The court further said that if a woman has stated in her evidence that she did not grant sexual consent, the court shall presume that she did not.

Stating that consent during sexual intercourse cannot be implied from the partner’s previous experiences, a Delhi court Wednesday rejected the anticipatory bail application of a Mumbai-based television journalist in a rape case.
The court further said that if a woman has stated in her evidence before the court that she did not consent, the court shall presume that she did not.
