and then actually never really does do it. like release his taxes, right. then there's other cases where it overrides all common sense, all of his advice and everybody else and does do it. the big question is, is he going to do it in this case? we don't know what donald trump we're fog to get on that particular day. although his staff does say and his attorneys do say that his tweets, in effect, and his public statements amount to his own testimony so far and you can just read his tweets and read his mind and that's something muler is doing, to see if there's any condemning statements he's made in those tweets. >> he's been warned about that for a very long time. the president continues, you know, to tweet. whether he is saying disparaging things about the process, his own intel community, all of that. how will mueller use these tweets to his advantage? even if they never get direct q & a from the president? >> yes, well, the tweets, on one
hand, the tweets are just irrelevant to mueller and his team. it's just background noise and they're not paying attention to it. in terms of affecting the work they're doing. >> but it could influence direction or could -- >> even with -- >> -- cause more probative questions? >> it could provide leads and, in fact, even amount to evidence at some point. >> even when he tweets blatantly that sessions should fire mueller. >> that's the kind of tweet that could amount to evidence -- >> whether the word is "must" or "should." it's important. >> in terms of the tweets as criticism, you know, that's what i mean when i say the mueller team is not paying attention to that. sure, they're looking for potential evidence there. and so we'll see how that goes. i don't -- if i had to predict, i wouldn't say the president will sit down with the mueller team. i'm not sure the mueller team needs the president to sit down to make whatever case or cases they're trying to make. >> meaning they already know the
answers likely? just to see whether someone's being truthful? >> i think that's right. ironically enough, most subjects or targets of investigations, when they're given an opportunity to sit down with the prosecutors, it's really in their benefit to potentially talk themselves out of an indictment. in the absence of sitting down and convincing the prosecutors an indictment is forthcoming. it's more complicated of course with the president because there's the school of thought that says the sitting president cannot be indicted. i'm not sure that there's a good answer here for the president. on one hand, defense lawyers would say don't sit down in the situation. on the other hand, of course, the mueller team will assume the worst if they don't get cooperation. >> and then, you know, steve, all of these investigations are taking rather odd twists. because now sources are telling cnn that kristin davis, also known as the manhattan madam, met mueller for a voluntary interview this week. investigators appear to be interested in her close ties with longtime trump adviser
roger stone. so, steve, how do you see all of this connecting? >> well, the manhattan madam part admittedly might be a bit out of my expertise. but i think the hard thing that mueller has to do here and of course he's uniquely qualified, as is his team, is move from all these pieces of information, many of which have significant counterintelligence implications. what are key people doing. where is money moving. what are the connections back to russia. what malfeasance is going on. in moving from simply counterintelligence stuff, which is basically common sense suspicions and following patterns to a legal case where you can actually begin convicting people and saying, okay, the laws were broken here. i think common sensically, everybody can look back and say, look, there was a lot of no good stuff going on here. but turning that into a legal case is something that's a bit tougher. >> i do think, you know, for
roger stone, he must be looking at paul manafort right now going, you know, if they're going to build a case against me, if that's why they're interviewing the manhattan madam and they're going after me and my finances, do i really want to go through this trial -- >> so like an imposing fear? >> yes, it's sort of a warning. you know, like do you want to end up like paul manafort or cooperate and end up like michael cohen. that's a choice between a lot of these guys who are part of this investigation. i think roger stone, things are really closing in on him, and that's going to be his choice too. >> potential legal strategies here. thank you so much. appreciate you all. all right, still ahead, a letter from the president. secretary of state mike pompeo hand delivers a message from president trump to a north korean official. so what does this pen pal kind of situation say about the relationship between the two leaders? and later, the trump administration separated hundreds of children from their parents at the border.

they're just pretty much generally saying we want to continue, we are committed. but if you look past the last week, there's been ups and downs. reports that north korea is continuing to evade sanctions, continuing to develop its nuclear program and there's a lot of rhetoric going back the last couple of days. especially in terms of north korea meeting the denuclearization, which pompeo admitted today that north korea's really setting the pace of this, that they're going to be the ones who dictate when they're going to denuclearize. >> they initiated the letter, right? and presumably it doesn't just say hi, how you doing. there must be in this kind of dialogue a tick tock of this is what we're willing to do, this is what we don't want to do, this is what we like. >> no, there doesn't have to be. you would hope that there would be and there should be. but a lot of these letters are
just kind of reaffirming the commitments that each one was willing to do. secretary pompeo has not been able to nail the north koreans down either for a time line for denuclearization or for the definition of what it actually means. it means something very different to north korea than it does to the united states. and as soon as secretary pompeo left after shaking hands with the north korean foreign minister and exchanging some pleasantries, as soon as he left that meeting of asean nations in singapore, the north korean foreign minister was blasting the united states for not lifting sanctions, for saying that it needs these type of confidence building measures. so although certainly rhetoric has improved since a year ago when it was all fire and fury, there's not a lot of progress in terms of the denuclearization. >> last hour you reported the u.s. says that north korea is evading sanctions. but what does this mean? no surprise there, right? >> it's no surprise.
but the problem is when the two leaders met and there's this agreement to kind of move forward, countries thought they could relax on the sanctions. so there's an oil ban, a petroleum ban, against north korea. now there seems to be transfers of oil, ship to ship transfers. and russia is responsible. china's responsible. they have pictures. also north korea's defying an arms embargo, trying to ship light arms place, proliferating weapons. so as the u.s. and north korea start to move closer together, countries feel that they can relax some of those sanctions and now north korea could get some of the retch knew that sanctions have been designed to put pressure to get them to give up the nuclear program. >> we'll see what's next. elise labbott, thanks so much. now to iran where the country's navy is holding military exercises in the strait of hormuz in the persian gulf and the war games come as the
trump administration is preparing to reinstate sanctions against iran and president trump and iranian leaders have spent the past few weeks exchanging threats on social media. cnn's international diplomatic editor nic robertson joining me right now. nic, no accident that iran has chosen the strait of hormuz to flex its military muscle. this is a major shipping area. what is the message being sent? >> really seems to be the message being sent that if iran so chooses, it can disrupt the world's oil fields. 20% of the world's oil passes through there. it's a major choke point effectively. and impacting one oil tanker, never mind shutting down the whole straits, would put a spike, a nasty spike into oil markets. perhaps trigger higher fuel costs for us. the reality is we don't know why iran has put these military
exercises into play right now. the timing of course right before -- in position of sanctions on them, because they've -- because president trump unilaterally pulled out of that international joint program with iran and iran's commitment to denuclearize. that really puts economic pressure on iran. so i think the indicators here are absolutely as you say they're flexing their muscles at a strategic choke point that could have huge impacts, huge economic impact, were they to push ahead with some nefarious activity. no indication that's going to happen. the iranians didn't talk about this military exercise publicly. often they do. so the moment, it's just a lot of questions around it, fredricka. >> all right, that's at the straight s of hormuz. u.s. and turkey, both of these countries have frozen the assets
of key officials. is this all over the pastor being held in turkey? >> it seems to be, though there are other issues in the background, you know, the decision to suspend the sales of f-35 fighter aircraft to turkey. that was a decision taken by the senate recently that put that decision off now to wait for a report from the pentagon in 90 days. so the turkish are not happy about that. there's turkish banking officials that are currently going through the courts because the united states accuses them of trying to get around sanctions on iran, sanctions busting there. there's differences of opinion over syria. but it does seem to be the issue. he has really brought things to a fore. earlier in the week, the united states deciding to sanction the justice minister and interior minister. we heard from turkey's foreign minister in the middle of the week, saying they would reciprocate.
despite the fact that the turkish foreign minister met with secretary of state pompeo in the past few hours and the readout from that meeting was positive, constructive that they thought they were making ground on this issue that it could be resolved in a number of days or weeks. now we hear from turkey's president today, reciprocating, as the foreign ministry warned they would, by sanctions on the turkish assets of the united states justice and interior ministers. now, obviously, the united states doesn't have justice and interior ministers and turkey hasn't yet said who these people are, but it looks like it could be attorney general jeff sessions. it looks like it could be secretary of homeland security krist kristirstjen nielsen. so the impact this would have would be minimal. but the signaling, it's not a positive development for getting him back to the united states or even out of house detention where he is now. >> nic robertson, thank you. coming up, hundreds of children and parents still apart after being separated at the

the ones to track down parents and determine reunification eligibility, bringing kids and parents back together. a california judge rejected that request, saying the administration should be held 100% responsible. joining me right now is immigration analyst raul reyes. good to see you. while the court may have issued that ruling, is it the feeling the administration will respect that and then take the lead in trying to reunify children and parents? >> well, right now, they really do not have any options, so it does look like that the government will continue to, in the search for these children. remember, most of the children that were separated from the parents, at the point where we are right now, most of those children have been reunited with their families. the children who are at issue now are about 400, 500 children. many of their parents have been deported to central america. the problem is now the government is saying it wants to essentially abdicate responsibility for finding them and reuniting them with their
parents. now, both legally and practically, this is -- this is really just an astonishing position. because first of all, when the government took these children into its custody, it assumes a duty of care for them. unresolved issues including potential asylum cases. so the government cannot just hand them off to a third party. the fact is, the aclu has done tremendous work on behalf of these children and families. the aclu is not an arm of the federal government. so for example even if they wanted to, a group like the aclu cannot go to central america and command and work with local officials to help them find these families. they don't have that authority. they cannot go to a consulate, for example. and meet with government officials and work with them and demand that they help them find these parents. >> the judge's ruling is reminding that it's not the aclu or any other ngo group that took
intake of these kids. >> exactly. >> made any kind of, you know, record or cataloging of parents and children. but presumably based on the judge's ruling, the government would have done that. so is equipped or should be equipped to try to locate parents who have been deported or simply parents and children who have been separated. but the administration has already spoken essentially. saying it didn't do a good job of cataloging. so now why should anyone think that as a result of the government's actions, these reunifications will take place? >> well, the reunifications are going to take place for most because they have to. the judge has issued -- >> but if they didn't, if people did not do a good job of once they deported, they didn't find out how to, you know, reach that parent whose child is still in detention. why is anyone convinced, you know, that the government will then do the leg work to find a
parent who has been deported and reunify them with a child who may be in iowa, maryland, new york and in a facility in texas. >> there are about 100 children in the united states where the government doesn't know exactly where they are. the reason is because what came out of this latest hearing with the judge and the parties involved is that the government, number one, has had no plan. they're basically winging it in terms of the reunification. and there's no specific point person. what the judge said to them, the judge gave them very specific orders. number one, that the next status meeting on august 10th, the judge wants to see a specific plan. it wants a process in place. >> do you have confidence in that august 10th deadline being met? >> i think the government at this point is doing good faith efforts. but the second thing that the government asks for -- not asks for, ordered the government to do is to put a point person in place. one person to be in charge of leading this effort. because one of the big problems we're seeing leading up to this is that the agencies involved in
reuniting the children thus far, including i.c.e., the office of refugee and resettlement, dhs, their computers don't even talk to each other. they're work on databases that don't even connect. so that has hamperred the whole process immensely. the aclu has volunteers of their own volition to say they'll help the government to reach out to these families to try to make connections in central america. i want to remind people of something that's a very important practical consideration. when we talk about the reunification of parents who have already been deported. these are people who left those countries under very desperate circumstances. they left because they were afraid of gang violence or because they were maybe facing death threats. so when they go back, they're most likely in hiding or in a new location or in very remote areas. so that makes the process of finding them even more difficult. so now it seems that the judge is losing patience.
he expressed anger. he was annoyed the government has not been more on track with reunifications. hopefully going ahead the government will make a stronger effort to find these families. >> i read there have been so many cases of parents who have been deported who were told one thing only to find out that once they were deported they were not leaving with their child or they were leaving without the information in which to retrieve their child later. so there's such a variety of circumstances that it's made -- >> that's one of the other big issues that the aclu is following up on. whether the parents who have been removed from the country knowingly waived their rights or did it with full understanding of, you know, the documents that they were signing, the consequences. >> we'll leave it there for now. thank you so much. undocumented immigrants already living in the united states are facing a growing health crisis. regardless of disease, condition or disability, undocumented men, women and children essentially
cannot be treated until they are on the brink of death. our chief medical correspondent dr. sanjay gupta has one mother's story. >> reporter: in order to really understand what's going on here, you're going to need to suspend disbelief. lucia is dying. her lungs drowning in fluid. her electrolytes are fluctuating wildly. and her heart is precariously close to shutting down. this 51-year-old mother and undocumented immigrant has end stage renal disease. full-on kidney failure. >> the function of the kidneys is to filter blood of excess toxins and excess fluid. when both kidneys stop working, people on average will live anywhere from 10 to 14 days. and so to continue living, you need some process to filter blood, which is a dialysis machine. >> reporter: for most people that treated the problem.
but here's the thing. lucia is allowed treatment only when she essentially arrives at death's door. the emergency medical treatment act of 1986 says hospitals in the united states must care for anyone with a medical emergency, regardless of their citizenship or ability to pay. but they're not obligated to prevent that emergency from happening in the first place. what is happening inside the body? >> for these patients, because they only come in once a week, instead of the three times per week, excess fluid, it stays in their body and it goes into their lungs, goes into their legs. separate from that, the toxins build up. one of the most important toxins being potassium. which at high levels can make the heart stop. >> reporter: this is no way to live. about as close to death as you can get. what's more, research shows that treating patients with emergency dialysis versus standard dialysis is nearly four times more expensive because these
patients like lucia are so much sicker when they come in for treatment. they're literally pushing themselves to the brink of death to get this treatment. am i overstating that? >> no, not at all. >> reporter: there is no question it works. lucia. just look at lucia now. after dialysis removed ten liters of fluid from her body. how are you feeling? >> translator: right now, i feel good. >> reporter: still, lucia is always worried. mostly about her family. especially her son alex. he watches his mother steadily decline every single week. this is their life. how hard has this been on your family? >> translator: it's been really hard. it's been really hard for my family. the worst is for my son. he worries about me. >> reporter: because just a few days from now, like clock work,

administrative leave. cnn correspondent cayleigh hartung is following the story for us. >> urban meyer is trying to make it clear he believes he followed the proper reporting protocols and procedures when he was aware of the allegations courtney smith was making against her then husband, his assistant coach. urban meyer is a husband. he's a father of two daughters. he's a leader of young men. and he's recognizing how he's been portrayed since the story broke. and that's as a man who was indifferent to domestic violence. who allow ed this behasslvior t on. he issued a strongly worded statement on twitter yesterday, in which he said here's the truth. while at the university of florida and now at the ohio state university, i have always followed proper reporting
protocol procedures. my elevating the issues to the proper channels. i did so regarding the zach smith incident in 2015. i take that responsibility very seriously. any suggestion to the contrary is simply false. so now i think the question broadens to not just what did urban meyer know and when but what did the university know, what did the athletic director know and what actions did they take, fred. >> and where are we in this ohio state university investigation, in what phase? >> this investigation is focused on what urban meyer himself knew and what he did, you know, when brett mccmurphy first reported this story, there was no discussion, there was very little room for debate as to whether or not courtney smith was a victim of domestic violence. she has pictures. she had text messages to prove that she endured.
now zach smith is speaking out and sharing his version of events. take a listen. >> anything that happened to her body was all just defensive movements to remove myself from the situation, and i said that's it, i'm not going to get charged because i didn't do anything wrong. >> that denial goes against the mountain of evidence against him. but, again, raise hs the questis of who knew what when. he's saying police notified the university of the allegations against him. now the university saying they have a six-member team leading this investigation who will then operate independently and report back to the board of trustees to decide what needs to happen next. i think it's a question not just of urban meyers' fate but the standing of this university on the whole. >> all right, kaylee hartung, thank you. we'll be right back. sometimes a day at the ballpark is more than just a day at the ballpark. stadium announcer: all military members stand and be recognized.

that trump and the republican pitch to voters is fundamentally a con job. i mean that in the most literal sense. the term comes from so-called confidence man, fixtures in the late 18th and 19th century who swindled the victims with their confidence. right now that all's bravado is the defining feature of donald trump's attempt to win back the oval office. remember, this is the man who tried to destroy our constitutional republic live on national television and who utterly failed in overseeing the one national crisis he had to guide the nation through the pandemic. and yet trump and his surrogates are constantly telling voters to ask themselves a question, are you better off than you were four years ago? >> are you better off than you were four years ago? i don't think joe biden can run on the question of are you better off than you were four years ago. >> that is one question he is praying that he never hears. are you better under four years of joe biden were four years of donald trump. >> you know, people are saying to themselves are we better off four years ago or are we better off now and it wasn't even close. >> that, by the way, was all from the past week. we have been running a series on "all in" responding to that question because the events of four years ago were so shocking, unprecedented, and traumatic. i think a lot of people, i would say most people including myself, have blocked it out. again, i get it. i don't want to think about sitting inside trying to homeschool my kids or attending zuma for my dearly departed uncle or the images of packed hospitals and dying saying goodbye to their loved ones on ipads. of course the fact that most people don't want to think too much about 2020 is an enormous advantage for republicans and the trump states reporting a jump in hospitalizations, the best indicator of the viruses toll. >> we are really doing a financial comeback. the jobs numbers are fantastic. >> 1.5 million people filed front employment last week, almost 43 million since the pandemic began. >> i think the economy next year will be maybe the best it has ever been. we are already seeing the stock market going up, because you have a lot of smart people betting on exactly what i'm saying. >> a selloff from wall street amid new concerns about the continuing spread of covid-19. the dow plunging more than 1800 points, its biggest drop in three months. >> a very important time in our country. a lot of things are happening and i think when it all ends up it is going to end up very good for everybody. >> there is growing concern tonight that restricting restrictions is causing an increase in covid-19 cases. >> all lives are precious, not just the people infected by covid, but also the people who are being driven to this because of the lockdown. >> what is happening in some of those places. that shut down. the poverty rate is going up. what are people going to do if they don't have jobs to go to to earn a living in order to take care of their families? that is the main reason. all of these scare tactics, they don't work this time around. they will not work. >> i should note one week after herman cain made that appearance on fox news, he attended donald trump's indoor rally. a big, indoor rally in the midst of covid in tulsa, oklahoma and by the end of june he was hospitalized with covid and died on july 30 at the age of 74. naturally every time we do one of these segments i find that looking back at four years ago brings a lot of emotion. most people divide recent history into the before times and the after times, myself included. a lot of us feel nostalgia for the before times and that is exactly what donald trump and his allies are using to build their lie about what really happened. to erase our real memories and implant false ones. that is their project and it has been unnervingly effective so far. four years ago in june, 2020 while we were living through the pandemic donald trump's approval rating was 42%. and when a new poll, 47% of americans say they approve of the job that trump did as president. it is not much, but those five points are basically the margin of the entire election and they are accomplishing that through flat out lies about what is actually happening. take a listen to missouri senator josh hawley doing this today. >> he's going to run on his record from four years ago versus biden right now. gas under president biden, up 55%. groceries, up 40%. wages down 3%. that is the campaign. that is before we get to crime, before we get to the border. >> sorry, josh hawley. wages are up. average hourly earnings are actually up 17% from may, 2020 two 2024 in nominal terms, like groceries and stuff. wages have also outpaced inflation for the past 13 months as the washington post pointed out today. crime is way down. look at what has happened with the homicide rate. in 2020 when donald trump was president, he ushered in under his presidency the largest ever one year jump, spiking 30%. by 2023 the homicide rate had tumbled 19% to 5.3 per 100,000 people. new data shows the rate continues to drop dramatically, down another 20 -- another 26% in the first quarter from the same time period last year. gas prices, are, i will admit, overall higher than they were in the summer of 2020. why were they low then? no one was traveling anywhere. okay? that is why there were cheap gas prices. refrigerator trucks full of cadavers, yeah, the gas prices were low. and they spiked up in the early part of the biden administration with the war in ukraine, but they have been trending in the right direction and continue to fall even as the summer travel season heats up. grocery prices are coming down. not just with inflation which cooled to 3.3% today, but retailers are actually slashing prices on thousands of islands. -- of items. again, they spiked during the pandemic like they did everywhere in the world, but they are on the right trajectory now and all of this is happening under the incumbent, joe biden. and we are not losing thousands of americans per day to a deadly pandemic. we do not live in a nation in the throes of constant disorder. this time four years ago we were living through the televised murder of george lloyd and the protestant police response that followed while then president trump called for sending in troops. >> across the country was started as peaceful gatherings protesting the death of george floyd evolved into destruction. from new york, where police and protesters squared off in the streets, to portland where the mayor issued a state of emergency and a city curfew. >> the nation erupted into scenes of chaos. violence. and widespread destruction into the early morning hours. in some of the nation's biggest cities, the night spiraled out of control early. >> we had to run -- rubber bullets. my cameraman has been hit. we have also seen tear gas being used. here we go again. this is exactly what it looks like. >> oh. >> whoa. >> can you hear us? >> are you okay? >> reporter: we are surrounded by the police and you saw the way that they dealt with my cameraman. we don't know who they are targeting at the moment. >> i said you have to dominate the streets. you can't let that happen and we are doing it with compassion, if you think about it. we are dominating the street with compassion. >> all that happens under the watch of president donald trump. we cannot say or hear that and if he returns to power i am telling you it is a safe bet that we will return to trauma and chaos. she is a democratic strategist who served as an advisor for the 2020 campaign. they both join me now. doug, i wanted to talk to you because in some ways history and recent history is part of what is being contested in this campaign. the legacy of the first trump year, trump term, and particularly 2020, the four years ago in the famous formulation, as a historian and historian and presidential elections, how do you see it? >> i think january 6 is such a seminal event and for the days after it seemed like trump was toast. everybody was furious that insurrectionists, but lo and behold suddenly mitch mcconnell came back to trump and lindsey graham and they sort of built this coalition and what is it? it is really anti-federal government. that is what trump represents now. that is why we are seeing the american flag hung upside down by conservative justices. and biden is trying to be part of a tradition, presidents club, of all of the other presidents. you saw on june 6, where ronald reagan is. by then saying i represent all of this and trump is sort of the anti-federal government, anger over covid. and that people still feel that their lives became topsy-turvy and they are going to punish whoever the incumbent is. so it is hard for biden to get traction even though as you said, numbers on the economy are good. we are much better off. he has shown great leadership, but communicating that to the people when there is this much frenzy on social media and hatred toward the federal government, it is an uphill battle for biden to get reelected. >> i was thinking about 2010, the elections in which of course democrats lost. the tea party uprising. a lot of that was something similar was happening. which is people were frustrated with the aftermath of the financial crisis ushered in by the republican party. democrats were the incumbent party and they took it out against the democrats and it was sort of classic like we don't like the status quo because things are bad and they were bad, but the reason they were bad is because what had been passed on. there is something similar here where the things people don't like him a totally understandably, the shocks that came out of covid were not the doing of joe biden. subsequent administrations had to fix that and people still feel frustrated with the pace that is happening. >> it's interesting that you bring up what happened in 2010 because i think of the history of the democratic party. to clean up the miss of the republican party and as democrats clean up the miss they have to message against republicans who are acting as if they want the party that let estate into it. four years ago donald trump was telling people to drink leach to cure covid while he was having superspreader events. four years ago people were in their homes watching what you just did in a montage, but we were watching that every day for 24 hours, not knowing when we would see our loved ones and then trying to figure out who we were going to vote for when it comes to the president to get us out of this. you know, policy for people to feel it in their pocket books takes a very long time and while you mentioned some great reports for the biden administration, even the global economic report this week that said the global economy is strong because the u.s. economy is getting strong, but people are not feeling that yet. that is not the fault of president biden. that is the unregulated corporations that republicans are blocking anything democrats want to do around this. this debate coming up, president biden will have to figure out how to message that as well as the surrogates and people talking about this between now and election day so people understand how they are not feeling this, even though these historic numbers are bringing us back to a place that the american people really want to be. >> you know, doug, i think that before times nostalgia is powerful and i think there is another thing in play here and i would like to get your thoughts on it. my view of trump was always that this is a person who is so unsuited to the job above all else that if and when a crisis comes it will be the worst possible response and then covid happened and it was borne out. i think a lot of people think 2020 is a mulligan. it was a meteor that hit earth and they sort of blocked out the degree of insanity in the crisis management that happened that year and i wonder if you think it is possible to remind them or people are so resistant to thinking about it. >> i think you can and it is going to be imperative that joe biden reminds people, particularly during the upcoming debate with trump. trump has gone through so many legal jeopardy moments and years have gone by and we are running it on television all the time and you have the 34 felony conventions -- convictions. even when that happens some democrats were saying don't rub it in trump's base. of course you have to rub it in his face. you have to call him a felon. biden has struggled i think with messaging in the sense of this economy that has been building. he called it a transitory pain we were having at one point and then it was bidenomics. instead they have to lay out that our economy is doing well. yes, i feel your pain at milk, groceries, gas, but he has to be the happy warrior like fdr. at times he does that. i felt that when he was in france, talking about freedom and democracy, but other times he gets in a bit of a defensive crouch. you can't be gerald ford with whip inflation now buttons. you can't be jimmy carter, the malaise or crisis of confidence. presidents get reelected with a sense of victory and optimism and better times are yet to come and obama when he ran, he had the killing of osama bin laden which gave him the foreign policy credential that people clearly understood. the revenge of the 9/11 disaster. >> the sort of past versus future -- obviously you have two individuals, one is who is 78 and the other is 81. in some ways donald trump is the recent past and i do wonder if because the past four years have been so dramatic and disruptive, people want to go back in time and that is part of the allure. >> i think people want to go back in time when there was what they felt was more certainty. with covid there was such uncertainty. the racial unrest and then we saw january 6. hindsight is 2020 and for some reason some people as though they -- people feel as though they were better under donald trump. that wasn't the case. i think we have to make sure that president biden, and i hope his campaign is listening, that he simplifies his message. he has always been the comforter right next to president obama. be that president and then talk about the ways not only has it gotten folks out of this, but he will continue to do so if they give him four more years. along with a congress and senate to keep doing this work. >> alencia johnson and doug after his father. yesterday hunter biden got convicted in federal court. the scandal machine has basically run out of fuel and now out of desperation republicans are demanding attorney general merrick garland release the audiotape of president biden's interview with special counsel robert hur. what? even the republicans already have the transcript. today they voted to hold the attorney general in contempt. congressman joe neguse of colorado is assistant democratic leader and member of the judiciary committee and joins me now. congressman, what was this all about? >> good evening and good to be with you, chris. unfortunately it is a sad state of affairs in washington, d.c. as extreme house republicans have once again found a way to weaponize what are very constitutional and serious tools that the congress has at its disposal. in this case, as you articulated, they pursued a baseless contempt resolution against the attorney general. by way of background as many of your viewers already know, the attorney general fully complied with the requests made by the congress. the department of justice produced over 90,000 pages of documents with respect to this inquiry. more by the way, chris, then the entire department of justice provided during the course of the trump administration and also produced the transcript itself of the president's conversation with the special counsel. the contextual reasons house republicans offered for purposes of the audio were clearly a smokescreen for what was a political exercise. they wanted audiotapes to use them for a campaign commercial and the attorney general cited a number of reasons why ultimately that tape could not be provided. the president invoked executive privilege and republicans in the house of course know that to be the case, but they proceeded anyway. unfortunately i think it is shameful and disgraceful and we will have to see what comes next in the clown show that they have perpetrated on the american people right now. >> you know, two things i want to note. the republican who voted against it said as a former prosecutor i cannot in good conscience support a position to score political points. the american people expect congress to work for them and solve policy problems. enough is enough. second of all i want to make sure that i have the events right. merrick garland appoints a special counsel to investigate the president. the man that he appoints is a republican who is a donald trump appointee in the justice department. this individual asks for an interview which the president voluntarily complies with i think for nine hours despite the fact that donald trump never gave an interview to robert mueller. he then uses parts of that interview to take political shots at him in the opening introduction. they release the transcript and all of this is deemed, what? partisan by the republicans? how far can you possibly go? the answer is nowhere. there is nothing you can do. >> that is the question and it is an open question. you articulated the timeline well. i would offer two amendments. one, this attorney general produced as you know the special counsel report in full, unredacted. very different compared to attorney general bill burr. i remember as we dealt with subterfuge with respect to the special counsel investigation and in this case the special counsel testified in front of my committee, as did the attorney general as recently as last week. this is a farce. house republicans know that. it is a way for them to up skate their lack of days for them to obfuscate their lack of an agenda. they prefer to spend time on these political games, which is unfortunate. >> it is not a coincidence the timing between hunter biden's conviction yesterday and this. this is the new york times reporting. mister trump who aggressively attacked hunter biden in the 2020 election has changed his mind about doing so now. trump said republicans needed to be careful not to go overboard because it could elicit sympathy and make people view the president as a caring father. so they spend years chasing this guy to the ends of the earth. they successfully, let's be clear, they basically successfully control this investigation. the prosecution happens and now it is like we've got to light a new fire because that one has burned out. >> look, in their view the circus must continue. their message is not resonating with the american people, so as a result they will continue pursuing political retribution at every turn and of course this is not the first time. they pursued seven or eight different impeachment resolutions at various points in the last 18 months against a variety of cabinet officials. they impeached secretary mayorkas. that was dispensed in the senate without a trial. the attempted impeachment of president biden failed. so i have no doubt that unfortunately these games are going to continue for some time. hope springs eternal that perhaps some in the republican caucus will do what representative joyce did today and ultimately speak truth to power and do the right thing and join us in getting back to the business of the house. >> congressman joe binding ethics package for the court. it was blocked by the top republican on the senate judiciary committee, senator lindsey graham. joining me now is senator jeff merkley, one of several democrats who took to the senate floor arguing why the ethics package should pass. senator, it is good to have you on. first, tell me what the act fix -- what the ethics package, what would it do? >> it is so straightforward, chris. it says they would have to have a binding code of ethics at least as strong as the house or senate has. what applies to the executive branch, what applies to other judges, what applies to members of the house and senate applies to the supremes as well. >> that is like what congressman raskin and ocasio- cortez were talking about. you could not do it as a senator. you could not do it as a mid- level engineer at the department of the interior and you could not do it as any other federal judge. >> chris, it is just phenomenal. think about what this looks like. it is mega yacht trips. indonesia. tuition for family members. luxury rvs. helicopter flights. you name it. $6 million of gifts over the last 20 years. here is the scenario. for an average person hauled into court and somebody sues you and you find out the person suing you has been going on fishing trips to alaska with the judge. would you think you are getting a fair shake? that there is any possibility of justice in that situation? the answer is absolutely not. that is a profoundly corrupt court and that is what we have today. >> i think, well, i don't know what the logic is but i think republicans say this is all partisan. the reason you are doing this is because you don't like the rulings in the court, you don't like the ideology, so you are trying to attack legitimacy to a road power for purely ideological and partisan reasons. >> certainly if republicans want this court to have the force that comes with integrity and respect of the american people, then they should be the first to step forward to clean up this miss. it is in fact a miss and certainly i believe that these justices on the right who were trained and selected by the federalist society to deliver power on a plate to corporations in america, are deeply, profoundly warping the constitution. in favor of corporations and against consumers and environmental laws and many other things. this issue of accepting massive gifts from people who have issues before the court, that stands on its own. separate from any dispute one might have. >> i want to redo something that sam alito said last summer in an interview with the wall street journal to a lawyer and a writer there. he said i know this is a controversial view, but i'm willing to say it, he says. no provision in the constitution gives congress the authority to regulate the supreme court, period. what do you think of that? >> it is called legislation and the constitution does give legislation power to the congress. it gives the ability to put a code of ethics on the executive branch. yes a president can veto it, but we can override that veto. certainly there was a sense of while the constitution said little about what the court system would look like, there were massive decisions made by congress to decide how the judiciary would be structured and run. so absolutely that does not pass any sort of common sense or legal examination. >> final question and quickly. on the question of having the chief justice come before the senate. he has basically blown off an inquiry from the chair of the judiciary committee who reached out to him. samuel alito has written to say i am not recusing myself. basically they are like, you are not the boss of us and we don't have to listen to anything you say. is that a tolerable equilibrium? >> it is not, because they are basically saying we have the right to be corrupt and you can't do anything about it and that deeply undermines a key institution in our country in which we need to have a sense of respect. a sense that it delivers the balls and strikes, as justice roberts once said in his confirmation hearings. right now we are getting profound conflict of interest and that is really sad to hear. chris, here is the thing. justice roberts, in running this court, he has to recognize that he is failing in his responsibility to run this court in a fashion which delivers fairness and a sense >> first and foremost, a ceasefire. first and foremost, a ceasefire. this is elementary. this is like when there was a ceasefire, hostages came back. now, -- they happen here and there, they are not a strategic solution to the problem of 120 people still kept in captivity. you know, during seven months of military operation israel succeeded in releasing seven hostages alive. this is, you know, a pace of one hostage a month. eight months, even. so 120 hostages would take ten years time. the hostages have no time. the sanitary conditions are nonexistent. the health is deteriorating by the day. physical and mental. and we must find a way to bring them back home as soon as possible. these are not, you know, these are not only young people, these are elderly people, grandfathers and parents and uncles and people that were taken from their beds at 7:00 a.m. on a saturday, you know, in their pajamas and barefoot sometimes, yeah. >> in the u.s., one of the things that people -- there has been kind of a joining of the notion of the war and the justness of it and doing it on behalf of the hostages. many people feel that the war is on behalf of the hostages, and people think that those, you know, who are calling for ceasefire are betraying them or forgetting about them. and you wrote this open letter that basically argued the opposite. and so for people that are -- people of good faith across the spectrum on this very contested issue, i want to hear your argument to them as a family member. >> sure, sure. first, again, a ceasefire. why? the thing that endangers the hostages the most right now, idf bombing. this has been from october 8th ongoing where my 9-year-old cousin's son was asked during an interview after he has spent 49 days in gaza captivity, he was asked what do you feel most about your grandfather still being there? without hesitation he answered the idf bombing. the idf bombing endangers the hostages, and the idf bombing, actually, we know about 14 hostages that were killed either by direct hit by the idf or, you know, as -- after an idf attack, the attackers needed to evacuate the space. they killed them, so you know, the military operation endangers the hostages. it got seven hostages out, 14, at least, dead, and this -- the whole military maneuver is not getting -- it's not for the hostages at all. it's not helping them. on the contrary, it gets them further and further away from the hostage deal, further and further away from getting united with their loved ones. because we know that the conditions for the hostage exchange or the prisoners exchange or whatever you want to call this, getting them back home is first, ceasefire. and by waging this war from day one, the israel government initiatives of this military operation is only keeping us apart, keeping us further and further apart. at the beginning it was only northern gaza, then it was rafah, and before that it was elsewhere, and we're just getting further and further apart from a solution to this problem, because the solution should start with a ceasefire. this is, you know, logical and basic. >> a spokesperson for the group of hostage, his uncle held by hamas in gaza. i can't thank you enough for making time for us. we're all thinking about you and your family. >> thank you very much. and we pray for the safe return of all of the hostages as soon as possible. this is a humanitarian issue. this is not some political issue, and people trying to make this a political issue, especially, the government trying to make this political. no, this is a humanitarian crisis. and everything should be done to get them back as soon as possible. thank you very much. >> that is all in on this wednesday night. alex wagner tonight starts right now. good evening, alex. >> 250 days, just unbelievable this is where we are. thank you, my friend, as always. so i want to start with a story that in any other universe would have absolutely nothing to do with politics or anything even approximating controversy. the kind of news we all used to read or hear and accept. but in the post-trump era, this

[laughter] >> steve: okay, more with brian in a minute but, first, a fox news alert. president biden is about to take off for italy in just about an hour from now for the annual g-7 summit in italy. >> lawrence: here at home concerns of terror threats crossing our southern border are becoming a reality as sources say 8 suspects with possible ties to isis are arrested after being released into the country. >> ainsley: lucas tomlinson joins us now with the latest. lucas lucas good morning, guys not only did they enter illegally through the southern border they apparently received, quote, full vetting according to our own bill melugin, suspects are from tajikistan the land locked country infantry in central arab borders afghanistan to the south and china to the east. recall the same suspects on that concert hall killed 45 people. those people were also from tajikistan. said in a statement to fox fbi says the individuals are detained in ice custody pending removal proceedings as the fbi and dhs recently described public and private bulletins heightened environment. dhs continue working around the clock with our partners to identify, identify and disrupt potential threats to national security. the suspected terrorists were arrested in los angeles and across the country in new york and philadelphia as well in recent days according to the "new york post" who broke the story, quote: part of the investigation featured a wiretap which revealed one of the now arrested individuals was talking about bombs. remember the boston marathon bombing, i'm afraid something like that might happen again or worse fbi director christopher wray warned lawmakers back in april what he described as threat coordinated attack after the moscow massacre those suspects were from tajikistan like the suspects here. >> ainsley: i know they weren't flagged when they walked across the border when they came across the border. they were let. in once they were here, what led them to realize these guys were terrorists? >> lucas: it appears there was wiretaps. >> ainsley: what made them go to that point? what made them wiretapped? >> lucas: americans being surveilled. apparently picked up. also somebody could have called in a potential threat for these guys and people were warned. this is the problem americans have been worried that something like this might be happening for years now. as millions of unvetted and illegal immigrants cross the southern border. >> lawrence: so luke's, the question is the president released his executive action last week and banning some countries and all of that did they know about this before they released that executive action or did this come afterwards? >> lucas: these guys have been on the radar now for a few weeks, lawrence. safe to say, before. >> steve: indeed. luke's, thank you very much. and keep in mind, he just mentioned christopher wray, the director of the fbi was in front of congress in april. and he was talking about a potential coordinated attack after what happened in that concert hall. our joint task force keeping an eye on everybody. i bet a dollar to doughnuts something popped up on one of the people were surveil surveilling. oh they are in the united states. joint task force alerted ice they swept them up in new york, philly and washington, d.c. >> lawrence: brian, the fbi director has been talking about these lights flickering all over the board. he said that he is concerned brian they thought their executive orders -- they think their executive orders are going to do it. so far no discernible difference between prior and current with the executive orders. got to worry about all the stans, these guys are coming from outlaw provinces moscow and don't have love loss for us. it's really got to be cancer. if you are christopher wray. you know the danger but it doesn't seem to be relayed to the people in charge and the border patrol seems flat out overwhelmed. i also thought it's interesting, too, that we're seeing the flood of immigrants come through san diego now, california, but they knocked it down 72% in texas at the cost of $11 billion with operation lone star. texas is doing it themselves because the federal government is not. >> steve: that's right. great point, brian. that's one of the reasons you are down in texas. meanwhile, border patrol, ainsley to your point, border patrol let them in. these people, because they presented id but apparently those particular names didn't click on the data base. and border patrol says we know people slip through all the time but we simply don't have enough time to fully vet them. if there is 300 people waiting in line. it's kinds of like how long is this going to take? >> steve: all right, brooke. thank you very much. the cover of "the new york post." first felon faces up to 25 years after historic verdict. and i heard on one of the other channels that apparently, you know, the jury got the case a couple days ago at 3:30 in the afternoon. they deliberated for about an hour. >> lawrence: they were 50/50. >> steve: it was split 6-6. a couple hours into the second day they were like, okay. he broke the law. and here's the thing. we knew he had broken the law because he signed that thing. and we know he put that x there. so it's one of those things where if he were not convicted on this, what does it take to get arrested and convicted in delaware? >> lawrence: when you look at the other channels and look at their conch of it, there is this reaction to compare what happened here and the justice system what happened to trump. and they say this is the legal system doing what it does this. is the right thing. but, i think they skipped the important step, this wasn't going go to trial at first, this was not -- there was unprecedented deal, and if they weren't shamed, both the prosecution as well as the defense with this deal, then we wouldn't have been here. now, you take that versus donald trump where you have unprecedented prosecution. not unprecedented deal. and i think there is a clear difference judicial system shouldn't be shamed. i get that everybody has someone, probably. i know i have family members that have struggled with addiction. >> steve: yep all of our family members should be treated the same it. looks like hunter biden is finally being held accountable like most americans would have ainsley. >> and, brian, we will bring you into this, too. the trump campaign said this is just a distraction from the real crimes, the real crimes are the biden family which has raked in tens of millions of dollars from china, raush and ukraine. what we learned in this court case the laptop really was hunter biden's. we knew that before. this is additional verification of that. which means we were lied to by those 51 intel individuals that signed that letter back before the election and joe biden. who lied to us about it. anbc, and cnn and npr who lied about it. social media individuals or social media platforms that were censoring this story so it didn't get out before the election. it's not just about addiction and lying on a government form. this goes beyond that the cover-ups. the money that the biden family possibly made from all of this. before the election. and burying a story so that you didn't know about it. you, the public, the voter didn't know about it before the election, brian. >> brian: yeah. a couple of things. number one out of everything on that laptop it's absolutely insane the one thing they get is the gun charge. on unsavory behavior that's witnessed there they all told us we are crazy for believing and definitely effected the 2020 election. also i think it's important this guy kevin morris who is funding all his legal defenses out of money. how do i know that's not hype. his daughter raised to hunter biden you are taking advantage of my dad who is writing checks for you. yeah. his dad is the president of the united states. he can't write the checks. but some obscure producer who made money early on and a sitcom nobody watches could empty his account for a guy who can't get off crack and obviously loves hookers. other thing is, the big story is coming up in the fall is going to be the tax case. and what about the made for tv moment, i'm sorry, my heart does not go out to joe biden who has to go back to his house and stand in front of his driveway and hug his son who got convicted of a buying a gun and having haley biden throw it out while, by the way an hour before he was telling us the need for gun control. who booked that gig for him the day his son is actually. >> lawrence: that was so dumb. >> brian: actually convicted of a gun violation. the dumbest thing ever but smart to have the hug in the driveway so msnbc has something to talk about. and they want to say it's no dual path to justice and trump got convict and he got convicted. it's totally different. this guy actually scripted his conviction seven years ago. they made up charges on donald trump and didn't even tell us the charges until they handed it over to the jury. and when you come up and speak about a jury decision and don't like it, that's called an american free move to do. you are not being anti-american by criticizing a jury decision. is everyone happy with the way the o.j. decision came out. are you anti-american by saying o.j. pretty much got away with murder? justice seeming to endorse a fight to return our country to a place of godliness and quote it was a liberal activist and filmmaker who secretly recorded the justice and his wife at a supreme court historical society dinner earlier this month people in this country, we're leaving that, keep fighting to return our country to a place the bottling names. >> i agree with important to underscore during that dinner, the activists misrepresented herself. she claimed to be a religious conservative the executive director of the supreme court historical society issued this statement on monday saying, quote, we condemn any sort surreptitious recordings of justice's at the event which is inconsistent with the entire spirit of the evening. attendees are advised that discussion of current cases, cases decided by current sitting justices or justices, jurors, pure prudence is strictly prohibited and may result in forfeiture of membership in the society earlier. in the conversation, the activist told alito that she didn't think that the right could negotiate with the left. >> here was his response one. >> side or the, other. >> there can be a way of working, our way of living together it's different because they're differences fundamental things that really can't comment so it's not like you're going to see what the difference a little hard to hear their finals here. >> molly ball, senior political correspondent at the wall street journal, meghan hayes, former special assistant to president biden, and matt gorman, the former senior adviser to the tim scott presidential campaign. welcome to all of you molly ball. >> this of course, i think underscores the pressure that alito is at the moment in our highly charged political environment where the justices are about to decide whether or not donald trump is immune in the january 6 case clearly, he's in a situation where he is responding in the affirmative to someone he is encountering at a party and yet the remarks are still illuminating in terms of how he thinks about things. yeah. i mean, i think as you said on the one hand, we've all done the thing where someone approaches you that you don't know and you just kinda play along. you just sort of say you're agreeing with whatever it is that they're saying. i'm either end it's no surprise to anyone that he's a conservative right, and that he does view, society as, as somewhat corrupted by a lack of godliness or i wouldn't be surprised to hear him say any of those things in a judicial opinion for example. so it's all pretty broadly consistent with the judicial philosophy and the political philosophy that we know that he subscribes to. i think also the fact that the recording is coming out tells you that increasingly the supreme court is being treated as another political branch of government. the people are sending trackers after them basically like they would with a political candidate monitoring their every utterance and looking through it for potentially damaging or politically useful bits of audio that, that can be used against them in what's essentially become a full-time political campaign. and that i think as we and others have reported, has contributed to a very high level of tension and division on the court itself has made it increasingly difficult to function. >> yeah, it's it's speaking of division on the court itself. >> i mean in this highly fraught moment that we find ourselves in as a country where there does seem to be this kind of looming question about violence. certainly we have had more violence in our politics in recent years than we had seen in another monitor campaigns with what happened on january 6, john roberts was also approached by this activist and he approached this very differently and it underscores a little bit of tension on the court as molly was just touching on. again, john roberts, appointed by george w bush. he is the chief justice. he is also a conservative but has carved out a much different kind of role for him self on the court. so when he was approached by this activist and some of these same themes of godliness. the question i believe was is the us a christian nation? >> here's how john roberts responded since i put here a little 20 years, i've been quieter times but the idea that the court is in the middle of a lot of tumultuous stuff going on. that's nothing new. >> the civil war, we did that very vietnam. you people getting killed and i was there. >> this is all right. i mean, it's it's not all right. but it's not like it's dramatic medically different people that's a common thing. people, their own perspective like this is so slow ordinary i don't know. >> heed the christian nation question. robert's actually responded that he has jewish friends, muslim friends who might disagree with that. he went on to talk about it a little bit, but megan haze, there. he was saying he was talking about other cataclysmic periods in our history, the civil war vietnam basically saying that we're going to be all right in the end. what is your view of all of this? and the way it's an unfolded, but particularly this difference between alito roberts here. yeah. i mean, i do think that we're gonna be all right. our democracy is built to survive and hopefully it will survive regardless of who wins the election in november. but i do think that there is a difference here, and i think that there was a difference. if you listen to alito's wife and how she responds and her reaction system of the questions that she got are also extremely stark. and so just just goes to show how these justices are thinking and how that they are forming their opinions. and it is, it is quite different and it is jarring when you hear their responses. >> let's listen to a little bit of what martha alito also who was approached by the same activist again, here's a little bit of what she had to say you know what i want i want sacred heart of jesus flag because i had to look cross the lagoon at the pride flag for the next month. >> exactly and he's like, oh, please don't put several my heritage come after me away. it doesn't have to be away. >> debris don't worry about it okay. >> she also said that justice alito doesn't control her at one point. but you don't seem to admit their that he did ask her not to put up a flag in this case. >> definitely go we put the flag up let me look at this whole thing. i saw on twitter the person lauren windsor put up, that this is gonna be a big undercover storage tweeted out, tease that out. before it came out. and then when it came out like this, this is what this is. i mean, this was the same person that was the one reported by the intercept who sent the kind of democratic activists to charlottesville, dresses neo-nazi would tiki torches to kind of stand outside the glenn youngkin's yvette. but with the lincoln project. so i'm not getting i'm not surprised by this, but i will say that i think a lot of what molly said his right. it's also just his religious philosophy makes no bones that he's a devout christian now, i was at church over the weekend and a lot of those same themes. it's country but more about the world gold and sin and godliness. those same themes or what kinda prevalent. church, i'm really not surprised. >> i mean, i think that the piece of it that i really i got caught on was where he seems to go on and say that there may not be a way to resolve these differences ever, which i suppose is part of what you're saying. >> i mean, it's it's again, i think we stepped back from the politics of it. i think the way the christians look at it is sin and whatever faith i'm not putting it very eloquently. the priesthood better job in his homily over the weekend. >> but but no, i think that is more of the way that he was talking about it for me again, he's devout christian. >> i don't really see what the the big thing is, megan, but these people, i just think our supreme court justices sort of need to rise above this. and i agree with molly that like we've all been in a situation where you just like nod and say, but he went further and then when his wife's comments, it just shows that like they're they're not viewing themselves as above and making laws for our country. >> it was his faith like it was not, it was not about politics. they're talking to say, it also she was goading him. she would want to introduce scholarliness into it. she was the one that he's just agreeing. >> yeah, i agree. like it's these ideas weren't germinated on testify in this historic case. >> it's the first criminal trial against the child of a sitting president. during closing arguments, prosecutors tried to convince the jury that hunter was a drug user at the time that he purchased a gun six years ago, saying, quote, hadi continued to use narcotics smoke, crack every 15 minutes throughout 2018 and decided not to buy a gun. >> we wouldn't be here in this courtroom. >> choices have consequences. and that's why we're here later. hunters defense attorney argued the prosecutors case was similar to a magician's trick, adding quote, there is nothing there. joining me now from wilmington, delaware is alex thompson, the national political reporter for it? axios, who has been covering this trial day in and day out. alex, wonderful to see you how just catch us up with what you saw in court yesterday during these closing arguments. and i want to dig into how the family in particular is playing into this because my understanding is the jurors were told not to be intimidated by the fact that it's the families the president of the united states yes. >> so yesterday you saw bolt very lengthy closing arguments, i believe abbe lowell hunter biden's lawyer when for about 87 minutes and then the prosecution got two shots at it and they probably got about the same about 87 minutes. and to your other points the prosecution said, if they have not proven that hunter biden was a crack addict than no one is a crack addict. and it got a little chip between the two sides. abbe lowell at one point said that the prosecution had been quote enormously cruel two naomi biden hunter biden's daughter, the president's granddaughter, and how they cross-examined tr the government came right back and said it was then who put her on the stand that put her in that position. and it was hunter biden who according to text messages tom had been erratic and texting in the middle of the night and had i think they've put it as said, blowing her off and so it got very personal in terms of how the family yesterday was the most family that we have seen in this trial. you had aunts, uncles cousins, the cousins, spouses. it was at least a full thing and it was interesting that both sides, in their closing arguments made you made allusions to the family. now, abbe lowell hunters lawyer has been really trying to portray hunter as a family person and has been referencing the family as as part of that that he is just i think one of you, whereas the prostitution is basically saying what? you just alluded to, which is don't be intimidated. this is not these people are not evidenced. these people are not really part of the trial how would you describe kind of the the mood among the biden family members who attended from what? you could observe it, what did what did that feel like yeah. i think they you can see a little bounce in their step after abbe lowell's closing, having just a fulsome 87 minute defense from of hunter when i think a lot of the family feels he has just been hit day after day after day for the last several years and i think i even saw bowel biden, the president, sister give them a go, give abby go, get them. right? right afterward. but after at the very end i don't think the family likes being at felony trial for joe biden's son, and you could tell there were certainly moments ashley biden in particular, the president's daughter and hunter sister has you been very emotional at moments in this trial having to leave at some point, plate lots of tears. and you can tell it's been harder on some than on the others. >> one of the arguments that came up was about hallie biden one of the attorneys said quote, poor hallie biden knew had to be dragged through this period of her life. again, who understandably did not remember a lot of the details well she remembering what she saw that day or dozens of other days when she too was using if you notice, she could remember what the prosecutors asked her. the prosecutors are also gave her immunity, but not so much for any number of things so that that i guess coming from from abbe lowell well, it clearly they felt like they needed to defend other members of the family. two, how did that fit in this been a key part of hunter biden strategy from the very beginning, which is to really try to undermine the credibility of hallie biden, who's beau's widow, who is also his sister-in-law. >> and the reason is because her testimony he is, very very troubling if you're a hunter, biden, the fact is that she was the one that found the gun. she and when she testified that when she went into the truck, she found crack cocaine, paraphernalia, suggesting that he had been smoking very recently, that she found powder that day, which also suggested he'd been using am was the one that he was texting during the period he had the gun in which he said that he was smoking crack and this goes to a larger sort of dynamic within both the defense and the prosecution, which you at the very end of the day beyond the facts that case, i think it will really come down to you. do you relate to hunter biden or do you resent hunter biden and the prosecutor? the hunters team at basically wants to make you think he's a family man that he was suffering from a disease that he's one of you in delaware home grown. whereas the defense is saying no, this is a bad guy. this is the guy that what the little details that he was trying hundred $51,000 in cash withdrawal and just three months that he was a millionaire, that he was yael educated, that he gave $800 to his 24-year-old girlfriend to buy clothes for his daughters. these little details that are meant to portray a different sort of person and that may end up being the difference maker with this jury all right. alex thompson for us this morning. alex. thank you very much for that. meghan hayes, can i ask you, you know, someone who's been in the biden family orbit? how this all mean as alex said, that they entire family has shown up for him at this trial. understandably, but it's gotta be weighing on the president who of course has not made an appearance at the courtroom. >> yeah. i mean, i don't think anybody hit this table. be surprised. a hunter is at the forefront of the presence minor, it adds, it's an extremely challenging situation. he's a dad first and foremost, i think he said that in his statement, but i do think that this is someone who is an addict. he is a recovering addict right now and i think that the family is concerned and i think that's showing up to be supportive of him. i think that's what families do is show up and support people when in their time of need. >> all right. >> let's turn now to the 2024 campaign trail where donald trump de, virtual mark remarks yesterday to the danbury institute it is a conservative christian group. they call abortion, quote, child sacrifice, and quote the greatest atrocity facing our generation today trump, who just two months ago said abortion should be left to the states, didn't explicitly mentioned abortion during his remarks. that's an admission that for the presumptive nominee of the republican party says a lot about the politics of this issue in a post-dobbs, america. instead, trump said this we are a seriously declining nations, seriously serious and so sad. i know that each of you is protecting those values every day and i hope we'll be defending them side-by-side for your next four years. these are going to be your years so matt gorman, i mean, he obviously is trying to tell them something that they want to hear, but to not mention abortion at a group like this. i mean, it just shows what a tough position any republican is in, in a world where in the hopes that you can raise the salience of some other issue, right. so if you're a democrat to ignore immigration and just tried to talk about abortion where you feel like you have a better message there is a school of thought, i think in both of these camps that says no, you have to go at it. you have to say to voters, i understand why you think this is important and here is my position so that they're not left guessing. so republicans have been having this active debates since the fall of roe, saying we do have to have a message for voters about abortion. we do have to have something to say to them. otherwise, we're just going to get clobbered and i think you've seen democrats on immigration, the same thing. a lot of candidates have tried to avoid the issue, but there is a new conventional wisdom on the democratic side that says if you do that you're just gonna get killed on this issue. that is important to so many voters. you do need to have some kind of positive message, even if it's not necessarily going to be popular because in both cases, the parties are on the wrong side of these respective issue really interesting way to think about it, okay the house what will this resolution ambassador do to get both sides? to accept this deal? that's currently on the table i think the resolution is actually the opportunity to pressure hamas to accept the deal. ceasefire this is an important effort that was made with the support of the qatari government and the egyptian government working with us on the ground as you said, you say, the israeli government has accepted this deal. >> that's currently on the table. but does the israeli leader, prime minister netanyahu, need to accept it himself he's avoided that but i can't speak for prime minister netanyahu. meeting yeah. >> i think it's important to note that this was a psi that was conducted after a jury verdict. so when a defendant pleads guilty, i think you can expect these introduced to take longer because at that point, most defendants, but they've already accepted responsibility. they're going to show some remorse. they're going to explain why their actions are bad. they're going to use that time as advocacy to tell the judge probation through the judge threw probation, why they should be giving a more lenient sentence. i think it's not unexpected that today's interview was very short because the former president wants to maintain his fifth amendment right. he's going to appeal. he is going to maintain his innocence so i think today it was just simple questions. he was not going to go into the conviction. todd blanche was there with him, so he was just going to talk about his education, his his characteristics, how long he had lived in the state of new york, probably as residency in florida and just very basic background because really that's all he could safely share it's interesting, tim, because todd blanche's attorney was there with them coaching and presumably about this probation interview that was going on, how do you think trump is handling it? >> what do you think he's trying to do? >> well, i mean, he's obviously he's not happy about the conviction itself. and so i think that todd is trying to keep him on task of let's just talk about the issues here at hand and is released. just said when i have a case like this where it is a verdict after trial you would tell the probation officer, hey, don't ask him any questions. he's going to invoke his fifth amendment rights. so just stick to the history of biograph biographical information. so i think that the idea of donald trump being interviewed by a probation officer about where did you grow up tell us tell us your parents names and things like that i'm sure that he finds it somewhat direct, degrading, but it is the same thing that every criminal defendant in that courthouse go, sir yeah. >> that's an important point as well. judge. grass. so what do you make of the fact that this interview lasted what, a half an hour? >> well, i agree with what the other panelists said. >> we wouldn't really have expected donald trump to go on at length about a sense of accountability and the things he's learned from this type of a situation. i think it was pretty perfunctory i mean, if he wanted, he could have tried without it without admitting anything or accepting liability for the offenses that he's still going to appeal on. he could have tried to maybe couch and in terms of while i don't think i did anything wrong, maybe we could have done things better along the way. some sense of humility or something like that, because the bottom line is this probation officer, is going to be making a recommendation to the judge on sentencing. the probation officer could very well recommend jail or prison time in this case so theoretically, a defendant might try and appear contrite. i doubt that happen here just from what we've seen being in court every day and the general persona of this defendant. so putting all of that in context a half-hour is not surprising at all at least i didn't think today's interview that trump had with his probation official will impact judge varchar decision on july 11 to announce sentencing. yeah, i don't think it'll have that great of an impact these sentencing recommendations are meant to be persuasive. so i think judge merchan will take it into consideration. but once again, since this wasn't a very fulsome interview, the defendant wasn't sharing a lot of information that the judge will take into account. and then i also understand from new york legal expert tim, that the psr is in new york state are not as robust as they they are in the federal system, in the federal system, the probation officer does their own investigation. they colored their own understanding of the facts, and they use that as the basis of the recommendation. it's my understanding that that's not the same here. so given the relatively short duration of the interview and the fact that judge merchan presided over the entire jury trial and is very aware of the facts and the defendant and its behavior. i think while it might be helpful, i don't think it's going to impact his ultimate decision-making to trump's team is scheduled to submit its sentencing recommendation. is this coming thursday? what do you think they're going to ask where there are clear then asked for some type of a probation in this case. i mean i think that what they would be smart to do is to focus on not just this case, but the history of what donald trump has done in new york city, they should be talking more about what he did for woman skating rink, what he did for revitalizing the area around grand central terminal, all of the things that he did for the decades before politic some of the positive thing exactly, exactly. they should talk about all the positive things that he's done for new york city and say, in light of all these wonderful things that he's literally changed the skyline the line of the city versus these false business records. this is not something that even accepting the facts as the prosecution claims them is something that he should get jail for, especially for class e felony with a cooperating witness who admitted to a class c felony during the trial, where somebody is no criminal history. so i think that they have a very good argument for some type of probation the difficulty is going to be of course, the prosecution is going to point out everything that he's done as far as violating the gag order the statement city made about the judge just minutes after the verdict. it's it's a very unique case. >> will know on july 11, what the judge decides everyone. thank you very much. just add a live report now in the hands of a jury after six days of trial, 12 citizens will decide whether the president's son is guilty of three federal gun charges. >> in a major show of support, hunter's family members and pastor taking up three rows in court today have known the parameters you don't abandon your friends and family in closing arguments, prosecutors pointed to the gallery of supporters and said, those people are not evidence and reminded the jury that no one is above the law. the prosecution directly address the most difficult element they have to prove that hunter biden knowingly lied on a federal background check form when purchasing the gun at the center of this case, the defendant knew he used crack and was addicted to crack at the relevant time period, adding that hunter would have been aware from his time in rehab that he had a problem with drugs maybe if he had never gone to rehab, he could argue he didn't know. he was an addict at the end of his closing, prosecutor, leo wise circled back to testimony from hunters daughter, naomi, on friday, when she told the jury that when she returned or father's car to him on october 19, 2018, she did not see any the evidence of drugs, but why is reminded the jury hunter's former girlfriend, hallie biden, his brother, beau biden's widow, had testified that when she found the gun in the same car days later, she found it alongside drug paraphernalia defense attorney abbe lowell countered, warning jurors not to convict his client in properly adding it's time to end this case. he compared the trial to a magician's trick, trying to dupe the jury, saying, watch this hand pay no attention to the other one. he accused prosecutors of cherry picking evidence to present a more timeline of hunter's drug use and said his client was not lying when he marked down that he was not an addict on that federal form. lowell attacks, two of hunter's former girlfriends who both served as prosecution witnesses in this case. he noted zoe kestan took pictures of hunter with drugs, but not in the key month of october 2018. he also reminded the jury that hallie biden could not remember specific details about when she found the gun in hunter's car? and noted hunter was the one who told hallie to file a police report for the missing gun after she threw it out hunter did not take the stand to testify in his own defense in this case. a move that would have come with potential rewards and definite risks the jury will return to court here in wilmington tomorrow morning at 9:00 a.m. to resume their deliberations. >> but it's notable the prosecutors pointed to the first lady and other supporters who are there for hunter and reminded the jury that they don't matter, that suggests that perhaps the justice department is a little worried about that let's show of force for hunter and what it means for their case. but i was in court earlier today and watch the jury. they followed by line by line is the judge went through the instructions but they'll have to follow for this historic decision. wolf paula reid reported for us, paula. >> thank you very much. let's discuss what's going on with cnn, legal analysts. carrie cordero, and our senior political analyst, gloria borger carry lab. you start with you based on the closing arguments. what do you think are the best strongest points of each sayyed that they made? >> well, from the defense perspective, the biggest thing that they have going for them is that the prosecution, if it's going to prove its case, is doing so by info in other words, there does not seem to have been at the trial specific evidence of a witness or documents like a video, for example, in actual physical piece of evidence demonstrating that hunter biden was using drugs at the specific time. what there is is there's sort of tangential evidence of circumstances that would lead the jury to infer that he was using at the time. and so that's that's really what the what the defense will point to the prosecution on the other side is going to say, well, look at all these different circumstance dances. those all add up to a conclusion that he was using and therefore, he knowingly falsified the form. >> well, it was interesting, gloria, in reference to the biden family. yeah. the prosecution said during their closing arguments, they said this, i'm quoting people sitting in the gallery are not evidence. you may recognize them from the news, but respect thankfully, none of that matters. what do you make of the optics of the first lady, jill biden and other family members showing up almost on a daily basis. >> well, i think that the prosecution might be a little concerned that the jury would have a lot of sympathy for somebody with that kind of family support. >> don't forget a lot of members of the jury have gone through issues in their own lives with drug abuse and you have the first lady flying back from france to come sit at this trial. you have his children, you have his pastor you have friends, family. they took up three rows, i guess and that's something that jerry pays attention to. and so it helps in the portrait of hunter biden as not an evil, a drug addict. it portrays him as somebody deserving of your sympathy and your empathy. and i think that helps him think you're probably right. did you think it was the right move for hunter biden not to testify? he could have testified if he wanted to. his lawyers presumably said don't do it. but what do you think? >> i think that's right. i'm certainly any defendant has the right not to testify. and i think in this case, probably it would have opened the cross-examination would have open him up to delving into so many other areas that are potentially would have been counterproductive. so i think most defendants don't testify on around behalf, and i think in this case, it probably makes sense that he followed the advice of his defense counsel not to, you know, in an odd way though, you did hear from hunter biden because you heard from his book in which he audio books, his audio book. he wrote about this. he wrote about his drug addiction and that was used during the trial against him. but it was used. and so you don't voice you did here, right? and you did here? voice. so he didn't testify. but you did hear him talk about his addiction. >> you know, it's interesting. the president has vowed to accept the verdict, but is ruled out a pardon for his son very definitively, if he's convicted, though, how's this going to play out politically? >> you know, it's, it's really hard to say. >> i'm not sure that it plays out that much at all. what congress is worried about. its financial and propriety that may have been committed between joe biden and his son, and they've presented no evidence for that. if you notice, they've been a little quiet during this trial. and if a hunter biden is convicted, i think that there will be some sympathy for for joe biden and for the family and all of this. but i'm not sure that it plays out in a large political way other than the fact that it will affect joe biden himself. i think sure. it will gloria borger. thank you. carrie cordero. merchan now is just over a month to determine how he'll punish the former president for his 34 felony convictions. cnn's bryan todd is taking a closer look at all of this for us, brian, what factors is judge merchan weighing as he decides sentencing? he's weighing several factors. wolf, including what trump might have just said at that pre-sentencing interview tonight, we have new information on the many possible forms of punishment the judge more sean could impose on donald trump i just went through a rigged trial in new york now that donald trump has completed his pre-sentencing interview with a probation official, a report on the interview will be sent directly to judge juan merchan, who has a few options for sentencing. trump, the most serious one, prison time, the crimes for which trump's been convicted, falsifying business records could carry sentences of up to four years, each, with a maximum of 20 years. but realistically, it's unlikely that someone convicted of this type of felony in new york with no prior criminal history would see much if any, prison time trump's advanced age experts say would also be a factor in not sending him to prison he turns 78 this week. another sentencing option, probation analysts say, well, that might be a more realistic choice. it would come with a host of inconveniences and indignities for the former president have it be drug tested, having to check in with a probation officer, there could be random visits by probation officers to your home, not with a search warrant, but they can come knock on the door. you need to let them in. home confinement also might be part of a probation sentence for trump, or maybe a restriction on out-of-state travel. >> if he were going to fly off to another state wisconsin, arizona, he would have to get explicit permission from the probation agency. trump could simply be fine for his convictions or he could do community service where he has to pick up trash on the subways. experts say a conditional discharge could be a sentencing option is a condition of your discharger, your release and you have to abide by those conditions. the court will say, don't get arrested, going, don't get in trouble for the next year or during the pendency of your saenz or for stated period of time. and that's it. you're not checking in? no one's following up with you. there's no probation is no oversight all options, experts say reflective of the striking uniqueness of this situation for the probation department, this is uncharted waters. they have never interviewed someone of this statute before. they know that their work their recommendation is going to weigh heavily in the judgment and decision by judge merchan legal analysts say acceptance of responsibility is often a key factor when a judge considers a sentence. and the fact that donald trump has shown no remorse for the actions he's been convicted of, and has repeatedly publicly attack the judge and witness in this trial views. and they sort of do want someone to be a protector or defender of those views, even if that person is the imperfect individual to do so, how do you think this is going to play with moderate voters out there? certainly that's a group that trump is trying to win over moderate voters, suburban women, for example, how's it going to play? not well at all. will fan this is where i think trump is trying to have it both ways. >> and while it's no question that christian groups, christian conservative groups, who are completely against abortion are going to support him because he is responsible for overturning roe v. >> wade and he brags about it every chance he gets, especially in front of these conservative groups. but then suburban women, moderate voters, and frankly, the vast majority of americans who believed that women should have the right to do what they feel is best for their own bodies and their families they don't support this. they think that roe v. wade should not have been overturned they believe that women should have this right. and they are going to continue to punish republicans and donald trump at the ballot box if they continue to push this massive goal of taking away women's rights and freedoms. and that's how the biden campaign's smartly is messaging this whole issue let's just get your thoughts, your mic alone. >> i have you vice president harris so, but i do think as you talk about the past, you do have to be careful not to have the appearance that you're romanticized and something that was very horrible for the black community. i have grandparents that are still alive who went through segregation. my grandmother was the first to enter into her high school in new orleans and first-time desegregating the school. and so i think there are people that are still among us who have those very real and raw my experiences. and i would hope that republicans, whether they're black, white, or anyone else for that matter, would be sensitive to the experience of those individuals who are still among us that's interesting on another subject, trump is launching what he's calling a latino americans for trump campaign to reach out to hispanic
