Transcripts For FOXNEWS Happening Now 20090827

this picture was snapped on a subway line a couple of weeks back. apparently he never heard of the new york minute. [captioning made possible by fox news channel] captioned by the national captioning institute --www.ncicap.org-- jon: new fallout from the cia. the agency is said to be at an all-time low former route. many operatives are making a difficult decision, giving up their careers, getting out of the business of protecting america. this decision to investigate employees -- how does that impact in morale? >> we have spoken before about individuals who wants works for them, want to be careful about making broad conclusions about the entire work force. but there was one scene that a merchant the conversation, the feeling people were dismayed. one source put it this way. anyone would have to think twice about taking controversial assessments. anything that requires a different degree of review, people criticize us for being too risk-averse. if we were not then, we will be now. the government does not have their back in this case. jon: what is the complaint? one main complaint? >> the inspector general's report, which inspected at the interrogation program, the same document has been around five years, reviewed by career officers around the department of justice and federal officers in virginia, and only one case was prosecuted. this was the same data that will now be reviewed again, but it is now a different administration. one of our contacts said that he sees an example of people seeking other work. he had heard about it. he put it this way. one company received a large number of the mills from the inside, saying, can you help me find a job, i am tired of second-guessing and looking over my shoulder. jon: you talked to people associated with the agency. what about the agency itself? >> u.s. intelligence officials said to me separately that you have to remember that this is a program that is almost over, four intelligence officials. jane: a final farewell to senator kennedy. his family is getting ready for private mass at hyannis port, massachusetts. the flag is set to be at half- staff. it will be off just an hour and a half from now, with several stops or whether. president obama is set to deliver a eulogy at the funeral. major garrett has more on the funeral and what you see. >> right now, they are banking at the beach in martha's vineyard. since news came of the senator's passing, they have tried to adjust, but also enjoyed a little relaxation. they went to one of the popular ice cream spots on the island, nancies, and were captured on video in joining some of the delights of the island, as it were, and biking. clearly, they are trying to relax before the president delivers the eulogy on saturday. he will not attend events today or tomorrow. his only appearance will be at the eulogy saturday at the old mission church in boston, that is how it is commonly known. he will not accompany the casket to d.c. were be there for the burial at arlington. jane: a lot of talk today about ted kennedy. he has not been able to get people to compromise on capitol hill, and what his absence now means to get health care reform passed. what are democrats and republicans saying? >> ted kennedy's absence has always been felt in this debate. democrats said that yesterday. clara castle said that if he had been here running the committee that wrote much of the panel he would have had a different feel for where the politics of the votes are. but now they are trying to say it is time to push even more aggressively for reform. that is largely preteen to an already-converted choir. the message from democrats is that in their advocacy, are they going to pull independenta alone the line? that will be a real test for the obama white house. jane: major, thanks. jon: new information on a tropical storm danny. we have more details from the fox weather center. >> still 60 miles an hour sustained winds, and the center of the storm is to the west of where we see the convection. we have got to see those thunderstorms wrapped around the center. the track has not changed much. they are edging everywhere from coastal carolina to coastal maine. we expect the strength to strengthen to category one, brushing close to cape cod, up toward nova scotia. long island, we cannot rule them out either. it could be dangerous headed into the weekend. one to watch. keep it here. jane: breaking out of houston, texas, allen stanford has just been rushed to the hospital this 40. we do not know anything of his condition. he was set to appear in court this morning on a hearing about whether he can get a new attorney. this comes after he also is said to be in court, expecting to change his plea to guilty for his role in the fraud. jon: awaiting the latest numbers on unemployment. >> when it comes to production, we're talking about gross domestic product, which measures how strong or weak our economy is. this reading her shows a decline of one %, actually better than what economists were expecting, and better than the - 6% begot in the first quarter. it still shows that the economy is contracting, or shrinking. if you put that together with jobless claims today, we still love more than 570,000 americans filing for first-time unemployment and more americans opting for extended benefit period. the dow is down about 70 points after seven straight days of gains. it also might be time for the markets take a breather. jane: h1n1 has forced a quarantine of cadets during their first weeks of basic training. how about where they hit? >> cadets were hit pretty hard, but they responded pretty quickly. what they did in part was to isolate anyone who came into the academy with flu symptoms. they isolated 245 total during the course of this outbreak. it was a little bit longer than a month. at the dorm there, they dedicated to the dual source to the h1n1 and the unit. they had isolation on the entire area, checking things out constantly, with meals brought in. they try to make sure they kept separate from the rest of the population here on the base. jane: is this something that can be duplicated? >> that is a big question. a representative said it is unique here at the air force academy, because they have an extremely controlled environment already, so they were able to keep students in the dorms when they needed to. when you talk about civilians, the recommendation can go out to stay in your dorm room, but they cannot make sure it happens. a big issue is compliance. >> our cadets ran away understood the seriousness of this, and that is key, recognizing it early and developing a plan, following that plan. >> part of the plan was making sure the cadets were educated. jon: a horrible crime in a peaceful place. a pastor murdered in church and she gave a sermon. or just one brita faucet filter. ( drop plinks ) brita-- better for the environment and your wallet. you weren't always my favorite day. with all the pet hair in the air, i'd spend class preoccupied, bothered by itchy eyes. but now i have new zyrtec® itchy eye drops. it works fast, with just one drop, to relieve my itchy eyes from allergies for up to 12 hours. no other allergy itchy eye drop works faster or longer. which is good, 'cause there's a lotta paws to shake. with new zyrtec® itchy eye drops i can love the air™. (announcer) find it in the allergy aisle next to other zyrtec® products. jane: oklahoma investigators are warning ministers in the area to be more cautious after the murder of carol daniels. she was killed inside a church in oklahoma. we have a publication director for the state bureau of investigations. i'm sure you heard that her body was found in a staged position, and investigators are haunted, according to local articles, but the nature of the killing, calling it very spooky. >> they are saying if this is a homicide, we need to investigate it aggressively and find out who did it. jane: she had multiple sharp force injuries. was that caused by a knife? >> only the killer and law- enforcement know at the time. jane: can you talk about where this happened? this is not hurt church? >> this is a church she has been passed report for five or six years. she started when the local pasteur became ill and they asked she fell in for him. they did not think it would happen, but this was an older congregation, and it sometimes, she would bring older members to the church. on this day, this past sunday, we believe she was killed sometime between 10 and new. we do not know at this point, but it was probably someone local from the area. we do not know if it was a target from the church. we're getting a lot of information coming in. we are running a lot of leads right now. jane: are they being targeted? >> we do not know who is being targeted. we do not know if this was a random act. a lot of pasteur's in the area are afraid because of the situation. and they want to let them know that just because they live in a small town, that does not mean large times can not happen. in need to be aware of who is around you and lot of doors. -- lock your doors, be aware of who is around you. jane: can you confirm what might be on surveillance tapes? >> i am aware of any tapes at this time. jane: just to brown, from the oklahoma state bureau of investigation. thank you. jon: a new rallying cry in the battle for health care reform. the deaths of ted kennedy complicates the matter for the president and allies on capitol hill. but some allies say that the late senator might help pass the plan, even posthumously. how that could happen, next. some lunch. you hungry? yeah. me too. (door crashes in) (broadview alarm) (gasp and scream) go! go! go! go! go! go! (phone rings) hello? this is mark with broadview security. is everything okay? no. someone just tried to break in. i'm sending help right now. thank you. (announcer) brink's home security is now broadview security. call now to install the standard system for just $99. the proven technology of a broadview security system delivers rapid response from highly trained professionals, 24 hours a day. call now to get the $99 installation, plus a second keypad installed free. and, you could save up to 20% on your homeowner's insurance. call now - and get the system installed for just $99. >> a very cold case just got very hot in northern california. we're hearing now suspects have been arrested and are in custody and a young woman has just walked into a police station antenna, barring california, saying that she was all grown up and was the little girl kidnapped from her parents' home in lake tahoe 18 years ago. her name is stacey lead. the guard -- this woman walked into the police station, and the police said we have got your doctor who was kidnapped 18 years ago, on the morning of june 10, 1991. she was getting ready to leave for south lake tahoe, and catch her school bus when somebody snatched her from the driveway and drove her away. parents have never found out what happened. i want to make some phone calls on this and find out anything can. the mother is on her way right now. she says that she from the phone conversation is 90% sure that this is for little daughter. this would be a huge development if it turns out to be true. what is developing. jon: senator edward kennedy was a vocal advocate for health care reform, and his death leaves senate democrats with one less vote, meaning that the party loses its crucial 60-vote margin, but it has also become a rallying point, with some democrats bowling that they will win one for him. joining us now is whether higgins. faceoff for all also have bob beckel. we also have bob beckel. >> you have to have a team to win, and frankly, as much as i would like to think so, it would be hard for me to imagine a blue dog democrat going back to north carolina saying i want to win this one for ted kennedy. the problem with democrats is among those moderate conservative democrats were kennedy is not politically helpful, i think there is a lot of feeling for teddy here and they want to help, but in the end, it does not change to the opinion. jon: they said he was a master legislator. what about it? >> bob is right. he was beloved in d.c. and boston. i think we may hear some eulogies. ted kennedy was the poster child for those who objected to the notion of government running everything. if he had died in november, that would have sparked greater emotional impact, but the way this will play out over time is, this is not your normal bill were compromise is really appropriate as it would be. there is a philosophical gulf between human beings as widgets that ought to be regulated by government first the idea that patients and doctors should have been making their own choices about their own bodies, the idea that everything can be employed and improved, versus a world of scarcity. jon: bob, if you are campaigning to get this passed, when al franken got there, he you had 60 votes. now you have 59. >> the math makes it more difficult. costs are out of control, it is bankrupting america, and we will put it right on the republican plate. they have no alternatives and put up with nothing. they said, we did the best we can do, we lost ted kennedy, we could not get the boats we needed, but we tried to get it done. the votes upon to insurance companies, and nothing is getting done. >> interest companies are not doing anything. is the citizens concerned about this. have you seen those unions? the union-turning out? we know who they are. the reality is, you say something often enough about the party of no and maybe somebody believes it. anyone looking at legislative history knows that there are a bunch of opinions that they have tried to get through on malpractice and form -- reform. but the reality is, nobody is looking at them. it is not republicans were thinking this. it is democrats understand the reality, and it is not republicans who are killing us. jon: we will have to let you come on and finish this debate another time. thank you very much. jane: white tail montana, population 71. about three people crossed the border to canada here every day. so why did they just get $15 million in stimulus money, your tax dollars? politics at play? and it is only a test, but an important one. the first test of a rocket lying there on its side jane: when president obama announced that stimulus package, he said he was basically banning politicians from using earmarked to pay for pet projects. senator $20 million -- $700 million were spent on border crossings. the associated press has discovered that low purdy checkpoints were chosen even though they work on bottom of the list. white tail, montana, will get $50 million to build a new border station. the town has a population of 71 and about three travelers a day cross the border here. so why the new station? janet napolitano was pressure to dump this project up. they say that senator tester boasted about this project, using his influence. 4200 trucks a day, rated among the highest priority, yes this was passed over for stimulus money. how did this happen? >> they were doing a stimulus package, putting that together. no question laredo does not need a lot of investment and border crossings. is the construction ready to go? do they have all of their permits? you have the international crossing. it may be that laredo was just not in a position to get going in the next year or two. that being said, you want to use hyperbole products as the first to get the money. frankly, many of the border crossings have been waiting for years to get the kind of assistance for capacity, not only good for the border, but for the economy as a whole. jane: is this a clean process? >> setting priorities are something that have been done with discussion. both of the locals looking for the standard of customs and border protection, where they think the flow is the greatest and the need is the greatest. we actually put together a very detailed plan submitted to congress a year ago that laid out a disciplined process, and the agency likes to follow that, so when the competition starts to approach, it is not generally a welcome courage -- current. jane: this was supposed to be more transparent than the stimulus money. deputy commissioner in customs said you just have to have a certain level of trust in your government because there's really no way for the public to know exactly how this money is being spent. you agree with them? >> some things are confidential, but you can give the public a good idea of the basic considerations. what is the economic gap church impact, how does it increase? i think it's certainly would help the department, the more they can make public. frankly, that tends to dispel the mystery. the more you keep private, the easier it is to speculate on something improper happening. jon: police into one less as they have arrest 6 deadman -- police and to what i have arrested six men for a plant to sell steel as >> scrap metal. the plan may face federal charges because the area is federal property. jane: chris gutierrez is live at this technical site in utah. explain what you see there now and what we will be seeing in a couple of hours. >> we will have the panel called of. it all has to do with the constellation program, that is the rocket down there. you can take a look. 154 feet long. essentially it is the tail end of this area's one rocket that you see here. i want to bring in a former astronaut who commanded two space stations. >> we are leveraging what we know of the system. what makes the entire system safer is the board on it. even if you lose a rocket, it is designed to get the crew awake with a solid booster. >> and obviously, nasa is not using this yet. we could use one of these rockets but the arriving capsule on top, and this is stage one. this is stage one. 48 different components of this rocket alone have already been used on the shuttle. isn't that amazing? some of your missions are being used right here. explain that. >> that is right. >> the other neat thing about this rocket is that it has got five segments, whereas the space shuttle, that fits segment is used to get astronaut's further in space, right? >> yes, it allows for a saber -- safer trajectory. significantly safer than what was evaluated intently. >> we commonly call about rocket science. thank you for your time. we will see this later, but one of the few things i have learned is that the wind out here, the gas will be 5630 degrees fahrenheit, and flames shooting out of the back of that rocket come out at mach 3. truly amazing. jane: that is cool. we will be looking for that a bit later on. thanks. jon: happening now in hyannis port, massachusetts, senator kennedy's family is getting ready for a private mass. once a concludes, the family will market a motorcade to accompany his body to the jfk library in boston, where senator kennedy will lie in repose. along the way, the motorcade is to stop in certain sites, such as the massachusetts state house, boston, and come off annual hall, and boston's mayor will bring the bell -- ring the bell at fanuiel hall. thousands are expected. the motorcade is expected to get under way a little less than an hour for. jane: the dow has been down 53 points or so. the recession is bad as a whole, but there are a few bright spots as a consumer. jenna lee definitely is, and she calls this a recession yield? >> recession chic. a couple of things to tell you about. mcdonald's is actually looking to beef up, if you will, their dollar menu, adding more breakfast items. the first items that have ever had on their dollar menu 4 breakfast. they're only doing this in certain areas, like chicago, and it is not permanent. but breakfast is very popular for mcdonnell, so it might be something to keep an eye on. also, microsoft will drop the price of the xbox by $100. for any of you gamers out there might want to check that out. microsoft says it has nothing to do with the fact that sony dropped the price of their system just a few days ago. but you can make your own mind. either way, the consumer wins. and the price of milk is actually down about 1/4 from last year. we're down about 99 cents for each gallon of milk. last summer, we were paying a whole lot more for a gallon. that bubble in the commodity market is really tough. it is all little bit of a double edge sword. this is not an item we're seeing prices come down, we're seeing them go up, and even though sales are down. it is beer. some of the largest brewers are deciding they are going to raise prices again when their sales are down. and the reason they can do this, and i'm just talking to the experts, is basically brand loyalty. if you drink bud light, for example, you will probably not switch gear based on prices. so that is where we might see little room, and you will see price increases for your favorite years. jane: jon: i am crying in my beer. jane: thank you. see you in a bit. jon: the fourth named storm is working its way towards the east coast. will danny boy grow up to be a hurricane? also, ben bernanke in charge of the nation's money supply. they could not stop thieves from taking something extremely valuable from his personal life. imodium multi-symptom relief combines two powerful medicines for fast relief of your diarrhea symptoms, so you can get back out there. imodium. get back out there. it doesn't cover everything. and what it doesn't cover can cost you some money. that's why you should consider... an aarp medicare supplement insurance plan... insured by united healthcare insurance company. it can help cover some of what medicare doesn't... so you could save up to thousands of dollars... in out-of-pocket expenses. call now for this free information kit... and medicare guide. if you're turning 65 or you're already on medicare, you should know about this card; it's the only one of its kind... that carries the aarp name -- see if it's right for you. you choose your doctor. you choose your hospital. there are no networks and no referrals needed. help protect yourself from some of what medicare doesn't cover. save up to thousands of dollars... on potential out-of-pocket expenses... with an aarp medicare supplement insurance plan... insured by united healthcare insurance company. call now for your free information kit... and medicare guide and find out... how you could start saving. jane: hurricane danny is getting stronger and heading for the united states. >> around 500 miles away from cape hatteras, and the course of the latest advice for, 11:00 a.m., 50 mile an hour sustained winds. the national hurricane center says if you live along the coast of the carolinas all the way to the coast of maine, you need to pay close attention to this storm, especially headed into the weekend. the storm here, you see those upper-level winds develop into a better looking storm, and we certainly could see a hurricane within the next couple of days. these are the comparable computer models. they make up that cone of uncertainty. 48 hours out, as we head in, things started to lighten up. o long the coastal areas of massachusetts supports maine and into nova scotia, yes, you need to be keeping a close eye on this one. we could see incredible amount of rain. not only do we have this potential hurricane, we also have a potential system moving across the east coast. those combined could be a powerful storm, a storm that could pack a punch. we need to keep monitoring this as we get closer to the weekend. jon: ben bernanke just reported to another term as head of the federal reserve. his job may be safe, but his identity? that is a different story. it appears that he had his personal financial information stolen by our rain that victimized hundreds of others. melanie has the story for us. how did they get a hold of his personal info? >> it started when his wife had her purse stolen last august in starbucks in washington. it ended up in the hands of an identity theft ring. court documents show that a few days after the purse was stolen, someone wrote in $900 check, and this became a bigger issue. 10 banks lost $10 million, and people were church. apparently, the bernankes fell victim to a gang that mixed street crime with a twist. they would take purses come up with their own pictures on them, and inflate the balance and make large withdrawals. clyde austin gray of waldorf maryland pled guilty last month for conspiracy and could get 30 years in prison. his sentencing as next month. jane: a high-tech way of rescuing wounded warriors. we're back in the medics office. you will see that. jon: we are all too familiar with the fact that soldiers with severe injuries also pose huge risks for medics. a new robot medic might help casualties for both war fighters and those that try to rescue them. we have the president of the company testing be medbot. this thing is called bear, right? what does that mean? >> its stance for battlefield extraction insist program, a robot intended to rescue a wounded soldiers. jon: you could rescue the soldiers if you put a robot in the line of fire. >> yes. we have all seen the scene in " full metal jacket," for a sniper is waiting to shoot his body after he comes out to rescue his friend. if they come out with the robot, it will save lives. to the best of our knowledge, this is the world's most powerful and versatile human our robot -- a humanoid robots. it can smash through doors, karate chop to by force -- two =-by-fours. it can also handle light bulbs or eggs without breaking them. this is important. jon: if a soldier is down on the battlefield, you send a robot to bring him to the point of safety and medics do not have to risk their lives. >> that is right. if the robot takes firework it's destroyed, it is a piece of machinery. you do not have to send a letter home to loved ones. jon: at the same time, our marines and soldiers and navy personnel do not want to leave someone behind on the battlefield. in many cases, aren't humans don't want to go out there and rescue their wounded brother? >> you are right. we of tremendous respect for our military first responders, and they are not going to leave their bodies behind. we put them in an awkward situation when we expect to go out and get shot or go into a dangerous situation. we want to least give them an option of sending a piece of equipment out rather than putting additional human life at risk. jon: and there are other applications. for instance, going into a partially collapsed mine to bring out rescued miners who might be trapped. >> absolutely. we realized early on that we could build a robot capable of rescue people, and it could be capable the whole range of other missions, from logistics', loading and unloading trucks, doing security detail, etc., and being there when you need it. jon: how long before we might see this thing? >> given funding, it could be out there within just a few years. jon: thank you. we wish you well. jane: we're watching massachusetts at this hour. senator kennedy's family is getting ready for a private mass set to start at the top of the hour. you see this motorcade there. we're also seeing a eulogy delivered at the funeral on saturday, and major is told that the president has begun its first draft. ..xn0] jane: new on the east coast, a mass is set to begin in massachusetts for senator kennedy. we expect to see the motorcade apart from the kennedy compound and will see live pictures there. they will be headed from boston, carrying the senator's body in a hearse, where he will lie in repose at the jfk library. the will make a few stops along the way, stops important to senator kennedy and his family. his funeral is set for saturday morning in boston. friends and colleagues are saying goodbye. massachusetts lawmakers must soon decide on what to do with the seat. there is a following for carl cameron on capitol hill. exchange -- explained the situation. >> a state law in massachusetts does not allow the governor to appoint an interim senator. the irony is that the law was changed with lobbying pressure of none other than ted kennedy in 2004. at that time, john kerry was running for president, and had he won, the massachusetts governor had the authority, and that was mitt romney. democrats were already fully worried that if carey had one, they would have a republican senator -- if kerry had won. [captioning made possible by fox news channel] captioned by the national captioning institute --www.ncicap.org-- as soon as labor day, they could put an appointee in place that would protect the majority for democrats and vote on health care in kennedy's place. a couple candidates are certainly going to run. one is steve lynch, a long serving congressman from south boston, very popular, a roman catholic, a labor-oriented blue- collar guy, and he is incredibly popular produce a pro-life centrist democrat, leading many polls. in addition, mark the copley is running, and she is on an upward trajectory among democrats. and mike capuono, a liberal democrat from outside boston. joe kennedy, a businessman involved in energy policy and businesses in greater new england has also been talking about it, so he is not ruling it out. folks are saying this time there might not be a kennedy, which could make it, the most competitive races we have seen in a long time. it has been over 60 years since jack and ted kennedy did not occupy that seat. jane: pretty incredible. we continue to watch the motorcade, including a curse, that will be carrying kennedy's body. it is expected to start moving 30 minutes or so from now. the family is taking part in a private mass there. the motorcade will head northwest to boston. >> you are going to have to stop, or you are going to have to leave. this woman right there, please. goodbye. [applause] jon: john mccain there, showing a heckler the door at his town hall meeting in phoenix to the applause of attendees. the republican senator has made clear that he is opposed to government run health insurance plans. mike emanuel is live in washington with where the debate is now. why did the heckler get tossed out? >> all indicators said that she was an anti-war protester. as you see on capitol hill, they interrupt hearing and that sort of thing. he said he would answer a question of she stop yelling. she was then peacefully removed from the room. jon: what response of missing from congress as a result of these meetings? >> a lot of members of congress seem better prepared for these interruptions, how they would handle those scenarios. yesterday, there was one meeting at 8:00 a.m. in the morning, so the theory is, people are sleepy, they might not be as feisty. another idea is that some on capitol kill have said they do not announce these events in advance so organized protesters do not show up. so the quietly announce them before the event, hoping to avoid an organized protest derailing the whole event. jon: we talked about what senator kennedy's posthumous affect on the debate might be. what is your take? >> they have already said that democrats are planning to name the bill for him when it emerges from negotiations. but the question is, will it be a major impact? people love senator kennedy were already on board, and polling shows health care reform to not be popular, wildly unpopular, with a lot of people in the country. while they may have sent a metal feelings towards kennedy, it is not clear if that will be a major impact on passing reform through. jane: one thing that could impact travel plans for those attending the funeral this weekend is this tropical storm, name to danny. right now it is 500 miles southeast of cape hatteras. things could change significantly in the next 12 hours to 24 hours. >> as we go further out in time, remember bill? we had a handle on what he was going to do. we saw all of the computer models an agreement that he was going to swiftly be taken out to sea. not so much with this storm, danny. as we go further out in time, computer models are not decisive on where the storm will go, and right now it is very disorganized. until the storm gets to the center of circulation it is hard to pinpoint where it will go and where landfall is going to be. one thing for certain is that the waters are going here, and that could lead to intensification. will it become a massive hurricane? at this time, we think minimal, but it will impact the coastline, regardless. we will see a rip currents and the potential for showers, thunderstorms, and gusty wind. we have a tiny system coming across the east coast and the system combined could give us a very, very potent storm. this is the track as of 11:00 a.m.. we are starting to get the indications that we're putting watches up. all interests need to be monitored very carefully. jon: a story fraught with drama unfolding in california. a woman steps forward, claiming to be the girl kidnapped just blocks from herself like talk to -- like her south lake tahoe home years ago. harris faulkner has details. >> she was just 11 years old as she stepped out of her home and vanished in eight car. her father said she was taken, and we hear now that two suspects, and man and woman, have been arrested. we are waiting for the el dorado county sheriff's department and fbi told a news conference later today, and we're hoping is true is that the young woman who has come forward 18 years later is the little girl you just saw and those pictures, taken from her home. credible enough for the fbi and several police departments in northern california and her parents to believe that this is the miracle they have been waiting for. we are all over this story, we have been on the phone today trying to piece together everything. the father spoke with our fox affiliates, very emotional, talking about the fact they believe 90% sure that this is her. what a story. back to you guys. jon: that reminds me of the elizabeth smart case. 18 years. jane: we are also keeping our eyes on hyannis port, massachusetts. the late senator's motorcade is set to depart soon. the family is attending a private mass and will be heading to boston, where his body will lie in repose at the jfk library. jon: also, pirates strike back. the navy says one of its helicopters was fired on while patrolling near africa, trying to gather intelligence. we will talk with a spokesman, coming up. i was in the grocery store when i had a heart attack. my daughter was with me. i took a bayer aspirin out of my purse and chewed it. my doctor said the bayer aspirin saved my life. please talk to your doctor about aspirin and your heart. i'm going to be grandma for a long time. jon: siring on a u.s. navy helicopter firing nearby. a large caliber weapon was fired one of the helicopters, a shot that could have done serious damage. luckily, the pirates missed. joining us now, a deputy spokesman for the fifth fleet combined maritime forces. this is the first time the pirates have actually fired on eight military chopper? >> the helicopter has been fired at, and it is the first time they have taken aggressive action. jon: what kind of response did they get? did the chopper fire back? >> the helicopter was more than a mile and a half away. the crew observe activity but did not ascertain action. rules of engagement are set to assure that our forces do not escalate force on necessarily -- unnecessarily. jon: we have some video recorded by another navy chopper. as you said, 3000 yards away, quite a distance. but you can see the gunman firing on our navy personnel. hard to believe, this ship has been held hostage since april, and the pirates have sort of turned it into a floating mother ship where the state attacks, including, as i understand it, the attack on the alabama that ended with three parents killed by navy stripers. >> that is correct. they are holding more than 30 mariners hostage. our primary concerns is for their safety. for the safety of those aboard the ship. jon: so blowing it out of the water is not an option for the navy. >> i will not get into that with you, but our primary concern is with hostages, insuring their safe return to hostages -- family. it is interesting. right about this time of year, the monsoon season sets off. you are looking at in between 10 foot and 15 foot seas, and i'm sure viewers have seen pictures, they certainly do not fare too well on heavy seas. our belief here is that since the weather calms down, pirates will continue with their attacks on merchant mariners in the area. jon: thank you. jane: russia has formally charged the suspected hijackers of the "arctic sea is out of the freighter vanished on the 21st of july, and it was found near algeria, where it was headed. the cargo may have been sensitive. jon: we're waiting for the departure of the motorcade carrying the body of late senator edward kennedy from massachusetts. the family is now having a private mass. when the motorcade departs, we will take you there live. also, the motions i have -- the emotions intensify at healthcare meetings. one key architect, a medical doctor, joins us like to talk strategy. that is ahead. spectacular. women who drink crystal light drink 20% more water. crystal light. make a delicious change. jon: live pictures from hyannis port, massachusetts. a collection of houses on the water there. they are there celebrating mass , with limousines and so forth, and a hearse carrying the body of ted kennedy will go all the way to boston. along the way, they will stop and visit points of interest that have been pivotal, places like st. stephen's church, where his mother, rose, was baptized and her funeral mass was celebrated. they will bring diwan processional all the way to boston, where the late senator's body will lie in repose for twa's at the jfk library. when the procession begins, we will take you there live. jane: new numbers are virtually identical to this poll on the same period a majority, 53%, are still against it. tom price is with us now, chairman of the study group, and congressman price was a practicing physician for many years. >> the american people have focused on the issue of health care and said loudly and clearly that they do not want a government takeover of american medicine. did not want a government-run program. but the good news is all of us believe the status quo is unacceptable and we can move and a positive direction, and that is what i hope we will do when we get back to washington after labor day, come together and work on a solution to get folks insured that are not insured, making sure that medical decisions remain between patients and doctors and we can keep the liability crisis. jane: so they are saying let's start it over? >> they are taking leadership. the question is whether moderate democrats will listen to leadership or constituents. so far, we have not seen people interested in working together for a positive solution. we believe there is a solution embracing the things that are good and of high quality, fixing the things that are failing. those things can be relatively easily fixed without the government taking over health care. jane: what about senator lieberman is idea that we do this piece by piece? take it slowly, but surely? >> not a bad idea. if we had started that way we could have come together in a bipartisan way. but that is leadership. in washington right now, the president, speaker policy, even harry reid have not been interested or willing to come together with the public and come up with a bipartisan solution. jane: they are in power, so how does that change, and where does the optimism come from? >> it depends on what they want to do. if it wanted jam a program through and have a government run everything, they have the numbers to do that. the problem is, that is not where the people are, and that is what we have seen in august. hopefully, representatives will be responsible to their constituencies and put together a plan that we believe could be done, getting folks without insurance insured, making sure that medical decisions are made between patients and families and doctors to solve a liability challenges we have and make sure that insurance is portable. we have some reform so people can take their insurance with them if they change their job. jane: i know you say that it is deficit neutral, but the cbo has not studied that, so we cannot say. we will see where it goes. jon: we're still waiting for the motorcade in massachusetts to get under way. the kennedy family is in the compound. they will accompany the hearse carrying the senator's body of a way to boston. to silence headaches... doctors recommend tylenol... more than any other brand... of pain reliever. tylenol rapid release gels... release medicine fast. so you can stop headaches... and feel better fast. what will happen tonight and tomorrow? >> they are expected to arrive at the presidential library and museum 4:00 this afternoon. it will be a long procession. the north and in boston, they will stop there, because that is where rose fitzgerald kennedy was going and where her funeral mass was celebrated. she died at the age of 104 years old, and after that, they will drive by the parkway, a big green space. they opened up this huge park land, one of ted kennedy's major initiatives, he wanted to provide the screen mothers and children. then it is on 24 annual hall. a few other stops, some office buildings, and it would not be a complete tour without occurs through south boston. that is the ira's section of town, a not to senator ted kennedy's irish roots. the irish museum of means so much to senator kennedy. the family will speak to mourners and those coming by to pay their respects and say farewell. jon: quite a large family. the most prominent american political family. any member count? >> we do not have exact numbers and honestly do not know who is in sight. robert kennedy has been here, that's sort of things. but there were a large number of cars who just came in for the motorcade, so we can expect that this is a big family. ted kennedy became a father like figure to well over a dozen nieces and nephews, so many of them are expected to be here to take part in this high historic turning. sadly, today, they are celebrating the passing of senator ted kennedy. jane: this live picture is so stunning, with the atlantic there and what the house this at the kennedy compound with the flag at half staff. this was a place he loves so much, and he spent his entire life. it must have been so peaceful that that is where he spent his last moments. and no major carrier reported that he is being told by some officials and the white house that officials had begun to draft his eulogy that he will deliver. he may have had more details on this, that we are expecting several former presidents to be there, as well? >> officials have been quoted as saying they were expecting former president on hand, and that would not be a surprise. the massachusetts delegates will be there. and you see this beautiful ocean behind me, nantucket sound and the harbor, and this is work kennedy spent so much time over the course of his lifetime. this is where memories were built, as he sailed with his brothers, his eldest brother, joe. he spent so much time in the water with him before he was killed in world war two. this is a place where they learn to sail and swim. you talk about bites at half baskets -- he has been sailing here for years. up until a year ago, he was still on that boat. family members would help him get down with a golf cart, but he was still there in joined the sea until the final week of his life, and that as several flights on it today, the senate fight, u.s. fight, state flag, and a pennant. jon: as jane just mentioned, president obama is expected to speak at the service saturday. major garrett is covering the president during his vacation to martha's vineyard. what can you tell us about what lies ahead? >> the president will be the eulogist at the kennedy funeral saturday, and honored the kennedy family has bestowed, and he picks the mantle of willingly. senior advisers tell me that the president has begun the draft, and senator kennedy's passing, tragic though it is, is not a surprise to the white house. as reported yesterday, obama made inquiries before he came up here as to whether or not it would be advisable or appropriate for him to stop by and see senator kennedy. the word back from the family that it was not a good idea, it would not have been a worthwhile experience for kennedy were the president, and that is why he did not come to see senator kennedy before his passing, though he regularly inquired about doing so. barack obama entered ted kennedy's life late, but kennedy was crucial to his political life. he gave was was at the time the most electrifying endorsement of the campaign, putting his reputation behind this center, something that helped the campaign extremely. david axelrod called it the biggest endorsement of the entire campaign, and you might recall, the obama campaign was not one that actively saw endorsements. they tried to build a grass- roots following and issue the idea that insiders would be the driving force behind the campaign. all that was set aside when kennedy said he would throw his support, reputation, name, and history behind bars obama. when he did so, that gave a tremendous boost to obama. so he will get a small -- an extremely large high honor and privilege on saturday. he will not be joined by his daughters. they will stay here on martha's vineyard. he will be accompanied by michelle obama and senior advisers. with him on the island is valerie jarrett, a close and trusted adviser, and pete prius, also a top adviser, who knew kennedy because he worked for more than 30 years on capitol hill. that will be the present vote shall -- presidential entourage on saturday. the president will not witness the burial at arlington national cemetery. jon: they are taking the casket l out. this processional should be getting underway any minute now. i want to ask you, how does this complicate things for the vacation? obviously, they have to be aware of the fact that they want the man to relax and enjoy time with his family, but at the same time this is a somber time for massachusetts and that the nation, and i understand there have been changes in presidential vacation plans as a result. >> if there have been, they are hard to detect. those of us in the traveling press corps, after seeing the president delivered remarks before 10:00 a.m. yesterday, talking about the passing of kennedy, we thought, well, i guess it will be a quiet day on the compound. they will not want to show themselves visibly, but as it could be considered less than morning a real fashion. they went to martha's vineyard, had some ice cream, greeted the crowd, talked to people, basically tried to enjoy their vacation as originally planned. the message is that they have to get on with their lives, and they have their vacation to enjoy. they went out on a bike ride this morning. they're back at the compound now, having lunch, but they will go out and do more vacation-type things on the vineyard this afternoon. the president does not feel constrained about trying to relax and enjoy his vacation, doing so publicly, even though the nation is watching the stately, gentle, and well- choreographed movements of ted kennedy. it is one of the sad testament to american history that the kennedy family has developed a long-running expertise at the precision, pageantry, and sort of experience of putting well- known americans to rest, doing it in a memorable way. jane: we have live pictures from the jfk library in boston, where the senator's body will lie in repose. we also are getting information that visiting hours at the library will begin tonight at 6 until 11, and tomorrow we will go from eight in the morning to three in the afternoon. bret, carl cameron was covering it a little bit earlier. what is latest on massachusetts politics? >> carl listed a number of people who could fill that seat, and one of them is vicki kennedy, and said to friends and family that she is not interested. but you do not know after this is over whether stepping into that role is a possibility. others -- the list is fairly long of possibilities there but the big question for massachusetts is rather whether they will change along. it was originally at the request of senator kennedy that the governor not a point in replacement and that the election happened within 145 at 160 days. that was meant to prevent mitt romney from 20 republican -- appointing a republican. weeks ago, senator kennedy's family sent a letter to the legislature there to see if they could change it back for this appointment. we will see what happens. my guess is that they make a change and have the governor appoint a replacement, and there are lots of possibilities, a long list. i do want to mention about the funeral mass, we have confirmation now from church officials and others that former president jimmy carter, george h. w. bush, and george w. bush will be there on saturday morning. it will be quite an event. the entire massachusetts delegation for congress will be there, and luminaries from around the world. this is a church that senator kennedy spent a lot of time in, praying there, every day in 2003 when his daughter was going through an fighting lung cancer. she did that successfully and apparently he has spent a lot of time over there in the past year, as well. jane: that basilica has an incredible history. i want to let you know, when you are looking at here is the kennedy compound right there on the edge of the atlantic ocean. the flag there at half staff, the hearst that will carry the senator's body in boston, where he will lie in repose. this is a spot so beloved to him and other members of his family, and this is where he passed away. this is an incredibly gorgeous and peaceful scene. jon: plans now for a private memorial service to take place at the jfk library in boston. friday evening there will be a funeral mass at our lady of perpetual help basilica, commonly known as the mission church in boston's mission hill neighborhood. president barack obama is scheduled to eulogize the late senator, as was mentioned earlier. we're learning a little bit more about who among the kennedys is there at this moment. they've been holding a private mass at the compound. we understand that caroline kennedy schlossberg is his niece, the former daughter, maria shriver, the daughter of eunice kennedy, first lady of california, married to of schwarzenegger, they are there, as is his son patrick kennedy, a rhode island congressman jane: let's talk about the burial which we will see on saturday at arlington national cemetery. do we know how that decision was made to request bharal there? we will be -- he will be joined by his brothers, jfk and rfk. >> he is eligible for burial at arlington because of congressional service and two years in the army. the request was made by the family to put the brothers together, and sealy to rest about 90 feet from bobby kennedy's grave. that is adjacent on the other side to john f. kennedy's grave site with the eternal flame at arlington national cemetery. it will be close to the public, but you'll be able to see the girl on saturday afternoon. -- the burial on saturday afternoon. it will be an interesting event. they will go from the basilica saturday afternoon and the transfer to washington for the burial after that. it is an amazing sight. dick about these three brothers -- think about these three brothers to will be laid next to one another and about the tragedy, the almost shakespearean tragedy of the family and all it has been through. the kennedys, no matter drop political ideology, people fought and looked at this family and all they have been through and their ability to bounce back from their loss -- this is the last of the brothers, and that burial will be very poignant when it happens at arlington. jane: i want to read a quote from senator john kerry, said, "there is a personal and private vigil taking place. it is very spiritual and about as beautiful as it can be. i think it is everything senator kennedy would want it to be. we are told there will be an honor guard, nine members representing all the armed forces in this country that will bring the casket from the home into the hearse. jane: -- jon: teddy kennedy died late tuesday night at 77 after a year-long battle with brain cancer. it had kept him largely out of public view, though he did emerge for a time, he was in denver for the democratic national convention, in which he gave a rousing speech endorsing the now-president obama. he was also there on inauguration day, there at the luncheon, a post-inaugural luncheon, welcoming the new obama administration, and at that luncheon he suffered a seizure that required him to be hospitalized once again. we're getting some indication about the timing of the public admission to the jfk presidential library in boston, where, beginning this evening, mourners will be allowed to pay respects to the late senator as she lies in riposte. i believe that that starts at -- as he lies in reposed. jane: just a little bit of color from the time of the senator's death. even tuesday afternoon, no one thought a bit. it was not until the evening on tuesday the family went in, and that is where the rev. arrived. he had to say that senator kennedy expressed that he did want to go. he did want to go to heaven and die, he was ready. he said there was a lot of peace, and he could not help but think that the world does not know that part of the senator at all, what he had seen. jon: tomorrow, from 8 a.m. to 3:00 p.m., they will wrap up early so the family can have another private service. i have to wonder whether they might need to find a way to extend those. i imagine it will be an absolute mob scene in the slightest way as massachusetts. individuals try to pay their respect for the late senator. we understand that the honor guard has gone into the home there, representing all branches of the military service will be exporting the casket to the hearst, so we expected any moment now. jane: molly, i do not know if you can hear me. can you give us an update on the ground there, what may be getting under way? >> we can see neighbors start to go out on their front porches to give this final farewell. i think really at this point time we're all waiting to hear more, just winning for senator kennedy to begin this journey. just down the street for me, police are still waiting by their motorcycles. they have not gotten on to leave this procession through hyannis port and on through intelsat -- through intelsat -- through hyannis. in march crowd has gathered, and we just want to say farewell. it has been a longtime home. they have enjoyed this for awhile, and now they are wondering if the mystique will pass on now that senator kennedy has passed on, as well. jane: how do police work with this when there are onlookers and neighbors? deserves and allow you to get some reporting done? >> this is something that the local authorities have been dealing with for decades. since the years of service in the senate, this is something that local authorities have down pat. there's a tremendous amount of respect for the kennedy family. they take a lot of pride in this community in allowing the kennedy family to live their lives and joyce summers hear, treating them more as part of the community, neighbors, not mopping them when they walk down the street. so, there is a tremendous amount of respect for people who have grown up with the kennedys as part of their lives. there is also room to breathe, so to speak here in the neighborhood. so, barnstable police are used to this. things are pretty calm. jon: it is the end of an era that we are marking their as we continue to watch the kennedy family compound in hyannis port, massachusetts. this man has represented the state of massachusetts for 47 years. before that, his brother, former president john kennedy held the seat. there was a brief time when there was a caretaker in place in between the two kennedys. every former living president is going to be in attendance on saturday at the funeral to take place at the mission church in boston jane: your thoughts as we watch this? >> it will be interesting to see this motorcade just for the history of it, not just for the kennedy family, but also in boston. if you look at some of the places they will travel by, it was where rose elizabeth fitzgerald was baptized. it is a church that has been around. paul revere was a member of that church. eventually, the burial will be at arlington national cemetery. it will be interesting to watch for the historic value. senator john mccain will also be speaking up for his friend that he said will be irreplaceable in the u.s. senate. jane: we have heard that from both sides of the aisle. we have had some veteran center is saying that his work was his bond. this was a guy who could sit down and hammer out a deal with people. jon: the public invited to the jfk library from 6:00 until 0:00 this evening as the late senator will lie in repose. the motorcade is about to get under way. martha: there is a live shot of the beautiful atlantic ocean in hyannis port, mass., a place where the kennedy family have spent some of their most joyous times as their saddest times. they wait for the hirst to depart from the kennedy compound which is one of the most well- known spots on cape cod, certainly, and in the northeast. good afternoon, everybody. we are waiting for this private mass to finish. the family is in the middle of a private mass now inside the kennedy compound. they will start the motorcade that will take his casket from that will take his casket from their home
