know mr. albenzy calls 911. he assumes someone has, but he doesnt know. he doesnt know mr. albenzy is armed and just up the street. mr. bryan is not in communication with anyone prior to...

Injury? yeah. yes, they did. we know mr. bryan did. he ran him into a ditch then tried to go at him again, then another time, then backed up for him. now, what did travis mcmichael say on stand? i just pulled up next to him. i didnt startle him. he wasnt afrald of me. do you believe any of that stuff? just look at the night owl video. look at how mr. arbery tries to get away from them, and then look at them speed up after them. thats all you have to do is look at that night owl video and youll k...

Now, its at the very end he ba backs up and straightens out a bit. whether mr. bryan said he was going to the left or to the center or slightly to the left, the actual evidence in the case is consistent with him pulling stating out. and again, we know from all the other things that weve seen that mr. bryans recollection of events that day simply isnt that good. now, mr. arbery, not mr. arbery -- mr. bryan makes what is for him a very faithful decision he actually pulls out in the road. now, at o...

Suggest to you that perhaps -- and i know ill get reamed for this -- i would suggest to you you can call it karma, you can call it fate, i would call it divine providence. somebody is guiding mr. bryan, whether its a thought process or not. someone is guiding mr. bryan down this street to document whats going on. just like mr. bryan is on his porch. why does he go out? he doesnt know. he gets in his car and sits out there. he doesnt even know why. hes being guided, whether thats by a god, if you...

Transmission shift as mr. bryan puts his truck in park. and then two seconds later youll hear mr. bryan buckle his seat belt. now, in about 30 seconds, and im going to go through this with you before we play it so youll know what to listen for. mr. bryan utters the famous words, im going to keep going. and youll notice his cell phone is down. this is where he says, im going to keep going. the state is suggesting to you, if i recall the opening statement and the opening portion today, that this i...

This gentleman is interacting with it in the way it a he is, but this is whats happening unbeknownst to traps. mr. arbery turns around. you get a quick glimpse of whats up the street, and it isnt travis mcmichaels truck. it isnt there. its because its all the way back down holmeser in satilla. the state is going to heart record that you heard of mr. bryan turning and revving and doing all of this stuff. this will be the third interact that mr. arbery will have coming at this truck, and mr. boyan...
