Florida is about to execute a man sentenced to death by an 8-4 jury before the U.S. Supreme Court ruled such sentences unconstitutional. The sentence shows how haphazard the death penalty can be in Florida.

At least one former Florida Supreme Court justice agrees the proposed law "has serious constitutional implications."
