안경사 면허를 갖춘 개인만 안경업소를 개설할 수 있도록 하고 어기면 처벌하도록 한 법 조항이 헌법에 위반되지 않는다는 헌법재판소 판단이 나왔다.
헌재는 A 씨가 의료기사 등에 관한 법률 12조 1항이 기본권을 침해한다며 낸 위헌법률 심판에서 재판관 4대 5 의견으로 합헌 결정했다고 29일 밝혔다. 위헌 의견을 낸 재판관이 위헌 결정 정족수인 6명을 채우지 못해 합헌으로 결론 났다.
안경테 프랜차이즈 사업을 하는 A 씨는 안경사를 고용하고 그 명의로 안경업소를 개설하면서 실제 영업은 회사가 책임지고 수익과 비용을 반씩 분배하는 방식으로 안경원 9곳을 개설했다.
