Suit alleges fraud in timeshare termination

BELLEVILLE — A retired Edwardsville couple claims Consumer Law Protection Lawyers and others fraudulently sold them services to get them out of their timeshare contract.  Ronald D. Kohlmiller and Theresa Kohmiller filed a complaint (and part 2) May 13 in the St. Clair County Circuit Court against Consumer Law Protection LLC, Resort Transfer Group LLC, doing business as Consumer Law Protection Lawyers, Square One Development Group Inc., Premier Reservation Group LLC, Island Hospitality Group LLC and others, alleging violation of the Illinois Consumer Fraud Act.  The Kohlomillers allege in their complaint that they were "subject to a high-pressure sales presentation" from the defendants on Aug. 5, 2020, regarding timeshare termination. They allege the defendants gave them the impression that they were lawyers. They signed a termination and transfer hold agreement with the defendants and paid $16,040. The Kohlmillers claim the defendants falsely represented that proposed state legislation would prevent timeshare owners from retaining attorneys in order to terminate their contracts and concealed the fact that one of the parties to their timeshare contract, Wynham, had a "free exit program." The plaintiffs also claim the defendants concealed being under an injunction, which prohibited them from the sales activities they were practicing. They also allegedly concealed that they faced lawsuits and had a "long history of fraud."

Time share termination agreement was a scam, alleges couple who spent nearly $80K to get out

BELLEVILLE — A couple alleges they were scammed by several businesses that falsely claimed they could help them terminate their time share agreements.  Eugene Smith and Linda Smith filed a complaint April 8 in the Twentieth Judicial Circuit for St. Clair County against Consumer Law Protection LLC, Resort Transfer Group LLC, Square One Development Group Inc., Cloud 9 Hospitality LLC doing business as Four Points by Sheraton, and Matt Titus, Courtney Kirkpatrick, Dan Chudy, Scott Jackson and George and LouAnn Reed alleging violation of the Illinois Consumer Fraud Act.  According to the Smiths' complaint, they were invited to a banquet at the Four Points on March 4, 2021, by the defendants to learn about canceling their timeshare contract with Club Wyndham, Sheraton Vistana and Dikhololo Resorts which they held with their daughters.
