fugitive. so we are going to have to find out exactly what the reason was, but it may be as simple as a judge or an office didn t get the paperwork in time where as ethan s lawyers got his paperwork in, in enough time to challenge the detention. okay, so joey, third degree felony. which is what she s facing. who s in bigger trouble here, tonya or ethan? that s a great question, brianna, good afternoon to you, by the way, good afternoon, danny. you know, it s interesting, because we have someone, the 16-year-old who actually killed four people when he was a juvenile, injuring two. when you look at the consequence to that, and of course there were a lot that talked about the miscarriage of justice in terms of the probation for ten years. now you have the charge we just talked about, his mother, which is the hindering apprehension, which she could face ten years in jail. and of course we know that ethan, because he ll be 19 in april, has to be released from a juvenile detention center
much as, you know, he s a fugitive from justice. as a result of that, he could delay the proceeding. but at the end of the day, i see him back in the united states, facing the violation of probation and the consequence of all the circumstances that comes along with it. this is a bump on the road but you know what, he ll be back. there s so much more ahead. it s really a fascinating and heartbreaking story to watch. joey, danny, thank you guys so much. happy new year to you as well. thank you, brianna, all the best. all the best to you as well. after the break, we re going to be talking about bill cosby. this is his biggest legal battle yet but it might not be his last. i ll be speaking with a lawyer for the young woman whose case might lead to more criminal charges. we live in a pick and choose world.
in texas, killed four people while driving drunk in 2013. this is when he was 16. you ll remember, he was sentenced to probation, not jail, after a defense psychologist testified he was essentially spoiled so rotten and this was through no fault of his own. well, ethan remains in a government lockup in mexico. he s fighting extradition. that brings me to my lawyer, cnn legal analyst joey jackson and danny sev valess. how was it that this mom was returned back but ethan stayed in mexico? it may be a simple an issue as perhaps paperwork not getting to the right office in enough time. tonya couch stands in a slightly different position than does ethan. ethan is actually considered a fugiti fugitive. tonya couch at the time had not yet been charged with any crime. she will of course now be charged with a third degree felony in texas of harboring a
so i think ultimately what the authorities are looking to do in texas, brianna, is to move his probation to adult court so that in the future should he violate he will be subjected to a much harsher punishment. the mother, based upon her intentionally harboring and really getting him out of the country and working to evade capture, she faces the harsher punishment at the moment. so is that why, danny, you think that maybe ethan isn t necessarily he s fighting to stay in mexico. why is that? just like we heard joey say, it could be a matter of four months in jail. we ve been racking our brains with that very question. but it really begs the bigger question, why go to mexico in the first place. but insofar as he is currently challenging his return to the states, his deportation back to the states, what is the basis. i mean what are the grounds that he can challenge his deportation? he s not lawfully in mexico.
